Whittle, on behalf of Thurman 0. Barnes, has submitted an application for a minor land partition of a 4.78 acre parcel, located in the southwest quadrant of the City along Seall Lane, west of Malabar Drive (37 2W IODA Tax Lot 100), and, WHEREAS, the Planning Commission of the City of Central Point held a public meeting upon said application for minor land partition an September 4, 1990, pursuant to Central Point Municipal Cnde Section 1.24.fl20C, and having at said public meeting received and reviewed the City staff report and testimony, and being fully advised, now, therefore, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON AS FOLLOWS: Section 1. Based upon the staff report, evidence, and record relating to said application, the Flanning Commission hereby finds that said application meets the requirements far minox land partition, and said minor land partition as proposed is in compliance with the City's comprehensive plan anal zoning code, and if the conditions set forth hereinafter are met, said application meets the City's requirements for minor land partition. Section 2. The Planning Commission hereby recommends approval of the minor land partition application submitted by Gary T. Whittle, subject to the conditions set forth in Exhibit A, attached hereto and by this reference expressly made a part of the within resolution. RESOLUTION N0. 206 MLPGTW.90/PCWORK Section 3. Tn accordance with Central. Point Municipal Cade Chapter 1.2~, this resolution of the Planning Commission, including the conditions sel. forth in Exhibit A, shall be forwarded to the City Administrator who shall schedule 3 public hearing before the City Council. After conducting said publzc hearing, recording and reviewing the City staff report and testimony, the City Council may decide in the matter of said minor land partition. Applicant, owner or assignee shall provide for storm drainage, street lights, curbs, gutters, driveways or street improvements or any combination of the same on that portion of Beall Lane which fronts property. Street design shall accommodate 10,000 vt/d 10o truck traffic. cull street width is expected to be 48 feet Applicant, owner or assignee shall also dedicate an additional 10 feet of property for ~3ea11 Lane street right- of-way. Applicant, owner or assignee may defer making the aforementioned street and street improvements until such time as the construction activities are underway in Phase I of Stonecreek No. 4 subdivision or until such time that a LID is formed to improve the same, whichever of these should occur first. 2. All costs associated with this development shall be the sole responsibility of the applicant or owner. The review done on this Minor Land Partition utilized the rules and regulations in effect as of August 21, 1990. Any modifications to the Minor Land Partition will require a new review and requirements set forth herein can be modified based upon any proposed changes. 3. All construction within Public Rights of Way, easements or storm drainage systems shall be built according to the Public Works Standards in effect at the time of application for permits. 4. Applicant or assignee shall pay a $20(3 per lot parks development fee prior to obtaining a building permit for construction of any of the lots created by the minor land partition. 5. Each individual lot created by this minor land partition shall have individual water, sanitary sewer, and storm sewer discharge services. 6. Pursuant to Chapter ~,~..08 of the Central Point Municipal Code, applicant or assignee shall submit the appropriate application form to the City requesting the City to make a just and equitable segregation of the assessment for the lots being created by the miner land partition, if an LID e~zists on subject property. 7. Parcel No. One {1} shall take access from the existing driveway onto Beall Lane and in the event that Stonecreek Igo. 4 does not develop completely and Glenn Way is not improved such that it provides access to Parcel No. Two {2}, then applicant or assignee shall provide access to and from Parcel No. Two (2) along Beall Lane. 8. No construction or placement of structures within a public utility easemer_t (except for fences by permit only). MLP~,0904.90/PCWORK 9. Contractor sha11 be responsible for protecting property corner manuments. If monuments are disturbed, damaged ar removed, the contractor shall replace monument prior to certificate of occupancy being issued. The contractor may want to verify location of property lines prior to construction. 10. All construction material and debris shall be removed an/or cleaned up at the end of each work day. In any event, the public works department shall require immediate response by the contractor to remove all debris from the street that will or may obstruct the street. 11. On all new construction, all root drains, area drains, and crawl spaces shall have positive drainage away from the structure, and sha11 be connected to a curb drain or an approved storm sewer. 12. Applicant Thurman 0. and Helen Barnes shall acknowledge to the City of Central Point in writa.ng that ha has reviewed and he accepts the conditions of approval associated to subject minor land partition. NO OCCUPANCY OF ANY STRUCTURE CONSTRUCTED OR PLACED ON THIS PROFERTX WILL BE ALLOWED UNTIL A "CERTIFICATE OF OCCUPANCY" HAS BEEN SIGNED BY BOTH THE BUILDING OFFICIAL AND THE PUBLIC WORKS DIRECTOR. TEMPORARY WATER SERVICE WILL BE PROVIDED FOR CONSTRUCTION PURPOSES ONLY. RESIDENTIAL WATER SERVICE WILL NOT BE TURNED ONTO THIS STRUCTURE UNTIL A CF~2TIFICATE OF OCCUPANCY IS COMPLETED.
