Applicants have submitted an application for tentative plan app naval of a land partition on a 1,.02-arse parcel located at 4969 Upton Road. 2. Dn December 21., ]..993, the Central Paint Planning Commission conducted a public hearing an the application, at. whz.ch time it reviewed the City Staff reports, and heard testimony a.nd comments on. the applica.ti.on. Such hearing was conta.n.ued to and was resumed an January 1.8, ]_994. Now, therefore, BE IT RFSOLVFf) BY THE PLANNING COMMISSION OF TI-fE CITX OF CENTRAL POINT, OREGON, AS FOLLOWS: Section 1.. Approval, ,,Cr,_~eria. The requirements for approval of land partitions and tentative plans are set far_th in CPMC Chapters 16 and 17, relating to ~.nformatianal requirements and lot area, width and access. _S~c~.ian 2. Findings and Conclusions. The Planning Commission f3.nds and determines as follows: A. Tentative P7.an Re uirements. The appl~.catian and tentative plan are in the carr,ect form and contain al.l of the :i_nformation required by CPMC Chapter 16.10. B. Area and Width of Lots. This partitiani.ng i.n an R-L zone would create the following parcels: Parcel 1 - approximately 22,217 square feet. Parcel 2 - approximately 22,27.7 square feet Bath lots meet the minimum area (1.5,000 square feet) and width (70 feet} requirements for lots contained in CPMC _17.16.050, and both fats meet the general requirements far. lots contained i.n CPMC 7.6.24.050. Section 3. Conditional A naval. The application far tentative plan for land partition herein is hereby approved, subject to the fallowing conditions imposed under authority of CPMC 16.36: 1 -- PLANNING COMMISSION RESOLUTION NO. .~ (011394) Can.ditians 7.. Developer shall construct an adequately sued starxn drainage system to provide for existing runoff into the property, and include sizing tar runoff from eacta lot. 2. All roof drains, area drains, and crawl spaces shall have positive drainage away from the structure, and shall be connected t.a a curb drain, ar an approved storm sewer. bevel.oper shall provide the necessary storm drainage improvements to assure that all streets, lots, and all properties will drain properly as stipulated above. 3. Developer shall enter into an irrevocable consent to inclusion in a L~oca7. Improvement District far the improvement of Teresa Way and 'Upton Road, where those streets ar.e adjacent to the project, to include the following: a. A street width Pram curb to curb of 3~' paved with asphaltic concrete. (Developer is responsible for 1.8' of this CanstruCtl.an). b. Developer has received tentative plan approval for a land partition at 49b9 Upton Road. 2. Central Point Mun:~.c3.pal Code Section 17_.42.41.4 requires persons constructing buildings or otherwise developing property in the city to either improve streets adjacent t.a the praperty or execute an irrevocable consent to include the praperty within any T.~ocal Improvement D~.strict farmed to construr..t such i~npravements. Now, therefore, it is agreed as follows: Agreement 1. Irrevocable Consent. Developer hereby gives irrevocable consent to include the following-described real property in any Loco). Improvement District formed for the purpose of constructing all street, curb, gutter and sidewalk improvements to Teresa Way and Upton Road where these streets are adjacent. to said real praperty: I~ot 2, Goes Subdivision, in the City of Central Point, Jackson County, Qregon, according to the official plat of record. This consent shall be recorded., at Developer's expense, and shall run with the above-described property, to be bindixzg upon all future owners of such praperty.
