Automoba.le and truck service stations ar.e permitted uses in the M-1 district. ?_. All materials must be stored within enclosed areas, paved surfaces and in compliance with all state and federal regulations. The proposal meets these standards. 3, Maximum structural height in the M--1 distri.ct is 60 feet. The proposed addition to the canopy is appraxa.mately 2.1 feet and meets the standard. 4. Special setback requirements are for a 74Wfoot distance between the center lines of the Pine and Front Street's and the building l ine of structures . The project meets the 10-foot minimum side yard setback and the 10-- foot minimum rear yard setback. 5. Developer has received conditional approval for its application for site plan approval. 2. Central Point Municipal Code Section 12.02.Q1Q requires persons constructing buildings or otherwise developing property in the city to either improve streets adjacent to the property or execute an irrevocable consent to include the property within any Local Improvement District formed to construct such improvements. 3. Developer wishes to pay to City, and City wishes to accept, a certain sum of money in return for City waiving its right to assess Developer's property in the event a Local Improvement District is formed in the future to construct such improvements. Naw, therefore, it is agreed as follows: Agreement l.. Irrevocable Consent. Developer hereby gives its irrevocable consent to include the fallowing-described real property in any Local Improvement District formed for the purpose of constructing street improvements an West Pine Street, west of North Front Street, in Central Point, Jackson County, Oregon. Parties' Intention. The parties intend by this agreement far City to now receive the amount of money it would otherwise receive through the Local Improvement District assessment process far those improvements required of this Developer by CPMC 12.02.010, which are set forth in the preceding paragraph. It is not the parties` intention that City should waive its right to require improvements made necessary by any other authority ar procedure. 4. Mane Used for Street Im ro~ements Onl City agrees that the money received from Developer pursuant to this agreement shall only be used for construction, repair ar maintenance of City streets. 5. At3thority to Bind Corporation. In the event that Developer is a corporation, the undersigned hereby certifies that he is the Vice President of the corporation, and is authorized to bind the corporation in this agreement.
