STAFF REPQRT Planning Commission Resolution ~~31 Nonconforming Uses This change in the Zoning Ordinance was prepared far the Planning Commission to provide clarification of the ordinance. The resolution would prohibit the expansion of an occupancy if the occupancy use is nonconforming. The current wording prohibits the moving, altering or enlarging of the structure which contains a nonconforming use. The ordinance does not clearly prohibit the expansion, without structural modification, of a nonconforming use. The following example will help to clarify the situation. If the use of the new City Hall were nonconforming, the City could expand the nonconforming use to both floors of the building, as long as there was no structural moving, alteration or en- larging. This expansion of a Type B nonconforming use is not the type of growth that Mr. Hough was attempting to achieve in his preparation of this ordinance.
