ORDINANCE NO. 1611
AN ORDINANCE DENYING PETITION FOR ANNEXATION
OF A PARCEL OF PROPERTY CONTIGUOUS TO
THE CITY BOUNDED GENERALLY BY EAST PINE STREET,
HAMRICK ROAD, BEEBE ROAD AND GEBHARDT ROAD
WHEREAS, a petition was heretofore filed with the City of
Central Point, Oregon seeking annexation of the property
described hereinafter, generally bounded by East Pine Street,
Hamrick Road, Beebe Road and Gebhardt Road, said annexation being
sought without an election pursuant to ORS 222.170(2), and
WHEREAS, the public hearing upon said petition for annexation
was held at the regularly scheduled Council meeting of August 18,
1988, and adjourned to the regularly scheduled of September 15,
1988, for the receipt of additional information, and
WHEREAS, the administrative staff of the City has determined
that due to an error in information received from the Jackson
County Elections Department, a comprehensive list of registered
voters in the area sought to be annexed was not received at the
time of the filing of the annexation petition on May 20, 1988,
and the staff having subsequently determined that additional
registered voters resided in said area and that the petition for
annexation was signed by less than one-half of said registered
voters residing therein, and consequently the requirements of ORS
222.170(2) have not been met, now, therefore,
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS:
Section 1. The petition for the annexation to the City of
Central Point of the parcels of real property adjacent to the
City bounded by East Pine Street, Hamrick Road, Beebe Road and
Gebhardt Road, which parcels are more particularly described in
Exhibit "A" attached hereto and by this reference incorporated
into the within ordinance, is hereby denied.
Section 2. Having been rendered moot by the denial of the
annexation petition, the proceedings for the withdrawal of the
parcels of property described in Exhibit "A" from the Jackson
County Fire Protection District No. 3 and Bear Creek Valley
Sanitary Authority, and for the establishment of zoning districts
thereon, are hereby dismissed.

Pine Street (formerly Head Road), and the True Point of Beginning;
thence along said south right of way line, North 89° 53' 40" East,
567.31 feet to the Northwest corner of parcel described in Instru-
ment No. 67-07369 of the Official Records of Jackson County, Oregon;
thence along the westerly boundary of said parcel, South 16° 41' S0"

2.04 chains (134.64 feet) South of the Northeast corner of
Section 2 in Township 37 South, Range 2 West, Willamette Meridian,

to the east line of Gebhard Road; thence along said east line of
Gebhard Road, South, 2172 feet, more of less, to a point which
bears East 20.0 feet from the point of beginning of that certain
