A RESOLUTION GRANTING APPROVAL OF A TENTATIVE PLAN
FOR A LAND PARTITION
(Applicant: Ken. Harris)

Recitals
1. Applicant has submitted an application far tentative
plan approval of a land partition on a 1.36-acre parcel located
at 316 N. Sixth Street.
2. On T7ecember 21, 1.993, the Central Point Planning
Commission conducted a public hearing on the application, at
which time it reviewed the City Staff reports, and heard
testimony and comments on the application.
Now, therefore,
BE IT RESOLVE27 BY THE PLANNING COMMISSION OF THE CITY OF
CENTRAL POINT, OREGON, AS FOLLOWS:
Section 1. Ax~proval Criteria. The requirements for
approval of land partitions and tentative plans are set Earth in
CPMC Chapters 15 and 17, relating to informational requirements
and lot area, width and access.
Section 2. Findings and Conclusions. The Planning
Commission finds and determines as follows:
A. Tentative Plan Requirements. The application and
tentative plan are in the anrrect form and contain all of the
information required by CPMC Chapter 16.10.
B. Area and Width of Lots. This partitioning in an R-2
zone would create the following parcels:
Parcel A - approximately 7,258 square feet
Parcel B -- approximately 8,775 square feet
Both parcels meet the minimum area {6,000 square feet for
interior lots and 7,400 square feet far corner lots} and width
{50 feet for anterior lots and 70 feet for corner lots)
requirements for lots contained in CPMC 17.24.050, and bath lots
meet the general requirements for lots contained in CPMC
16.24.050.
C. Setbacks. Parcel B contains a 9--foot setback between
the new rear property line and the existing garage. An
administrative variance for the 1-foot discrepancy is allowed.

D. Building Envelope Not.._Approved.. The building envelope
shown on Parcel A is not approved as part of this application,
since it is not relevant to this decision.
Section 3. Conditional A naval. The application for
tentative plan for land partition herein is hereby approved,
subject to the following conditions imposed under authority of
CPMC 16.36:
Conditions
1. All structures shall have roof drains, area drains, and
crawl spaces with positive drainage away from the structure and
drain lines connected to a curb drain, or an approved storm
sewer. Developer shall provide the necessary storm drainage
improvements and lot grading to assure that all streets, lots,
and all properties will drain properly. Developer shall submit a
grading plan with the construction drawings and perform necessary
grading and drainage improvements.
2. Developer shall improve the existing
