RESOLUTION NO. 49
A RESOLUTION ADOPTING FINDINGS AND APPROVING
A CONDITIONAL USE PERMIT AT 984 SOUTH FRONT
STREET, J. C. MAP PAGE 87-2W-11C, TAX LOT 181
WITH CONDITIONS
WHEREAS, John R. Kuklenski filed application an
January 19, 1982 for a conditional use permit for a Muffler/
Radiator Shop, and
WHEREAS, a public hearing was advertised in the
Medford Mail Tribune on January 29, 1952 and February 1, 1982
for a Planning Commission public hearing on February 2, 1982,
and
WHEREAS, at said public hearing testimony from pro-
ponents and opponents was heard; now, therefore,
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY
OF CENTRAL POINT, OREGON as follows:
Section 1. The Planning Commission of the City of
Central Point hereby adopts the following findings:
1.a. The site for the proposed use is in a sire and
shape larger than required to meet minimum City codes and is
adequate to provide parking, landscaping and open space comparable
with the neighborhood.
1.b. Yards and spaces exceed Code requirements and are
comparable to other neighborhood uses.
l.c. Walls and fences are not required by the City code
but are needed to be comparable with the neighborhood and should
be a condition of approval of the conditional use permit.

l.d. Therefore, the Planning Commission finds that
the site for the proposed use is adequate in size and shape to
accommodate said use and all yards, spaces, walls and fences,
parking, loading, landscaping and other features required are
adequate to adjust said use with land and uses in the neighborhood.
2.a. The site obtains access from Highway 99 and has
received approval from the Oregon State Highway Department far
access and capacity.
2.b. Therefore, the Planning Commission finds that
the site fnr the proposed use, as it relates to streets and high-
ways, is adequate in width and pavement type to carry the quality
and kind of traffic generated by the proposed use.
3.a. The proposed use is a commercial use with
drive-in traffic and caters to minor equipment repair and
rebuilding and is similar to the Fluid Air Components business
to the north.
3.b. The remaining abutting properties are vacant
land with the nearest residential use being 23fl feet distant.
3.c. All vehicular ingress, egress and circulation
will be from Highway 99 and will not effect abutting property.
3.d. Setbacks, building height, fences and land-
scaping, outdoor lighting and signs will all meet City codes
and be compatible with and similar to abutting uses.

3.e. Therefore, the Planning Commission finds that
the proposed use will have no adverse effect on abutting property
or the permitted use thereof. The proposed location of improve-
ments on the site, vehicular ingress and egress and internal
circulation, setbacks, height of buildings, wa11s and fences,
lancscaping, outdoor lighting and signs wi11 all meet City Codes
and be compatible with and similar to abutting uses.
4.a. John R. Kuklenski and Larry Brown are currently
purchasing the land from Alvin Hansen for the purpose of can-
strutting and operating the Muffler/Radiator Shop.
4.b. A specific site plan was not submitted with the
conditional use permit request,
4.c. Fencing is needed in the area to be compatible
with the neighborhood and provide compatible site aesthetics.
4.d. Vehicles using the property which are over
30,000 lbs. gross vehicle weight would not be compatible with
other uses in the area to the north and south.
5.a. The Planning Commission, therefore, finds that
the following conditions are deemed necessary to protect the
public health, safety and general welfare and are hereby adopted
as a part of this resolution.
1. Approval will be contingent upon approval
being received from the City for a minor land partition of the
property or upon showing evidence to the City of a satisfactory
lease agreement from Alvin Hansen to John Kuklenski and Larry
Brown,

2. Approval is contingent upon the City
approving a site plan review for the proposal.
3. Approval is contingent upon fencing
satisfactory to the City being completed along the rear pro-
perty line prior to occupancy and completed upon the remaining
property lines within one year of issuance of an occupancy
permit.
4. Approval is contingent upon the use beizig
allowed only for vehicles under 30,000 lbs. grass vehicle weight.
Section 2_ The Planning Commission of the City of
Central. Point hereby approves a conditional. use permit for a
Muffler/Radiator Shop at 984 South Front Street, contingent
upon the four conditions required above being satisfactorily
completed.
Passed by the Planning Commission and signed by me in
authentication of its passage this 16th day of February, 1982.
