Education. The Oregon prekindergarten program is operated in coordination with the federal Head Start
program. Oregon defines prekindergartens as programs that are recognized by the department that
provide comprehensive education to maximize the potential of children three and four years of age.
Gerrerat Project Description: The proposed 3,700 square ft. single story Head Start facility, with two
(2) classrooms, 39 students and nine (9) employees on the maximum shift (14 employees total), is
located in the northeast corner of the Central Point Elementary campus. Students would attend either an
a.m. or a p.m. session, similar to kindergarten. The building Footprint will occupy an area approximately
57 ft. by 72 ft. with a future playground parallel to Ash Street. In total, the Head Start facility will
occupy an area measuring approximately 120 ft. (S. Fourth Street) by 220 ft. (Ash Street). The proposed
facility, in relation to the elementary school and the administration building is illustrated in Figure 1.
The Head Start building has been situated in the northeast corner of the Campus to maintain the Third
Street visual corridor for the historic 1908 brick administration building.
On the Campus, there are 135 existing off street parking spaces. The proposed Head Start facility does
not include any additional off street parking. Table 1 is inclusive of the Head Start facility and provides
a summary of the currently available Campus parking.

Conditional Use Criteria: When considering a Conditional Use in the R-1-6 zoning district it is
necessary that the Planning Commission address five (5) criteria as set forth in CPMC Section
17.76.040(E). Each of these five criteria has been reviewed and favorably addressed in Attachment "E"
Planning Department Findings. It needs to be noted that preparation of Attachment "E" is based an an
interpretation of the use classification of the Head Start facility as follows:
The Head Start facility, as part of the Campus, is classified as a subordinate and
sanctioned educational use to the Central Point Elementary School, and as such is
distinctly different from the City's definition of Day Care Center1. This interpretation is
based on the presence of an educational curriculum administered by the State (see
discussion above).
On its own merits, the interpretation is warranted. However, it should be noted that the interpretation
does affect the off-street parking rociuirements for a day care center verses an elementary school. As an
adjunct to the elementary school, the Head Start facility would be required to have a minimum of six (6)

parking spaces (Table 1). As a clay care center, the Head Start facility would be required to have one (1)
space per employee (on the maxirnutn shift) and one (l) space per five {5) children for a minimum of
seventeen (I7) spaces (Table 2}. As a day care center, tl7e Campus still leas adequate off-street parking
to serve both the elementary school, administration building, and I-Iead Start.

The existing Campus parking satisfies the off-street parking spaces required by CPMC Section 17.b4.

FINDINGS:

ISSUES:
1. The interpretation that Head Start is considered an educational facility, therefore the parking
ratio for elementary schools would apply and the minimum required off-street parking is six
(b) spaces.
2. At this time, the location of playground and fencing around the playground has not been
determined. There is potential that the fencing may encroach into the Third Street view
corridor of the historic Administration Building. The view corridor is illustrated in
Attachment G. As defined, the view corridor provides a unique view of the administration
building 100 ft from the centerline of Ash Street to the building.
CONDITIONS OF APPROVAL:
1. Central Point Building Department (Attachment "C") and Rogue Valley Sewer Services
{Altat:hrric~.nl "1)").
2. The applicant sha11 submit signage plans prior to building perrnit approval. Said plans shall be
consistent with the provisions of CPMC Sections 15.24.
3. The approved conditional uses will comply with local, state, and federal health and safety
regulations.

4. The Conditional Use Permit approval shall lapse and become void one (1 }year following the
date on which it becomes effective, unless use is in operation.
5. Future playground equipment, landscaping and fencing shall not encroach into ,the view corridor
as illustrated in Attachment G. Landscaping, playground and fencing location and design shall
be reviewed and approved by the Planning Department prior to construction.

DRW Architecture has been retained to provide architectural design and construction document services for a
new 3,700 single story Head Start Facility located in Central Point, Dregon.
The subject property is located on in the Northern corner of an existing elementary school campus, located at
the intersection of d~ Street and Ash Street in Central Paint Oregon. The surrounding neighborhood consists
of established single family and multi family residences intermixed with corr-rnercial facilities. The
elementary school campus has occupied this site for over75 years and was re-built approximately 10 years
ago.
During the planning of the new can~us, the area where the new head start facility is #o be located was
designated as a future campus expansion area. The District felt this program was compatible with the
elementary school functions and be an asset to the community. The portion of the elementary school campus
where Mead Start will be located is approximately 120' {4`~ St) x 220' (Ash St). P`ouath Street defines the
Northern edge of the subject parcel, Ash. street defines the Western Edge. T'he Primary Bus Ioop entrance for
the elementary school is located to the South and the existing faculty and guest parking lot is located to the
East, When the elementary school was constructed this future expansion area was temporarily developed as
a manicured lawn. There are no natural features associated or impacted with development. All utilities have
previously been stubbed out to the building pad area with the expectation a building would be constructed on
this site.
The addition of the Head Stoat facility to this campus is consistent with the overall occupancy and usage. No
new or di#f'erent functions with: a greater impact will be introduced into the surrounding neighborhood. The
Central Point Elementary School District welcomes this component to it's campus.
In my opinion, due to the fact this is apre-developed site, na environmental issues, modifications to the
natural habitat or neighboring context is being introduced, a further detailed environmental study is not
necessary.

7 7.76.40 Findings and conditions.
The planning commission in granting a conditional use permit shall find as follows:
A. That the site for the proposed use is adequate in size and shape to accommodate the
use and to meet all other development and lot requirements of the subject zoning district and
all other provisions of this code;
The subject parcel for this application is a portion of the ~ 8 acre Central Point
Elementary School campus. The portion to be occupied by Southern Oregon Head
Start is a parcel approximately 720' x 220' in sine and is located in the northern most
corner of the campus and is edged on two sides by 4~' Street and Ash Street The
existing faculty and guest parking lot is located to the east, the bus drop off and pick
up loop is located to the South. When the Central Point Elementary School was
redesigned approximately 7 years ago, this area was allocated for future school
expansion. The current site is a lawn area with a few trees with a caliber of
approximately 2"- 3': One of the existing trees will be relocated.
B. That the site has adequate access to a public street or highway and that the street or
highway is adequate in size and condition to effectively accommodate the traffic that is
expected to be generated by the proposed use;
The neighborhood is currently impacted by the traffic generated by the elementary
school campus. The hours of operation for the new Head Start facility will be
staggered slightly from the schools schedule. The proposed facility will contain two
new classrooms. The points of entry and exit will remain the same. The district will
allow the exiting bus loop to serve as the parent drop off point for head start due to the
fact the busses will not be occupying the site at those times.
C. That the proposed use will have no significant adverse effect on abutting property or the
permitted use thereof. In making this determination, the commission shall consider the
proposed location of improvements on the site; vehicular ingress, egress and internal
circulation; setbacks; height of buildings and structures; wolfs and fences; landscaping;
outdoor fighting; and signs;
The proposed facility is consistent with the function of the elementary school. No
new activities will be introduced to the site. New building is approximately 3,700
square feet. It is a single story structure with materials and colors similar to those of
the elementary school. The refuse and recycling area will be screened with a 6'
concrete block enclosure with a solid steel gate. Mechanical units will also be
screened from view. The proposed play area for head start will be fenced for the
safety of the children. As mentioned in the above paragraph B, vehicle circulation will
not be altered with this proposal. New exterior lighting will consist of building, soffit
mounted and pathway lighting only. No new Light standards are being proposed. All
lighting will screened to focus on the specific task areas and reduce light spill to
neighboring properties.
D. That the establishment, maintenance or operation of the use applied for will comply with
local, state and federal health and safety regulations and therefore will not be detrimental to
the health, safety or general welfare of persons residing or working in the surrounding
neighborhoods and will not be detriments! or injurious to the property and improvements in
the neighborhood or to the general welfare of the community based on the review of those
factors listed in subsection C of this section;
Head Start operation guidelines specify minimum standards for facility maintenance
and operations. These guidelines have been developed specifically to address the
health and life safety of the chfldren. These guidelines are specifically monitored of
regular intervals for facifify licensure. As mentioned above, the activities of the
proposed facility are consistent with those of the elementary school.
E. That any conditions required for approval of the permit are deemed necessary to
protect the public health, safety and general welfare and may include:
1. Adjustments to lot size or yard areas as needed to best accommodate the
proposed use; provided the lots or yard areas conform to the stated minimum dimensions for
the subject zoning district, unless a variance is also granted as provided for in Chapter 17.13,
The proposed building has been located such that all required setbacks have
been satisfied.
2. Increasing street widths, modifications in~street designs ar addition of street signs
or traffic signals to accommodate the traffic generated by the proposed use,
No modifications to existing streets, parking lots or vehicle pathways are being
modified with this application. Anew Head Start sign wilt be placed on the buitding
but witf be under a separate sign permit application.
3. Adjustments to off~street parking requirements in accordance with any unique
characteristics of the proposed use,
No adjusfinenfs to offstreet parking are being requested in this applicafion.
4. Regulation of points of vehicular ingress and egrgss,
No modifications to vehicular ingress and egress are being requested in this
application.
5. Requiring landscaping, irrigation systems, lighting and a property maintenance
program,
The subjectsite is currently a manicured lawn area. This lawn area and
irrigation system wilt be removed and reconfigured as required for construction of the
buitding and new walks. Once completed the lawn and irrigation area will be healed
and repaired. The existing tree within the proposed build[ng pad will be relocated prior
to the start of construction.
6. Regulation of signs and their locations.
No new signs are being requested within this application, new building signage
will be requesfed under a separate sign permit application.
7. Requiring fences, berms, walls, landscaping or other devices of organic or artificial
composition to eliminate or reduce the effects of noise, vibrations, odors, visual
incompatibility or other undesirable effects on surrounding properties,
I11ew fencing will be provided for the children's safety and to mark the
boundaries of the play area. New visual screens will be provided for the
refuselrecycling areas and mechanicaf units.
8. Regulation of time of operations for certain types of uses if their operations may
adversely affect privacy of sleep of persons residing nearby or otherwise conflict with other
community or neighborhood functions,
The hours of operation will be consistent with fhose of the elementary school.
9. Establish a time period within which the subject {and use must be developed,

BUILDING DEPARTMENT COMMENTS
1. Applicant, agent and contractors must comply with all current State of Oregon adopted
codes, and apply for all permits through the Central Point Building Department.
2. If a private storm drain system is proposed it must be reviewed and a permit issued by
the Central Point Plumbing Department.
3. Any private street lighting must be reviewed and permitted by the Central Point
Electrical Department.
4. Provide the building department with a Geotechnical report as required by OSSC
Appendix J and chapter l.8 of the OSSC. A written report of the investigation shall include,
but need not be limited to, the following information:
a. A plot plan showing the location of all test borings and/or excavations.
b. Descriptions and classifications of the materials encountered.
c. Elevations of the water table, if encountered.
d. Recommendations for foundation type and design criteria, including bearing
capacity, provisions to mitigate the effects of expansive soils, provisions to mitigate the effects
of liquefaction and soil strength, and the effects of adjacent loads.
e. When expansive soils are present, special provisions shall be provided in the
foundation design and construction to safeguard against damage due to expansiveness. Said
design shall be based on geotechnical recommendations.
5. Grading/excavation permits are required in accordance with OSSC Appendix 3 and
chapter 1 S and regarding any f 11 material placed on the site. Fills to be used to support the
foundation of any building or structure shall be placed in accordance with accepted engineering
practices. .
A soil investigation report, and a report of satisfactory placement of fill {including
special inspections of placement of fill and compaction) acceptable to the Building Official,
shall be submitted prior to final of the grading/excavation permit. Building permits will not be
issued until grading/excavation permit is f naled.
Exception:
l . The upper l .S foot of fill placed outside of public rights-of way.
2. The upper 1.5 foot of fill that does not underlie buildings, structures, or vehicular
access ways or parking areas.

6. To move or demolish any existing structures located on the property, call the Building
Department for permit requirements.
7. Notify the City Building Department of any existing wells, or septic systems located on
the property.
8. Any development (any man-made change) to improved or unimproved real estate
located within the flood hazard area of the City of Central Point shall require a Development
Permit as set forth in the Central Point Municipal Code 8.24.120.
9. Dust control, erosion control, and track out elimination procedures must be
implemented.
10. Application for building permits will require three sets of complete plans indicating
compliance with Oregon Structural Specialty Code {2005).
11. Fire District 3 will determine fire hydrant locations, as well as access to buildings.
Any changes proposed shall be submitted in writing by the Applicant, or Applicant's
contractor to the Building Department for approval prior to start of work.

There is a 10 inch sewer main on both Fourth and Ash Streets. Sewer service to
the proposed development will require a tap into one of these locations. The permit
for the tap will be issued by RVS upon payment of related development fees.
The proposed development will be required to meet stormwater quality standards as
defined in the Rogue Valley Sewer Services stormwater Quality Design Manual.
RVS requests that approval of the proposed development be conditioned upon the
following:
1. Applicant must obtain sewer connection permits and pay ail related
development charges to RVS prior to the start of construction.
2. The applicant must provide a stormwater management plan for approval by
RVS prior to the start of construction.

INTRODUCTION
In the Matter of a Conditio~~al Use Permit far the purpose of constructing a Southern Crego~i
Head Start facility consisting of two classrooms. The new facility is to be located on the
Central Paint Elementary School campus. The subject property is located in the R-l,
Residential Single-Fa~niIy zoning district and is identified on the Jackson County Assessor's
neap as 37S 2W 11BB, Tax Lot 6700, APN lO1d6129. (Applicant: Southern Oregozz
Head Start, Agent: Kenneth Ogden, AIA, Architect}
CPMC 17.20.030 Conditional uses R-1 Residential Single-family.
The following uses and their accessory uses ar°e permitted in an R-1 district when authorized
in accordance wit1~ Chapter 17.76:
C. Public and parochial early childhood development preschools, nursery schools,
kindergartens or day care centers;
Finding: The proposed Head Start facility is considered an early childhood
development center or a preschool and znay be permitted with a Conditional Use
Permit.
Conclusion: The applicant has met the procedural requirements with the filing of a
Conditional Use Permit application.
CPMC 17.76.040 Cnnrlitional Use Permit: Fitxdings a~trl conditions. The planning
commission in granting a conditional use permit shall find as follows:
A. That the site for the proposed use is adegtcate in size and shape to accommodate the
use and to meet all other development and lot requirements of the subject zoning district and
all other provisions of this code;
Finding: The project is a single story facility to be located an the 7.8 acre Central
Point Elementary campus. The facility will occupy approximately 120 ft. X 220 ft.
land area in the northeast corner of the campus.
Finding: The facility is 3,700 sq. ft with two (2} classrooms, kitchen, amulti-purpose
room and staff office space. The structure is designed to meet the proposed learning
activities.
Conclusion: The project can meet this criterion.
CPMC .17.76.040 (B). That the site has adegicate access to a public street or highway and
that the street or highway is adegicate in size and condition to effectively accommodate the
traffic that is expected to be generated by the proposed use;

streets are i~l~proved City streets with sidewalks. The site is a part of the existing

Finding: The proposed structure is a single stoz•y, 3,700 sq. ft. designed with roof and
siding materials to blend with the existing school and historic administration building.
The applicant states that the future playground will be fenced for child safety utilizing
appropz-iate fencing materials.
Finding: The site plan for the proposed structure provides the necessary setbacks as
required within the R-1-6 district. A clear vision triangle in excess of 25 ft. is
maintained at the corner of Ash and Fourth Streets. A 30 fi. side yard setback fz-om
Ash Street has been planned.
Finding: As discussed in Finding B-l, the project site has public street access with
existing ingz-ess and egress, drop-off and bus loops.
Finding: The Head Start building has been situated in the northeast coz-rzer of the
campus to maintain the Third Street visual corridor for the historic 1908 brick
Administration building. This location also provides access to the existing paved
parking lot, bus and drop off loops. The existing internal circulation pattern will not
be altered with this application.
Finding: The site for this proposed project was identified during the 2001 review for
the Central Point Elementary School {File No. 01038) as evidenced by the proposed
site plan illustration, Staff Report dated August 1, 2001 and Resolution 52b.
ConeIusion: The proposed use is consistent with the R-1-6 zoning district and the
City's intent for this area.
CPMC 17.76.040 (D). That the establishment, maintenance or operation of the use applied
for will comply with local, state and federal health and safety regulations and therefore will

not be detrimental to the health, safety or general k~elfcrre of persons residing or working in

Finding: The Head Start facility will be within a r~cwly constzucted building that leas

Oregon Head Start.
Finding: Head Start operation guidelines specify zniniznum standards for facility
maintenance and operations. These guidelines have been developed specifically to
address the health and safety of the dlildz-en.
Conclusion: The proposal complies.
CPMC 17.76.040 (E), That any conditions required for approval of the permit are deemed
necessary to protect the public health, safety and general welfare and Wray include:
I. Adjustments to lot size or yard areas as needed to best accommodate the proposed rrse;
provided the lots or yard areas conform to the stated nainimttm dimensions for the subject
zoning district, unless a variance is also granted as provided for in Chapter 17.13,
Finding: The site plan of the proposed building illustrates that the structure has been
located such that all required setbacks have been meet or exceeded.
Z. .Increasing street widths, modifications in street designs or addition of street signs or'
traffic signals to accommodate the traffic generated by the proposed use,
Finding: As discussed in Finding B-l, the project site is located on the corner of Ash
and S. Fourth Streets. Both streets are improved City streets with sidewalks. The site
is a part of the existing Central Point Elezxzentary campus with existing ingress and
egress from both Ash and S. Fourth Streets. An existing bus loop on Ash Street and
the existing drop-off loop from Fourth are currently used for student access. The
applicant states that the Central Point School District will allow both to service Head
Start students, therefore Head Start will use the existing ingress and egress points with
no additional access points requested.
Finding: A new Head Start sign will be placed on the building and a sign permit will
be required. Sign standards and permit requirezxzents are found in Section 15.24 of the
CPMC.
3. Adjustments to off-street parking recltcirements in accordance with any unique
characteristics of the proposed use,
Finding: CPMC Section 17.64(E}(2} requires three {3}parking spaces per classroom
for a total of six (6} parking spaces required of the Head Start facility. As presented,

the applicant is proposing the use of six {6) existing off-street parki~~g spaces. 'fhe
campus has 135 existing off street parking spaces, including loading, drop-off a~~d bus
loops. The pa~•king space allocation includes: 63 spaces for the Central Poi~~t
Elementary School and SS spaces far t11e Administration Building as required by
CPMC Section 17.64.040. The existing parking on the campus is adequate in number
to accommodate the ~~eeds of the Head Start Facility {see Table 1 }. However, it needs
to be noted that this finding is based on the interpretation that the Head Start facility is
a subordinate and sanctioned educational use to the Ce~ltral Point Elementary School
campus.

This interpretatio~~/clarification is presented under the authority of CPMC
17.76.040{E){3), which allows the Planning Commission to adjust off-street parking
requirements in accordance with any unique characteristics of the proposed use.
Rather than adjust off street parking requirements the interpretation/clarification of
the use classification of the Head Start program is presented.
Finding: A definition for "day care center" is provided, however curriculum
standards and the classroom setting is absent from the definition.
Finding: Oregon Revised Statutes, Act For 21 S` Century Reform, provides the policy
that Oregon is to implement programs for early childhood education {ORS 329.160).
This section also states that The Oregon prekindergarten program shall continue to be
operated in coordination with the federal Head Start program. Oregon
prekindergartens mean programs that are recognized by the State Department of
Education that maximize the potential of children three and four years of age.'
Finding: Head Start is a national program that promotes school readiness with a
special focus on helping preschoolers develop the early reading and math skills they
need to be successful in school. Head Start services are provided to children with
curriculum standards.

Finding: The proposed Head Start facility provides preschool level instructio~l foi•
children primarily in a classroom setting. Oregon Revised Statutes 329.170{1){b}
defines prckindergartens as pragrains that are recognized by the departincnt {the
Oregon DcpartEnent of Education) that provide; coinprcliensive eclueation to maxiinizc
the potential of children three aEld four years of age. Tl~e early childhood education
program is consistent with the function of the existi~ig elementary school, a permitted
use in the R-1-6 district.
Finding: The Head Start facility, as part of the Campus, is classificcl as a subordinate
and sanctioned educational use to the Central Point Eleme~itary School, and as such is
distinctly different from the City's definition of Day Care Cerzter2. This interpretation
is based on the presence of an educational curriculum administered by the State (see
discussion above}.
Finding: The Head Start facility must meet the early childhood education
performance cui7•iculum starzdaz-ds of both state and federal statutes. By def Wing the
Head Start facility as an educational facility, the parking ratio for eieznentary school
would apply, acid the miniinuin required aff-street parking
Finding: As an adjunct to the elementary school, the Head Start facility would be
required to have a minimum of six {6} parking spaces {Table 1). As a day care center,
the Head Start facility would be required to have one {1}space per employee and one
{ l }space per five children for a minimum of twenty-two (22) spaces {Table 2}. As a
day care center, the Campus would be required to provide an additional five {S)
parking spaces.

Finding: The project site is currently landscaped with planting areas and n~azzicured
lawn area. The applicant states that the lawn area and irrigation system will be
reconfigured as required for the construction of the building and new walkways. This
disturbed area will be replanted. The applicant states that existing trees within the
building pad will be relocated prior to the staz-t of construction.
b. Regulation of signs and their locations,
Finding: Anew Head Start sign is expected to be placed on the building. Prior to
installation, a sign permit is required. The proposed sign will be reviewed for
compliance with the sign requirements. No now signs are being requested with this
application.
7. Requiring fences, berms, walls, landscaping or otlxer devices of organic or artificial
composition to eliminate or reduce the effects of noise, vibrations, odors, visual
incompatibility or other undesirable effects on surrounding properties,
Finding: The applicant states that new fencing will bo provided for the children's
safety and to mark the boundaries of the play area.
Finding: At this time, the location of playground and fencing around the playground
has not been deterrrzined. There is potential that the fencing znay encroach into the
Third Street view corridor of the historic Administration Building. The view corridor
is illustrated in Attachment G of Revised Staff Report dated November 6, 2007. As
defined, the view corridor provides a unique view of the administration building 100
ft from the centerline of Ash Street to the building.
Finding: To protect the view corridor, Condition nuzrzber S of Revised Staff Report
dated November b, 2007 states that future playground equipment, landscaping and
fencing shall not encroach into the view corridor as illustrated in Attachzxzent G
Landscaping, playground and fencing location and design shall be reviewed and
approved by the Planning Department prior to construction.

WHEREAS, on November 6, 2007, the Central Point Planning Commission conducted a
duly-noticed public hearing on the application, at which time it reviewed the City staff

WHEREAS, the Planning Commission's consideration of the application is based on the
standards and criteria applicable to the R-1-6, Residential Single_Family zoning district
section 17.20, Off-Street Parking and Loading section 17.64 and Conditional Use Permit
section 17.76 of the Central Point Municipal code; and
