ROLL CALL: Commissioners Connie Moczygexnba, Chuck Piland, Damian Idiart, Candy Fish and Wayne Riggs were present. Commissioner Mack Lewis was absent. Also in attendance were: Don Burt, Planning Manager; Ken Gerschler, Community Planner; Lisa Morgan, Planning Technician; and Didi Thomas, Planning Secretary. III. CORRESPONDENCE There was no correspondence. IV. MINUTES Chuck Piland made a motion to approve the minutes of the May 23, 2006 Planning Commission meeting. Candy Fish seconded the motion: ROLL CALL: Fish, yes; Idiart, abstained; Piland, yes; Riggs, yes. Motion passed. V. PUBLIC APPEARANCES There were no public appearances. VI. BUSINESS A. File No. 05073: A public hearing to consider a recommendation to City Council for a Zone Map Amendment application to rezone approxirrrately .67 acres from R-1-10, Residential Single Family, to R-1-8, Residential Single Family. The property address is 3292 Grant Road and is identified on the Jackson County Assessor's map as 37S 2W 10C, Tax Lot 1900. Brian Poppa, Applicant. Damian Idiart stated for the record that he knew the applicant and his wife but didn't feel that he had a conflict. There were no other conflicts or ex parte communications to disclose. Planning Commission Minrrtee .Irrne b,1006 Page 2 Ken Gerschler, Community Planner, presented the staff report, i3idicating that the subject propcrty was surrounded by other R-l -S parcels and that the R-1-S designation represents the best use of the land. Mr. Gerschler added that infrastructure was adequate to ancet the requircme~~ts of the propcrty, and applicant has provided a master plan for three {3) lots. Mr. Gerschler noted that the ~nastcr plan was tentative and not acceptable at this time. The public portion of the hearing was opened. .lane Marie Pappa, applicant, appeared and stated she and her husband would not be developing the property in the immediate future. Connie Moczygemba explained the importance of getting neighbors involved in discussion concerning future development of the surrounding properties, The public portion of the hearing was closed. Damian Idiart made a motion to adopt Resolution 699 forwarding a favorable recomrrtendation tothe City Council for a Zone Map Amendment from R-1-10 to R-1-8 for property located at 3292 Grant Road (3ackson County Assessor's map 37S 2W lOC, Tax Lot 1900) based on the standards, findings, conclusions and recan~mendations stated in the staff reports, correspondence from agencies and the conditions of approval. File No. 060b4: A public hearing to consider a recommendation to City Council for a Zone Map Amendment application to rezone approximately 1.34 acres from TOD-OS, Open Space to TOD-LMR. The property address is 4270 Grant Road and is identified on the .lacksvn County Assessor's map as 37S 2W 03C, Tax Lots 208 & 228. The project area is located north of Tulane Road, west of Buck Point Street and south of Twin Creeks Crossing. Twin Creeks Development Co., LLC, Applicant. There were no conflicts or ex parte communications to disclose. Planning Technician Lisa Morgan presented a staff report, advising Planning Commission members that the purpose of the zone map amendment was consistent with the land use design and would correct a discrepancy between the Master Plan and the Open Space map for the development. The Open Space map is the correct map. It was noted that staff s recommendation was conditional on the applicant providing amended Master Plan and Open Space maps for the Twin Creeks TOD Master PIan. The public paz-tion of the hearing was opened. Herbert Farber, agent for the applicant, stated that the zone map amendment request was basically a "fix" to the Master Plan for Twin Creeks Development Co. File No. 06084: A public hearing to consider a Conditional Use Permit application to operate an outdoor pottery sales area and lacquer art gallery in a vacant building. The property address is 1480 E. Pine Street and is located in a C-4, Tourist & Office Professional zoning district south of East Pine Street, west of Peninger Road, and north ofLarue Drive; identified on the Jackson County Assessor's map as 37S 2W 02D, Tax Lot 2800. Dale Porter, Applicant. There were no conflicts or ex parte camzxzunications to disclose. Lisa Morgan, Planning Technician, presented a staff a report and indicated that the outdoor sale of pottery created the need for a conditional use permit for this applicant. All other proposed uses are permitted outright. An existing locked gate an the property will need to remain ia~ place as a condition of approval due to the proximity of the Interstate 5 off ramp, In addition, no spray painting will be allowed to occur at the location. Concerns with landscaping and access were discussed. The applicant intends to use the existing planter boxes on the premises for landscaping purposes. The public portion of the hearing was opened. The applicant, Dale Porter, came forward and addressed the Planning Comanission. He presented commissioners with background information on his business and answered questions concerning how plants would be watered, painting of the existing building, signage and ingress and egress. Mr. Porter stated the pottery and lacquer art gallery would be an asset to the City of Central Point and described the characteristics of the pottery and lacquer art to commissioners. The public portion of the hearing was closed. Darr-ian Idiart made a motion to approve resolution 702 to allow for a conditional use permit For the operation of an outdoor pottery sales area and lacquer art gallery on property located at 1.480 E. Pine Street (Jackson County Assessor's map 37S 2W 02D, Tax Lot 2800) based on the standards, findings, conclusions and recommendations stated in the staff reports. Chuck Piland seconded the motion. Each unit will have a two car garage. There will be a deck on the second story. This proposal is similar to those built across from Pfaff Park, with some revisions that will comply with the site plan design criteria. The lot is .18 of an acre. FINDINGS: No f ndings at this time. Action on the tentative plat must be proceeded by approval of the project site plan. FINDINGS: No findings at this time. ISSUES: A thorough review of the application submittals revealed that the design of the project as presented in the Site Plan review (06082, Site Plan Review) did not comply with the site design standards set forth in Section 17.67.050(J). The applicant has been advised and revised plans are being prepared. The one yenr shall commence with the final development plan. Findings: The approval for final development plan shall become null and void on July 18, 2007. Conclusion: The final development plan is consistent with the preliminary plan with the number of lots, lot sizes and lot configurations. The applicant has met all requirements for final development approval. The recommended conditions of approval shall be met prior to the City signing the final plat for recording. Any deviations of the final plat from the approved preliminary plan and final development plan will require reconsideration by the Planning Commission. Minor deviation: The applicant will be doing a 2' Iot line adjustment beiween Lots 19 & 20. 'This 2' lot line adjustment will be reflected in the final plat that gets recorded with the County. Conclusion: The final development plan for Phase II is consistent with the preliminary plan with the number of lots, lot sizes and lot configurations. Civil plans have been approved for both phases by Public Works. The applicant has met all requirements for final development approval.
