Recitals
1. Applicant previously zeceaved tent.at.i.ve plan approval
for a 33-lat subdivision in an R-1-8 district of Central. Paint,
Oregon, and has nnw s~.tbmitted an appl.ir:atioa~ far final plat.
approval for such subdivision.
2. On September 2:E., 3.993, the Planning Commission reviewed
said application for final plat approval.
Naw, therefore,

CENTRAL POINT, OREGON, AS FOLLOWS:
5ectinn 1. The Piaxaning Commission finds and determines
that the final plat is in substantial conformance with the
appraved tentative plan and the conditions placed an the approved
tentative plan, as well as all applicable ordinances anal state
laws. All of the required subdivision street and utility
improvements have been made.
~ec~_i,on 2. Approval is hereby granted to the final plat
submitted herein for Unit No. 5 of Jackson Creek Estates
Subdivision, subject to all applicable conditions contained in
the tentative plan approval and the condition set forth in.
Section 3 below.
Section 3. Applicant has coxastructed a black fence along
the north side of Beall Lane, near tl-~e southern border of the
subdivision. The fence is not constructed on. the property line,
but instead is situated 10 feet south. of the property line, in
the public. street right-of-way for Bea11 Lane. The effect of
this is that lots 1.69, 170, 1.71, 178, 179, 1,80, 181, 182, 183 and
1.84 appear to contain 10 feet of land more than they actually
contain. In order to put purchasers of those lots on notice that
their lots do not in.c.lude all of the land up to the black fence,
applicant shall include the fol,lawing noti.r.e in a restr~.ct~.ve
covenant for each. of the fats specified:

"NOTICE: The southern property line of this pa~:cel
lies ~.0 feet, more oti less, north of the bJ.ock fence
built nest to Beall Lane. The block fence does not
mark the prapexty line; the property Zane is 10 feet
north of the fence. The 10-foot strip to the north of.
the fence i,s public property, dedicated to the City of
Central 1~oint for future widening of ~3eall Lane. No
buildings, structures, fences, air landscaping mare than
.1D inches in height is allowed in the 10--foot right-of-
way strip."
Section 4. The Planning Cammissa.c~n Chairman is hereby
authorized tn~sign the final plat on behalf of the City.
