HomeMy WebLinkAboutResolution 52 - Collins Partition and VariancePLANNING COMMISSION RESOLUTION N0. 52 A RESOLUTION RECOMMENQING APPROVAL OE A MINOR PARTITIONING AND VARIANCE REQUEST AT 141 N. 5th STREET WHEREAS, Lewis R. Collins, pursuant to Central Point Municipal Code, Chapter 16.44, has applied for a minor portion of tax lot #4600, 37-2W-3nD, at 141 N. 5th Street, into two lots approximately 3,850 sq. ft. each, and WHEREAS, the present lot is 55' by 140` with his residence and a rental unit built upon the property, and WHEREAS, a Variance pursuant to Chapter 16.36 is necessary to create 55 ft. wide lots with approximately 3,850 sq. feet; now, therefore, BE IT RESOLVED BY THE CENTRAL POINT PLANNING COMMISSION AS FOLLOWS: Section 1. The testimony by the applicant stated that he received a building permit for a second dwelling in 1957, the City told him he could divide the lot at any time and could build along the alley line. And he was advised by the County Assessor that there was no hurry to divide the lot. And due to his advancing age and his wife's arthritis, they can no longer maintain the rental property nor afford to hire maintenance. Therefore, the Planning Commission finds that extraordinary hardship may result from strict compliance with these regulations and a variance is necessary so that substantial justice may be done and the public interest secured. Section 2. The existing lots across from the applicant's property on 5th Street and Laurel Street are similar sized parcels with single family dwellings. Therefore, the Planning Commission finds that a Variance will not have the effect of nullifying the intent and purpose of the City regulations. And further, granting the Variance wi11 secure substantially the objections of the City regulations in order to preserve the public health, safety, con- venience and general welfare.
