A RESOL~7'I`ION APPROVING A CONDITIONAL USE APPLICATION
SUBM:CTTED BY JAMES DOREY AN1] CHERYL, SMITH ~`OR A TROPICAL,
FISH RETAIL STORE (Pet Sales and Related Supplies)
WI-3F.REAS, James Dorey and Cheryl Smith have submitted an app~.icatian for a
conditional use permit for a Trnpical Fish Retail Stare to be located at 24g East
Pine Street in Central Point, Oregon further described as Jackson County Tax
Assessor's Map Page 37 2W 3DD, Tax Lot 11000, and,
WHEREAS, a Tropical Fish Retail Store, catagorized as a pet sales and
related supply use, is a conditianal use within the Downtown Business District
(C-3 zone), and
WHEREAS, the Planning Commission of the City of Central Paint held a
public hearing upon said appl~.cation for conditional use permit on May ~, 1990,
pursuant to Central Point Municipal Code Section 1.24.020B, and having at said
public meeting received and reviewed the City staff report, applicant's findings,
and testimony, and being fully advised now therefore,
BE IT RESOLVED BY THE PLANNING COMMISSION OF TI-~E CITY OF CENTRAL POINT,
OREGON, AS FOLLOWS.
Section 1. Based upon the staff report, evidence, and record relating
to said application, the Planning Commission hereby finds that said application
meets the requirements for conditional use, that said conditional use as proposed
is in compliance with the City's Corr~prehensive Plan and Zoning Code, and if the
applicants conduct said business in a manner described in the applicants' condi-

tional use permit statement which. is attached x~erei:o t-~s Exhibit A and by this
reference made a part of the within resolution.
Section 2, The Planning Commission hereby grants approval. of the condi-
tional use application submitted by James Barey and Cheryl Smith, subject to the
conditional use statement set Earth in Exhibit A, attached hereto, and by this
ref erence expressly made a part of th.e within resolution.
Passed by the Planning Commission this ~~ day of May, 1990 and

A. The said Building is located at 249 E. Pine St. Central Pt. Ore., 'This
establishment has been Rented for various retail Businesses in ttse
past. ~Snst recently, a small appliance repair shop. To the best of our
Knowledge and intended use, the Building meets all space requirements.
B. Said Building is Located in the C-3 zone ( Downtown Business District }
Please refer to F.ig. B. attached, which should indicate location and
accessibility. Ta the Best of Our Knowledge the location intended for use has
adequate access to parking. There is additional off street Parking in the
rear of the building, 3 spaces.
C_ `?'he intended use far the Building is to have retail sales of Tropical
Fish( Fresh, Brackish & Salt water Fish) and related supplies to that effect.
We find that for the intended use, there poses no threat of damage to ajaining
Businesses, or the area at or near this location. We only intend to add
shelving to the Building to contain the aquariums for safety & display.
D. As in Sec. ''C' above, the intended use should render no Health ar Safety
hazards to persons working in or near this location. to the best of Our
knowledge. In the best interests of Safety of the Building and persons/property
near this Building, sfle have installed circuit Breaker power straps between
aquariums and power source to insure Safety.
E. Items E 1 thru E 22 (CPMC sec. 2'7.76.04x) Do not apply to our proposed
Conditional Use Permit Application.
