Section 1. Nature of Application
This i.s an application for a variance from CPMC 17.50.090A2,
which prohibits erecting or maintaining any building or structure
within 70 feet of the center line of any major arterial street ar
highway in the City. Applicant seeks to extend an existing
office area 51 inches iota the prohibited area. A public hearing
was held an ~7anuary 19, 1.993 wherea.n the Planning Cammissian
reviewed the application, Staff Report a~ad related materials.
S~:ctian 2. Criteria Applicable ~a Decision
CPMC 17.60.090A2 prohibits erecting ar maintaining any
building nr structure within 70 feet of the center line of any
major arterial street nr highway in the City.
CPMC 17.80.010 provides that variances to the standards of
Title 1.7 may be granted where the strict application thereof
would result in unnecessary hardship, and certain findings are
made relating to the impact the variance would nr would not have
on the property and the neighborhood.

1. Without a variance, construction of the proposed office
space would violate CPMC 17.b0.090A2, in that the office would be
within 70 feet of the center line of Highway 99, which runs in
front of Applicant`s building.
2. The strict application of the 70-foot rule would result
in unnecessary hardship, because Applicant would be unable to
fully utilize its office space, and part of Applicant's existing
office is already encroaching on the 70-foot line (that
encroachment pre-dated the 70--foot rule}. The addition would
fallow the existing building line.
3. All of the factors listed i.n CPMC 1.7.80.010D have either
been satisfied ar are inapplicable to the application herein.
