BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
CENTRAL POINT AS FOLLOWS:

Section 2. Crit.~ria .A.p~_licab].e to Decision. The to3 J,owa.ng
chapters of the Central_ Point Municipal Code apply to this
application:

2. Chapter .17.60, General Regulations;
3. Chapter 17.64, Otf-Street Parking and I~aading; and
4. Chapter 17.72, Site flan, I.andscapang and Construction
Plan Approval..
Section _3=-Findings .
~_. Automoba.le and truck service stations ar.e permitted uses
in the M-1 district.
?_. All materials must be stored within enclosed areas,
paved surfaces and in compliance with all state and federal
regulations. The proposal meets these standards.
3, Maximum structural height in the M--1 distri.ct is 60
feet. The proposed addition to the canopy is appraxa.mately 2.1
feet and meets the standard.
4. Special setback requirements are for a 74Wfoot distance
between the center lines of the Pine and Front Street's and the
building l ine of structures . The exa.sta.ng structures meet th~.s
standard and the proposed addition wil.3. n.ot. change that. The
project meets the 10-foot minimum side yard setback and the 10--
foot minimum rear yard setback.
5. There is no l.ot coverage standard in the M-1 di.str~..ct,
there is no oft-street parking standard for fueling station uses,
and there is no requirement for landscaping screening,

6. West Pa.n.e Street is an arter~.al street according t~.a the
City's Cnmpr_eh.ensive Plan. Arterial. streets sh.auld have r_ight-
af--ways 90-100 feet in w~.dth. Presently, West Pixie Street has an
$0-f oat tight-of-way. In arde3~ to remain r..onsistent with past.
land use actions and to widen the public right-a'~-way, applicant
should be required to dedicate 10 feet of eight.-nf-way to the
Gity far public use, to be available at such time as West P3.ne
Street. is widened.

I.. Applicant must dedicate 10 feet of right--af-way al,ang

accommodate future widening of West Pine Street.
2. Applicant must execute an irrevocable consent to
participate in any future local improvement district for the
widening of. West Pine Street, in the form attached hereto marked
IWxhibit "A", and by this reference incorporated herein.

DEDICATION TO PUBLIC OF STREET RIGHT-OF-~WAY
Grange Cooperative Supply Association, Inc. hereby forever
dedicates to the public far street right-of-way and utility
purposes a strip of land 10 feet in width, 170 feet long running
in an east-west direction abutting West 1?ine Street in Central
Point, Oregon, which 10 foot by 174 foot strip is part of the
following-described real property:
Commencing at the north quarter corner of Section 10 in Township

County, Oregon, thence, on the northerly Tine of said Section,
North 89°26'41" East 1572.53 feet to a point where said Section
line intersects the southwesterly line of f=ront Street {50.0 feet

AGREEMENT FOR CONSENT TO INCLUSION IN
LOCAL IMPROVEMENT DISTRICT AND FOR f~iAIVER OF
LID ASSE55MEHT
This agreement made by and between Grange Cooperative Supply
Association, Inc., hereafter referred to as "Developer", and the City
of Central Point, Oregon, a municipal corporation, hereinafter
referred to as "City"
Recitals
1. Developer has received conditional approval for its
application for site plan approval.
2. Central Point Municipal Code Section 12.02.Q1Q requires
persons constructing buildings or otherwise developing property in the
city to either improve streets adjacent to the property or execute an
irrevocable consent to include the property within any Local
Improvement District formed to construct such improvements.
3. Developer wishes to pay to City, and City wishes to accept, a
certain sum of money in return for City waiving its right to assess
Developer's property in the event a Local Improvement District is
formed in the future to construct such improvements.
Naw, therefore, it is agreed as follows:
Agreement
l.. Irrevocable Consent. Developer hereby gives its irrevocable
consent to include the fallowing-described real property in any Local
Improvement District formed for the purpose of constructing street
improvements an West Pine Street, west of North Front Street, in
Central Point, Jackson County, Oregon.

County, Oregon, thence, an the northerly line of said Section,
North S9°2b'41" East 1572.53 feet to a point where said Section

beginning; thence continue South 35°32'00" East 225.61 feet to a

1 - AGREEMENT
This consent shall be recorded, at Developer's expense, and shall
run with the above-described property, to be binding upon all future
owners of such property.
2. Pa went to Cit In consideration of payment to City by
Developer, within 10 days of the date of this agreement, of the sum of
$-6_._066.00,,._ , City agrees that City wi 11 make no assessment against
the above-described property for any of the following improvements
that may be made, pursuant to a future Lacai Improvement District:
Widening West Pine Street to 100 feet, including curb,
gutter and sidewalk improvements.
3. Parties' Intention. The parties intend by this agreement far
City to now receive the amount of money it would otherwise receive
through the Local Improvement District assessment process far those
improvements required of this Developer by CPMC 12.02.010, which are
set forth in the preceding paragraph. It is not the parties`
intention that City should waive its right to require improvements
made necessary by any other authority ar procedure.
4. Mane Used for Street Im ro~ements Onl City agrees that
the money received from Developer pursuant to this agreement shall
only be used for construction, repair ar maintenance of City streets.
5. At3thority to Bind Corporation. In the event that Developer
is a corporation, the undersigned hereby certifies that he is the Vice
President of the corporation, and is authorized to bind the
corporation in this agreement.
