PLANNING COMMISSION RESOLUTION N0. 240 A RESbT,UTION APPROVING A CONIIITIONAL USE PI~;RMIT APPLICATION SUBMITTED BY AGENT ALFRED FOXCROFT FOR APPLICANT BRET McBEE FOR OPERATING A SECOND HAND STORE AT 55 SOUTH SECOND STREET (37 2W ~OAA Tax Lot 2800} WHEREAS, Agent Alfred Foxcraft submitted an application far operating a second hand store for used clothing in the City of Central Point, Dragon, further described as Jackson County Tax Assessor's Map Page 37 2W lOAA Tax Lot 2800, and ~'I3EREA8, pursuant to Central Point Municipal Code 1.24.060 and ORS x.97.763(2}, a public hearing was scheduled and a notice of said public hearing was prepared and sent to property owners of record within 100 feet of location of subject conditional use, and, WHEREAS, the Planning Commission of the City of Central Point held a public hearing upon said application for conditional use permit on June 2, 1992 pursuant to Central Point Municipal Code Section 1.24.020B, and having at said public meeting received and reviewed the City staff report, testimony and the applicant's findings statement, a copy of which is attached hereto as Exhibit "A" of this document and which was included within Ttem C of said staff report, and being fully advised new therefore, BE IT RESOL'V'ED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON Section 1. That the City finds that the application for Conditional Use Permit meets the requirements set forth in the City code and, as outlined in the May 26, 1992 staff review, a copy of which is attached hereto as Exhibit B of this document. The Planning Cornrnission hereby approves the conditional use permit application for operation of the second hand store for used clothing at 55 South Second Street, subject to the applicant, or his assignees following all the operating plans set forth in Exhibit "A", attached hereto, and by reference expressly made a part of the within resolution. The site has been used for sale of used and reconditioned guns and accessories far a period of five years. Then for sale of kitchen wares, gadgets, and some other kitchen items. The size and shape of building wil]. adequately satisfy our needs just as it stands. B. The site has adequate access to public streets of ample size and space to accommodate the small amount of traffic that this business will create. M E M CJ R A N I7 U M T0: Planning Commission .FROM: George Rubaloff, Administrative Assistant DATE: May 26, 1992 SUBJECT: Public Hearing - Review and determination for conditional use permit application for second hand store use at 55 South Second Street, within the commercial/professional district (C-2 Zone} On behalf of property owner Brett McBee, Alfred Foxcroft has submitted a conditional use permit application to allow the sale of used clothing and accessories along with new merchandise. The retail site is located within the city's commercial/professional district (C--2 Zone). The City's municipal code defines the proposed use as a second hand store. Second hand stores are categorized as conditional uses and are permitted in the C-2 district when authorized in accordance with Chapter 17.76 of the Code. Conditional use permits are processed an accordance with land use deca.sion guidelines. Those guidelines require that we review the application with respect to the size and shape of the site, applicable zoning and development requirements, vehicular access, traffic accommodations, compliance with government regulations, public health, safety and welfare . REVIEW 1. The proposed use is being planned far an existing building at 55 South Second Street. The proposed building sets on a zero lot line set back, therefore, the front yard landscaping requirements do not apply to the proposed conditional use. 2. The proposed retail use will be of a scale and volume to conform to the size and shape of the existing 1,000 square foot building. The site has been used as a retail outlet over the years in Central Point, and that prior use demonstrates an adequacy as to size and shape of the sate. Additional space is provided to the rear of the building to serve off-street parking requirements, further demonstrating adequacy in size and shape for the intended use and to meet the C-2 zoning regulations. 3. The proposed retail use fronts on Second Street. The rear property has access from Oak, Third and the east-west alley between Oak and Pine, Therefore, the site has adequate access to public street. South Second Street and Oak Street are in good condition and have a pcmem.GR (052692} sufficient capacity with which to provide for the generated traffic from a 1,000± square foot new and used clothing stare. South Third Street between Pine and Oak is in poor condition but has sufficient capacity to provide for the minimal traffic generated by the proposed use. Therefore, the public street is adequate in size and condition to serve the expected traffic generated by the proposed use. 4. The applicant does not intend to place new improvements on the site; set backs, building height, walls, signs are pre-existing; vehicular egress and ingress will occur primarily within the rear parking lot or on Second Street, and will function efficiently as it does currently; there are no existing or proposed fences; landscaping is not applicable due to the zero set back in the front yard; no outdoor lighting is proposed. Therefore, no significant impact is expected from the proposed land use. 5. There are no known safety and health regulations which apply to the proposed use, and there are no known activities which wi11 be detrimental or injurious to the public or the neighborhood with respect to location of on-site improvements, vehicular egress, ingress and internal circulation, set back, height of buildings, walls, fences, landscaping, outdoor lighting and signs. None of the suggested conditions of approval in Section 17.76.040 of the Central Point Municipal Code, subsection (d) are applicable to the proposed land use with the exception of hours of operation, which will be from 10:©0 a.m. to 4:00 p.m. Tuesday through Saturday. Since the operation is within the C-2 Zone, and because the site does not directly abut the residential zone, and since the operation is virtually quiet, said activity wi11 not disrupt residential land use activities.
