~. This application for site plan approval oaas originally
conditionally granted on August 4, 1992, with one of the conditions
requiring that the applicant make street improvements to Oak Street
and Amy Street adjacent to the project.
2. Applicant has requested that the above-mexation.ed condition
be deleted and replaced by a new condition that the property be
bound to inclusion in any future Local Improvement District
established to construct the necessary street improvements.
3. On February 15, 1994, a duly--noticed and advertised
hearing was held before the Planning Commission wherein the
Planning Commission reviewed a staff report and heard testimony and
evidence submitted by all persons wishing to be heard on the issue.
Now, therefore;
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
CENTRAL POINT, OREGON, A5 FOLLOWS:
Section 1. The site plan approval previously granted by the
Planning Commission an August 4, 1992, for this project is
modified so as to delete the condition that applicant shall
improve Oak Street and Amy Street to the standards set forth in
the Central Point Municipal Code and the Public Works Standards.
Section 2. As grounds for such modification, the Planning
Commission finds that there are no street, highway or alley
improvements within the same block on the same side of the street
adjacent to applicant's property an Oak Street or Array Street, sa
that under CPMC 12.02.OlOC, the Planning Commission may waive the
requiremezit to improve those streets, so long as the applicant
executes the irrevocable consent to inclusion in a Local
Improvement District for those improvements.
Section 3. The condition requiring improvement of Oak
Street and Amy Street shall be, and hereby is, replaced by the
condition that applicant shall execute an irrevocable consent to
the inclusion of the subject property in, a Local Improvement

District for the canstruction of street improvements to Oak
Street and Amy Street. A capy of such consent document is
attached hereto and by this reference incoxpnrated herein.
