Berlin, of Southern Oregon Child and Family Council, Inc., on behalf of applicant Gloria Dei Lutheran Church, submitted an application for a conditional use permit for an early childhood development facility, known as Southern Oregon dead Start, located at Gloria Dei Lutheran Church in the City of Central Point, Oregon, further described as Jackson County Tax Assessor's Map Page 37 2W 3AD, Tax I~ot 4700, and WHEREAS, pursuant to Central Point Municipal Code 1.24.060 and ORS X97.763(2), a public hearing was scheduled and a notice of said public hearing was prepared and sent to property owners of record within 1030 feet of location of subject conditional use, and, WHEREAS, the Planning Commission of the City of Central Point held a public hearing upon said application for conditional use permit on December 4, x.990 pursuant to Central Point Municipal Code Section 1.24.0208, and having at said public meeting received and reviewed the applicant's findings which are attached hereto as Exhibit A of this document, City staff reports and testimony and being fully advised now therefore, BE ST RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON AS FOLLOWS: Section 1. Barad upon the staff report, evidence, applicant`s findings and record relating to The Conditional Use Application, the Planning Commission hereby finds as follows: PLANNING COMMISSION RESOLUTION N0. 2I2 HDSTART/RESO a. The Gloria Dei Lutheran Church properly and facil.i.ties are adequate in size and shape to accommodate the land use described as an early childhood development facility and will meet applicable development and zoning requirements. b. Vehicular traffic will enter the site and access North Tenth Street from two driveways. Said access points are adequate in size and condition to accommodate anticipated traffic generated by the land use. c. Upon review of the application for conditional use and associated development and zoning standards, it has been determined that said project will not have any adverse affect upon abutting properties. d. Upon review of the Conditional Use Permit Application, zt has been determined that the proposed land use will not diminish the health, safety and welfare of persons residing or working in the surrounding neighborhood. Section 2. The Planning Commission hereby approves the Conditional Use Permit Application submitted by Southern Oregon Child and Family Council, Inc., on behalf of applicant Gloria Dei Lutheran Church subject to the applicant meeting the conditions which are a requirement of said approval and which are set forth in Exhibits A, U and C, attached hereto, and by this reference expressly made a part of the within resolution. This site would Nerve approximately 36 four--yr>ar-~ald children. Children attend the center 9 days per week for 9 1/4 hours per day. Since the program is only part--day, Children's Services Division exempt; Head Start centers from licensing (See AttacJaed Letter). Centers do have to follow strict federal regulations and are inspected regularly by fire and health officials. Federal regulations require providing a minimum of 35 square feet per child indoors and 75 square feet per c~~ild of outdoor space. The proposed Centex site and proposed outdoor play axea exceed the minimal space requirements. FINDINGS: A. Federal and state regulations require providing a minimum of 35 sq. feet of inside space for children and 75 sq. feet of outside space. The Gloria Dei Lutheran Church building is 120 X 72 for a total of 8,590 sq. feet, with Head Start using only 4,5,25 sq. ft. (classrooms, kitchen, bath, etc.? and the proposed playground is 102 X 70 X 11$.9 X 95.5 for a total of 6,785 sq. feet. (See Playground Plank This £ar exceeds the amount of space needed for 36 children of 1,260 sq. feet o£ inside space and 2,700 sq. feet of outside space. There are 2 bathrooms, each with 2 stalls which provide for adequate plumbing and toilet facilities. B. There are 2 vehicle access points for Glaxia Dei Lutheran Church which would both be used as an entrance and exit. Head Start would arrange with Gloria Dei Lutheran Church the dismissal time for the Head Start cea~ter to coincide with other Gloria Dei Lutheran Church activities. (See Parking and Traffic Flow Plant. Approximately 1/2 of Head Start children (18) are bussed to and from the Head Start center by a Head Start bus, thus leaving the other 1/2 of the children (18) to be brought to and picked up at the Head Start center by Head Start parents, this small amount of traffic will not affect the current traffic flow on and o££ of North 10th Street. No improvements to the street or right-of~-way would be required as a 20 foot driv~:way circles the building and is entirely paved and marked with more than the required 14 parking spaces needed. The entrance ~ and exit has no obstructions to vision. The playground is set back across the parking 1nt and is within full view of traffic, which provides safe access £ar children. There are approximately 75 parking spaces within the Gloria Dei 3-,utheran Church Property, which far exceeds the required amou~~t for Head Start usage of 19 spaces (1 .for every employee and 1 far every 5 children3- There is plenty of additional space if needed and this would therefore require no off street parking. T}ais would provide a very adequate parking area far Head Start and Gloria Dei Lutheran Church purposes. Also the parking could be used by par-eats attending Gloria Dei Lutheran Church functions during non Head Start time. EXi-iIT3}'I' ~....: C. With the Gloria Dei Lutheran Church bualdang alre~~dy an use arsct playground already in place and set as far away as it; is from North 10th Street to the East and the exist;inch harises to the North, West and South, thus the proposed use wall have no adverse affect on abutting property. D. Southern Oregon Head Start as a federally funded preschacal for children of age 4 and only operates 1/2 day. The use of the Gloria Dei Lutheran Church building will have not be detrimental to the health, safety ar general person residing or working the surrounding neighborhood and will not be detrimental ar an7urious to the property and improvements in the neighborhood or to the general welfare of t}3e community. E3. Head Start proposes to further develop the existing playground with a park lake setting within t}~e current chain link fenced area (4-5 feet high) that is appraxiznately 70 feet on the North, 45.5 feet on the South, 102 feet on the East and 118.9 feet an the West. There is an existing wood fence on the West, with a 12-14' drive gate and 2 waJ,3; gates. Within this play area there would be a sandbox, 3 large play structures (one owned by the Church and already installed and one awned by Head Start to be installed), a possible sodded section and a possible large mound with a culvert running through it. Head Start employees would care far the playground at~d any existing trees and landscaping in the proposed use area. Head Start use of the property would have no adverse effect an the natural resources of the property. (The play structure Head Start owns is approximately 25 feet long and 7 1/2 feet high.) (See Playground Plan} There is one existing building on the Gloria Dei Lutheran Church property, (besides the church building) which as being used as a storage shed for the church. Head Start would like to install 2 storage sheds next to the current existing shed owned by the church. `I'he sheds Head Start proposes {See Site Plan) are $ feet in height and are of wooden construction and are co3zstructed locally. Head Start would lake to place a sign near North 10th Street, desagzlating that there is a Head Start center an located with Gloria Dei Lutheran Church property, and that the sign would meet all City of Central Point City sign regulations. Tk~e chi3-dretz would attend the center from approximately 8:30--12:45, 4-5 day: pc~r weak, Monday through Friday. Since tk~e children are only at the center 4 1/4 hours per day and mostly inside except for a 1./2 hour outside play time, the naise should be greatly minimised. fihere wau3,d be no other detrimental environmental effects. E9. Head Start wishes to be operatianal with the prapased building on or before January 2, 1990. E1fl. Head Start, if required would purchase a bond for removal of such use, but would not like to spend any additional mrsney than needed to due the amount of budget limitations. Head Start currently carries an enormous arnount of insurance with Aetna which does include a couple of different type of bonds. E11. Developers Require Conditions 1. The developer sha11 be required to sign a deferred improvement agreement for street .improvements, curbs and gutters, on-site storm drainage, sidewalks, driveways, and street lights for a 44 ft. street section on North 10th street. Developer shall make aforementioned improvements when future expansion of the street facility occurs. 2. Ingress/Egress driveways shall be the standard required when items in No. 1 above axe to be completed. II. SANITARY SEWER SYSTEM IMPROVEMENTS A. Existing Conditions 1. An existing sanitary sewer service is located at the existing facility. B. Developers Required Conditions 1. In advance of starting operation of the Head Start facility, the Developer shall locate the existing service lateral on the plan, and verify size and capacity. If the size is oat adequate to accommodate this new use, a Larger sewer service shall be required. III. WATER SYSTEM I~'iPROVEMENTS A. Existing Conditions 1. An 8" AC water main is located on the east side of North 10th Street, and a 12" water main is located on the west of North 10th Street. 2. Fire Hydrant No. 455 is located on the northeast corner of North 10th Street and Arroyo. The distance from this hydrant to the farthest point of existing structures is 250 ft. 3. A backflow device (DCVA FEBC4 805 #23308) is located nn the irrigation system and not the domestic meter. B. Developer`s Required Conditions 1. A backflow device, as it pertains to the hazard, sha11 be required on the domestic meter if food will be served on a regular basis at this facility. Said backflow device shall be installed in advance of starting operation of Head Start Facility. IV. STORM DRAINAGE SYSTEM A. Existing Condition 1. A 15" storm is located on the east side of North 10th Street. 2. `here is no on-site storm drainage system for this property to service the existing structures and parking area. B. Developer's Required Conditions 1. All roof drains, area drains, and crawl spaces shall have positive drainage away from the structure and shall be connected to curb drain or an approved storm sewer. This requirement shall be tied to the future expansion of the street facility as per DIA. 2. Developer shall provide an on-site storm drainage plan and determine how this property will comply. Runoff calculations shall be submitted with site plan construction drawings. This requirement shall be tied to the future expansion of the street facility as per DIA. V. ADDITIONAL REQCTIREMENTS A. 3~eveloper shall install or cause to be installed, conduits for utilities at intersections, or locations determined by utility companies. Developer shall also provide conduit crossings for utility companies who will not install their services until after the facility constructed. The developer shall be responsible for all costs associated with the installation of these conduit crossings. B. Ali construction for utilities, streets and other structures discussed herein within rights of ways owned or to be owned by the City of Central Paint, shall be done so according to all rules, regulations, ordinance, resolutions, and other applicable requirements of the City of Central Point for construction of this development. C. `the review for the development submitted hereby by Gloria Dei Lutheran Church for Southern Oregon Head Start, was done in accordance with the rules, regulations and ordinances in effect as of the date of this review. Any modifications by the developer of this development after City approvals could require resubmittal of an application and approval by the City if the modification does not meet the standards set forth in the code. D. All costs associated with this development shall be the sole responsibility of the applicant or owner. Any modification to the proposed plan will require a new review, any requirements set forth herein can be modified based on the change of plan. Applicant shall obtain appropriate City permits} prior to installing signs and accessory structures (in excess of 120 square feet} 2. Applicant shall. maintain a ten (10) foot separation from other buildings and shall comply with. any other applicable rules relating to accessory structures. S. This Conditional Use Permit shall expire an December 4, 1995, and a City review of the Conditional Use Permit shall be required if there are any changes in the land use activities allowed under the permit. The applicant shall initiate contact to the City prior to such changes.
