HomeMy WebLinkAboutResolution 760 - CPMC Code Amendments - ExtensionsPLANNING COMMISSION RESOLUTION NO. ~ ~ ~ RESOLUTION OF INTEN'T`ION A RESOLUTION DECLARING THE PLANNING COMMI55ION'S INTENT TO INITIATE AN AMENDMENT OF SECTIONS OF THE CENTRAL POINT MUNICIPAL CODE RELATED TO PLANNED UNIT DEVELOPMENTS, 17.7G.Q60 -EXPIRATION; CONDITIONAL U5E PERMITS,17.72.Q7U - EXPIRATION; AND FINAL PLATS, 16.12.01fl - SUBMISSION PROCEDURE IN ORDER TO RESOLVE INCONSISTENCIES RELATED TO TENTATIVE APPROVAL EXPIRATION DATES AND NUMBER OF EXTENSIONS ALLOWED WHEREAS, an amendment of the Central Paint Municipal Cade may be initiated by adoption of a resolution of intention by the Planning Commission; and WHEREAS, the Planning Commission vfthe City of Central Point deems that the public necessity and convenience and the general welfare of the public will benefit by the proposed amendment; NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Central Point, Oregon that it is the intention of the Planning Commission to amend the City of Central Point Municipal Cade Zoning, Title 16 and 17, in order to coordinate Planned Unit Development, Conditional Use Permits, and Final Plat approval expiration dates and number of extensions allowed. Applicant: City of Central Point STAFF SUURC David 7acab, BACI{GRDUND: In CPMC, there is ambiguity related tv expiration dates and extensions allowed for applications far Planned Unit Developments (PUD}, Conditional Use Permits (CUP}, Tentative Plats, and Site Plans. Under current code, CUPS became void one year following the date on which they become effective. CPMC does not specifically address extensions of a tentative plan, but related to final plats states that "within one year after approval of the tentative plan, the applicant shall cause the subdivision to be surveyed and a final plat be prepared." For a PUD, the applicant is required to file a final development plan with the City within six months of approval of the plan. CPMC is silent on the number of extension allowed for PUD, CUP, and Tentative Site Plan applications. At the direction of the Planning Commission, amendments to the code clarifying and coordinating the timing and number of extensions will be prepared for Planning Commission review. FINDINGS: Pending initiation of code amendment. Section 17.10.200 regulates the processing of text amendments to the city code. The proposed change would be processed as a Type IV, Legislative Action [Section 17A5.500}. Findings will be prepared pending initiation of the proposed code amendment by the Planning Commission. ISSUES: Prior discussion with the Planning Commission indicated a concern with the lack of consistency with application expiration dates and the number of extensions allowed by code.
