RESOLUTION N0. 35
A RESOLLI'I'TON AUTHORIZING SMALL ENGINE SALES AND SERVICE
AS A CONDITIONAL USE IN A C-5 ZONE
WHEREAS, Municipal Code Section 17.60.140 provides that the
Planning Commission may rule that a use not specifically named as an
allowed use in a district is included in the uses for Chat district;
and
WHEREAS, Che City of Central. Point received a request to make a
determination for the appropriate location far sma11 engine sales and service;
now, therefore,
BE IT RESOLVED BY THE CENTRAL POINT PLANNING COMMISSION as follows:
Section 1. Tile Planning Corrunission finds thaC sma11 engine sales
and service is a use not specifically named in the examples of allowed uses
in the zone disCricts and finds further that small engine sales and service
is of the same general type and a similar use and is compatible with other
conditional uses within the C-5 district.
Section 2. Small engine sales and service are hereby ruled to be
a condiCional use in C-5 Thoroughfare Commercial zones, Section 17.46,030 Z.
Passed by Che Planning Commission and signed by me in authenti-

Planning Commission Resolution ~~35
Conditional Uses in C~5 Zone
Staff has recently received several requests as to which zones
allow the operation of chain saw sales and service.
The current zoning code does not allow the operation of this
type of business in any zone. Each of the Commercial zone
definitions has the statement, "Other uses not specified in
this or any other district, if the Planning Commission finds
them to be similar to the uses listed above and compatible
with other permitted uses and with the intent of the C-
district." This paragraph requires that each individual re-
quest be brought before the Planning Commission and City
Council, sometimes requiring the applicant to wait a con-
siderable period of time for approval {depending on meeting
dates and application date).
In an effort to assist our citizens and speed the application
process, Staff prepared a resolution for consideration by the
Planning Commission which would have allowed chain saw sales
and service in the C-5 zone.
Upon review the members of the Planning Commission felt that
this type of request would probably come up again, such as for
lawn mower sales and service, which is not listed as a use in any
Commercial zone. After discussion, the Planning Commissioners
indicated that they felt that a paragraph allowing similar,
compatible uses in all C zones should be developed that would
not require Planning Commission action on each occupation which
is not listed in the ordinance.
Staff suggested modification of this resolution with direction
to prepare the changes suggested above. The prepared resolution
was then rewritten to allow small engine sales and service in
the CT5 zone to cover the broader range of activities which was
the intent of the Planning Commission.
A motion was made and passed unanimously.
