HomeMy WebLinkAboutResolution 237 - Foot CUP for mobile food vendorf 7 ~ ~._ PLANNING COMMISSION RESOLUTION N0. 237 A RESOLUTION APPROVING A CONDITIONAL USE PERMIT APPLICATION SUBMITTED BY AGENTS MONICA PERRY AND CHIP WOL~'~' S'OR APPT,ICANT ZELMA FOOT FOR OPERATING A MOBILE FOOD VENDOR UNIT AT 436 EAST PINE (37 2W 2CC Tax Lot 6500) WHEREAS, Agents Monica Perry and Chip Wolff submitted an application for operating a mobile food vendor unit in the City of Central Point, Oregon, further described as Jackson County Tax Assessor's Map Page 37 2CC T~ Lot 6500, and WHEREAS, pursuant to Central Point Municipal Gode 1.24.060 and ORS 197.763(2), a public hearing was scheduled and a notice of said public hearing was prepared and sent to property owners of record within 100 feet of location of subject conditional use, and, WHEREAS, the Planning Commission of the City of Central Point held a public hearing upon said application-for conditional use permit on June 2, 1992 pursuant to Central Point Municipal Code Section 1.24.020B, and having at said public meeting received and reviewed the City staff report, testimony and the applicant's findings statement, a copy of which is attached hereto as Exhibit nAr: of this document and which was included within Item C of said staff report, and being fully advised now therefore, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON Section 1. That the City finds that the application for Conditional Use Permit meets the requirements set forth in the City code and, as outlined in the May 26, 1992 staff review, a copy of which is attached hereto as Exhibit B of this document. The Planning Commission hereby approves the conditional use permit application for operation of the mobile food vendor unit at 436 East Pine Street, subject to the applicant, or his assignees following all the general requirements of the City including the special setback of 50 feet from center line of East Pine Street the operating plans set forth in Exhibit "A", attached hereto, and by reference expressly made a part of the within resolution. We will secure all legal licenses necessary for our business. We accept the respon- sibility to secure all needed insurances for our business. The Central Point Grange #698 will, not be held liable for any action taken regarding the business. A donation of $7.Q0 will be given the Central Point Grange #698 monthly. This agreement will be null and void if the above standards are not met. They have stated all legal matters regarding the set-up WiII have been covered.. We will require a ~+rritten statement from them that this has been done and the property will be kept clean. The parking lot is approximately 7400 feet, not used during hours coinciding with the mobile food vendor operation, will provide for about 25 parking spaces, and is adequate in size and shape to serve an estimated 25 vehicles daily, over a five to six hour operation . 2. The C-3 zone does not require a front yard set back. The vendor is placing the mobile food cart on the property at the edge of the northerly property line, and therefore meets the City~s front yard set back requirements . 3. The mobile food vendor is licensed with the County Health Department and is therefore in compliance with applicable laws regulating food service . 4. The applicant does not propose to install any signs or lighting. Therefore, this standard does not apply to the project. 5. The current Location provides for twenty-five off-street parking spaces. Therefore, off-street parking will be available to adequately serve the use. 6. Clear vision requirements are excluded from the C-3 zone. Therefore, this ,standard does not apply to the project. STAFFREV. CQUNCIL 7. There are two driveway approaches which exist on the east property line and access South Fifth Street, which is a local street, and which is in a failed condition, has a remaining capacity of about 1000 vehicles per day, and which will provide for the expected ~0 vehicle trips per day generated from the proposed use. Therefore, access to public street is adequate, and that street is adequate in size and condition to handle the expected traffic. S . Egress and ingress would occur on South Fifth, which follows the hierarchy of streets for access purposes; since the use is estimated to serve 25 vehicles per five to six hour occupation, atwenty-five space lot is adequate in terms of internal circulation; set backs do not apply, nor do building height, walls, fences and outdoor lighting requirements ; the mobile food vendor sign is mounted on the mobile food vendor cart, which does not remain on site each day; landscaping does not apply far this temporary use; the mobile food vendor will police litter throughout the day and at the end of each daily operation in an attempt to manage litter generated by the mobile food vendor use; therefore staff finds no adverse impact upon abutting properties . 9. The food service is licensed with Jackson County Health Department, and under said license is required to comply with health division rules for food service . Based upon facts cited in Item 7 above, the proposed mobile food vendor use would not be detrimental to the general welfare of the community. 10. After reviewing 17.75.040, subsection (e) of the Central Paint Municipal Code, the staff finds that there are no other recommendations required to protect the public health, safety and welfare under this project.
