Resolution 274 - First Baptist Church Variance
PLANNING COMMISSION RESOLUTION NO. ~~ A RESOLUTION CONDITIONALLY APPROVING A SITE PLAN APPLICATION FOR THE FIRST BAPTIST CHURCH AT 140 OAK STREET, AND A ZONING VARIANCE FOR LOT COVERAGE AND SIDE YARD SETBACK (First Baptist Church, Applicant} {37 2W 10AA Tax Lot 3744} BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLLOWS: 1. Nature of Appl„i,catian. This is an application for site plan approval for a building addition to the First Baptist Church at 140 Oak Street, together with applications for a lot coverage variance and a side setback variance, all in a Commercial Professional Zoning District {C-2}. 2. Criteria Applicable to Decision. The following chapters of the Central Point Municipal Cade apply to this application: 1. Chapter 17.36, C-2, Commercial-Professional District; 2. Chapter 17.b0, General Regulations; 3. Chapter 17.64, Off-Street Parking and Loading; 4. Chapter 17.72, Site Plan, Landscaping and Construction Plan Approval; 5. Chapter 17.80, Variances. 3. Findings. A. The proposal is for the addition of a 3,120 square fact „all purpose" building to the rear of the existing church, to be used as a gymnasium and youth activity center for the church youth programs. The present use is a Class A Non-Conforming Use. Pursuant to CPMC 17.56.464A{2), existing legal, non-conforming structures and uses are permitted to expand, provided such is dare in accordance with all applicable codes in effect at the time of the expansion. B. The building height limitation in a C-2 zone is 50 feet, and the proposed additional building complies with that standard. C. The proposed addition complies with the front and rear yard setbacks contained in CPMC 17.35.050. The side yard setback is required to be 5 feet. The application and map indicate a setback on the westerly side of 3 feet, more or less. A variance is hereby granted for that setback, supported by the applicant's written submitted findings. 1 - PLANNING COMMISSION RESOLUTION NO. ~ (012194) D. The maximum lot coverage i.n a C-2 pane is 50~, pursuant to CPMC 17.36.OSOG. The total lot area is 7,7©© square feet, and the proposed additional structure would bring the lot coverage to approximately 74~. Applicant has requested a variance for this standard, and such variance is hereby granted, suppnrted by the applicant's written submitted findings. E. The proposal meets the requirements of Chapters 17.60 and 17.64 relating to parking. F. The southwest corner of the project is adjacent to the intersection of First Street and the alley immediately south of the proposed additional building. If the alley remains as an access, and the building is placed as per the site plan, the clear visian standards of the City's Public Works Standards will not be met. This issue will be addressed as a condition to the approval. 4. Canditianal APPrnyal. The within application for site plan is hereby conditionally approved, sa long as the following conditions are met: Conditions 1. Clear vision standards relating to the alleyway south of the project require a 25-font clear vision triangle, which cannot be met so long as the alleyway continues to be used as an access to First Street. No building permit shall be issued for the additional building until such time as the alleyway access onto First Street an the south side of the property is completely eliminated, by vacation of the alley and abandonment and physical closure of the alleyway access. In addition, the vacated alleyway must be kept clear as a fire lane on the church's side of the vacated alleyway. 2. In the event that the alley access onto First Street is not eliminated by way of vacation as set forth above, and if the proposed building is moved so as to comply with the clear visian standard, in that event, applicant shall improve the alley adjacent to the property, including 2 inches of compacted asphaltic concrete over 6 inches of compacted base rack aver compacted subgrade, to City standards, including drainage. Such paving shall be connected to asphaltic paving to the east, and to the alley driveway to the west. 3. Applicant shall provide a complete plumbing plan for the addition to determine if the existing water meter is adequate to serve the existing and new addition, nr if a new water meter should be installed. All casts associated with the installation of a new water meter shall be the responsibility of the owner. 2 T PLANNING COMMI55TON RESOLUTION NO. ~ (©12194} 4. Applicant shall provide a complete plumbing playa far the new addition to determine if the existing sewer service is adequate to serve the existing structure and new addition, or if a new sewer service should be installed. All costs associated with installation of a new sewer service shall be the responsibility of the owner. 5, All roof drains, area drains, crawl spaces, and paring lot drains shall. have positive drainage away from the structure, and shall connect to a storm drainage system approved by the Public T+~orks Department.
