E. C. BRITTSAN FOR TEMPOT2ARY' PLACEMENT OF A MOBILE HOME FOR
INFIRM OCCUPANCY AT 5394 TERESA WAY (36 2W 34D TL 213)
WHEREAS, E.C.Brittsan submitted an application fora conditional use permit
far temporary mobile home placement for infirm occupancy located at 5394 Teresa
Way in the City of Central Paint, Oregon, further described as Jackson County
Tax Assessor's Map Page 36 2W 34D, Tax Lot 213, and
WHEREAS, pursuant to Central Point Municipal Code 1.24.060 and ORS
197.763(2), a public hearing was Scheduled and a notice of said public hearing
was prepared and sent to property owners of record within 100 feet of location
of subject conditional use, and,
WHEREAS, the Planning Commission of the City of Central Point held a public
hearing upon said application for conditional use permit an October 2, 1990
pursuant to Central Point Municipal Code Section ~..24.020B, and having at said
public meeting received and reviewed the City staff report, testimony and
applicant's findings, and being fully advised now therefore,
BE IT RESOLVED BY TkiE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT,
OREGON AS FOLLOWS:
a. The site for proposed use is in excess of one acre and is therefore
adequate in size to accommodate the temporary placement of mobile
home for infirm and the existing land uses upon the site within the
R-L (Residential Low Density) zone.
b. Infirm occupant does not operate a motor vehicle and therefore said
temporary land use will not increase the volume of traffic. The site
has adequate access to a county road and said road adequately serves
the existing traffic which is generated within the residential
subdivision.

c. The layout of the primary structure and accessory structures are such
that the proposed rrFObile home placement will be concealed from view
and ~s~ill meet the zoning requirements applicable to the R-~L zone and
will therefore have little or no adverse affect upon abutting
properties.
d. In conducting subject land use, the applicant has agreed to comply
with all conditions wha,ch are outlined in section 17.60.055{2) and
the Planning Department and Public works Staff Reports which are
designed to maintain the health, safety and welfare of the applicant
and surrounding property owners.
Section 2. The Planning Commission hereby approves the conditional use
application for placement of mobile home far infirm occupancy submitted by E.C.
Brittsan, subject to the conditions set forth in Exhibit A, attached hereto, and
by this reference expressly made a part of the within resolution.

CONDITIONS: - ~. C. Brittsan
1. Applicant or owner sha11 obtain all necessary permits for the
installation of this temporary mobile home, including but not
exclusively, plumbing; setting up; power; driveways and other
required permits.
~. Payment of the Systems Development Charge of $527.00 sha11 be
required.
3. Fa11ow all the requirements established in 77.60.055 of the
Central Point Municipal Code.
4. A11 costs associated with this development shall be the sole
responsibility of the applicant nr owner. The review done nn
this Conditional Use Permit utilized the rules and regulations
in effect as of September 24, 1990. Any modifications to the
Conditional Use Permit will require a new review and
requirements set forth herein can be modified based upon any
proposed changes.
5. A11 construction within Public Rights of way, easements or
storm drainage systems shall be built according to the Public
wanks Standards in effect at the time of application for
permits.
6. each individual dwelling created by this conditional use
permit sha11 have individual water, sanitary sewer, and Storm
sewer discharge services.
7. The temporary mobile home sha11 take access from the existing
driveway of Tax I~ot 213 .
8. No construction or placement of structures within a public
utility easement (except far Fences by permit only}.
9. Owner shall be responsible for protecting property corner
monuments. If monuments are disturbed, damaged or removed,
the contractor shall replace monument prior to Certificate of
Occupancy being issued. The owner may want to verify location
of property lines prior to mobile home setup.
70. All construction material and debris shall be removed and/nr
cleaned up at the end of each work day. In any event, the
Public works Department shall require immediate response by
the owner to remove all any or all debris from the street that
wi11 or may obstruct the street,
ii. On all new construction, all roof drains, area drains, and
crawl spaces sha11 have positive drainage away from the
structure, and sha11 be connected to a curb drain or an
approved storm sewer.
NO OCCUPANCY OP ANY STRUCTURE CONSTRUCTED OR PLACED ON THIS
PROPERTY WILL 8E ALLOWED UNTIL A "CERTIFICATE OF OCCUPANCY" HAS
BEEN SIGNED BY BOTH THE BUILDING OFFICIAL AND THE PUBLIC WORKS
DIRECTOR. TEMPORARY WATER SERVICE WILL BE PROVIDED FOR
CONSTRUCTION PURPOSES ONLY. RESTDENTTAL WATER SERVICE WILL NOT BE
TURNED ON TO THIS STRUCTURE UNTIL A CERTIFICATE OF OCCUPANCY TS
COMPLETED.
