OF' UNIT N0. 1 Off` GREEN PARK VILLAGE SUBDIVISION Recitials 1. On behalf of Pacific `T'rend Building Company, Bill Earl has submitted an application for a fence variance to build a six foot fence along the west property line of Lot ~. of Unit No. 1 of Green Parr Village Subdivision. 2. Section 15.2Q.04Q of the Municipal Cade allows a maximum fence height of ~2 inches where such :Fence is closer than twenty feet from the nearest street right-of-way line. S. Section 15.20.Q70 of the Municipal Code provides far a fence variance process and Section 1.24 of the Code states that the Planning Commission shall decade upon all fence variance applications without public hearing. 4, The Central Point Planning Commission conducted a public meeting' an April 7, 1992 during which the Commission revieraed the variance application and staff report and received comments from the publa..c. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF T~iE CITX OF CENTRAL POINT, OREGON, AS FOLLOWS: Sa~t_~on 1. Approval Crit~ri_a..,.___,The requirements far approval of fence variances are set far~h. in CPMC 1.5.20.070 and relate to hardship determination, neighborhood advantages, beautifa.catian, safety, protection, adverse impacts and utilization of zoning. Seca,o~__._2.....__._.__..__.Findi~s__ _ and_..__Cpnc1._usa.oz~s .------The Plann~.ng Commission finds and determines as follows: A. Strict Adherence to the CPMC 15.20.00 would strip all rear yard privacy, security and sound attenuat~.on from the future resident of Lot 1. These features are available to other Corner fats within the City. Therefore a bonafide hardship exists in this particular Cir~LkmStaXlCe . B. The variance will provide advantages to the neighborhood because of the benefits of beautification, safety, protection and security described in the following subsections. C. The variance will provide beautification to the neighborhood because the fence will provide a consistent and more attractive entry feature to Green Pare Village Subdivision as viewed from Merriman Road. Beautification will also be enhanced by a fence height which would adequately separate and screen rear yard activities from vehicular and pedestrian traffic. D. The variance wall provide safety to the neighborhood because the six foot fence will better restrain children and dogs residing at Lat 1 and keep them from entering onto Merriman Raad. B. The variance will provide protection to the Neighborhood by discouraging unwanted intruders onto Lot 1. The sax foot fence will also discourage children from cutting across private property. The fence will also encourage pedestrians to cross Merriman Road at the intersection rather than short--cutting across the corner lot and then crossing mad- road. The six foot fence will also provide the benefit of sound attenuation for both the residents of Lot ~, and pedestrians nn Merriman Road. ~'. The variance will not have adverse impacts upon the neighborhood provided the applicant complies with the conditions of approval set forth in Section 3 of this resolution. G. As described in the preceding subsections, the fence variance would provade safety, protection and beautification to Lot 1 and adjacent properties, thereby, 1. facilitating the stabilization and protection of urban low density residential charactoristics of the Single ~`amily Residential District and 2. promota.ng anal encouraging suitable environments far family life. The variance would therefore utilize property within the intent and purpose of the zoning district.
