HomeMy WebLinkAboutResolution 230 - Durham-Remick PartitionCT ~i ~_ PLANNING COMMISSION RESOLUTION NO. 7?n A RESOLUTION RECOMMENT)ING APPROCI'AL TO GRANT A MINOR LAND PARTITION (Agent Jahn Durham far owner Michael Remick) (37 2W 11 TL 2402) Y,TI]EREAS, on behalf of Michael Remick, Sohn Durham has submitted an application for a minor :Land partition of a .58 acre parcel, located on Cedar Street between Rostelle Avenue and Freeman Road in the southeast quadrant of the City, and WHEREAS, the Planning Commission of the City of Central Point held a public meeting upon said application for minor land partition nn January 7, 1992, pursuant to Central Point Munica.pal Cade Section 1.24.020C, and having at said public meeting received and reviewed the City staff report and testimony, and being fully advised, now therefore, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POIN`I, OREGON, AS FOLLOWS: Section 1. Based upon the staff report, evidence, and rennrd relating to said application, the Planning Commission hereby finds that said application meets the requirements for minor land partition, that said minor land partition as proposed is in compliance with the City's comprehensive plan and zoning code, and if the conditions set forth hereinafter are met, said application meets the City's requirements for minor land partition. Section 2. The Planning Commission hereby recommends approval of the minor land partition application submitted by Agent Jnhn Durham, subject to the conditions set forth in Exhibit A, attached hereto and by this reference expressly made a part of the within resolution. RESOLUTION NO. 230 MLP.DURHAM/RESO Section 3. In accordance with Central Point Municipal Code Chapter 1.24, this resolution of the Planning Commission, including the conditions set forth in Exhibit A, shall be forwarded to the City Administrator who shall schedule a public hearing before the Caty Council. After conducting said public hearing, recording and reviewing the city staff report and testimony, the City Council may decade in the matter of said miner land partition. STREET IMPROVEMENTS: Includes: Street subgrade, street base, street paving, street lighting, traffic controlldelineation improvements, curbslgutters, safety improvements, ingress/egress improvement, off-street parking, delivery truck access, traffic requirements, sidewalk, and bikeways. A. Existing Conditions. 1. Street No. LS 98, Street Name -Cedar Street, Jurisdiction, Central Point, Existing ROW-80', Future ROW-80', Existing Street Width-36', Future Street Width-36', Curb/Gutter-Existing, Existing Sidewalks-None, Future Sidewalks-Required, Existing Traffic Volume-300 VTID, Projected Traffic Volume This Project-30 VT/D, Street Designed For-1500 VTID, Existing Street Lights-Located at Intersections, Future Street Lights-At adjacent property owner's request, Existing Traffic Control- MUTCD required, Future Traffic Control-None for this Project. In order to meet the applicable Code, the AppficantlOwner, whichever the case may be, shall complete the Conditions listed below as stipulated. B. Developer's Required Conditions: 1. CPMC 12.02, 16.36 Street Improvements Code: '16.36 a. The access to the flag lot shaft be a minimum width of 20 ` . -TF3 16.36 b. Each lot can have its own access driveway, however, the accesses for Parcels 1 and 2 shall be located at the farthest paint away from the access to Parcel 3. -TF3 5. CPMC 17.64 -Parking 17.64 a. A 12" transite water mainline is located in the most northerly portion of the street section. 2. A 4" cast iron water line is located a few feet south of the 12" transite water mainline. 3. A 8" cast iron waterline is located a few feet south of the 4" cast iron water line. 4. Fire Hydrant #34 is located in front of 628 Cedar Street. Each parcel shall have individual services installed as a part of the building permit issuing process. TF3 PWS b. Each parcel shall have individual sanitary sewer service as required by the Oregon State Plumbing Specialty Code with a minimum size for each service of 4". These services shall be installed at the time the structures are being built, one service for each parcel. 3. Regional Sewer Development Charge a. The DeveloperlBuiider, whichever the case may be, shall pay a SDC for connection of this facility to the Regional System. Cost of this connection shall be as defined in the Sewer System Development Charge Report. The SDC shall be paid as a part of connection to the sanitary sewer system. 4. Local Systems Development Charge a. As required by. CPMC Title 14. i V . STORM DRAINAGE IMPROVEMENT.• includes: Discharge Basin, Wetlands Requirements, Pretreatment Requirements, Mainlines, Services, Catchbasins, and Erosion Protection. A. Existing Conditions: 1. An 18" storm drainage pipe is located on Rostell Avenue. B. Developer's Required Conditions: 1. Discharge Basin, a. This property is located in the Mirtgus Creek Discharge Basin. Wetlands Requirements: This property is not located in a designated wetland, unless the final construction plan review reveals a condition which requires by City Standards additional improvements to be made by the ApplicantlOwner, whichever the case may be. 3. Pretreatment Requirements: No Pretreatment Conditions, unless the final construction plan review reveals a condition which requires by City Standards additional improvements to be made by the Applicant/Owner, whichever the case may be. 4. Mainlines - No improvements to the mainline is required for this land use action, unless the final construction plan review reveals a condition which requires by City Standards additional impravements to be made by the ApplicantlOwner, whichever the case may be. 5. Property Service. a. All roof drains, area drains, and crawl spaces shad have positive drainage away from the structure and shad be connected to a curb drain or an approved storm sewer. Developer shall provide the building's finished floor and property topographical elevations to determine that all structures will drain properly. - TF 3 6. Flood Plain -This property is NOT located in a Flood Plain or Floodway. V. OTHER CONDITIONS: A. Developer shall install nr cause to be installed, conduits far utilities at intersections, or locations determined by utility companies. Developer shall also provide conduit crossings for utility companies who will not install their services until after the facility is constructed. The Developer will be responsible for all costs associated with the installation of these conduit crossings. - TF3 Public Works Staff Report Minor Land Partition -Durham December 26, 1991 -Page Seven B. All construction for utilities, streets, and other structures discussed herein, shall be done so according to all rules, regulations, ordinances, resolutions and other applicable requirements of the City of Central Point for the construction of this development. C. This review for the Minor Land Partition, submitted by John and Roxene Durham was done so in accordance with all the rules, regulations and ordinances in effect as of the date of this review. Any modifications by the Develaper of this project after City Planning Commission andlor City Council appravafis, could require resubmittal of an application and approval by the City Planning Commission andlor City Council. D. All costs associated with this Development and the conditions placed on this Development shall be the sole responsibility of the applicant/owner, whichever the case may be. E. No construction will begin on this project or any building, until such time as plans and specifications have been reviewed and approved by the Public Works Department and other required divisions of the City and a Construction Permit has been issued for each portion of the project requiring a permit. F. The Applicant/Owner shall be required to pay all applicable Systems Development Charges at the time a permit is issued for structures to be buikt within property in this Minor Land Partition.
