FOR A STA`T'E POLICE FACILITY WHEREAS, Zeeb's Investment Cnmpanyhas subirnitted an application for a conditional use permit for a State Police Facility to be located approximately north of Crater High School along Highway 99 in Central Point, Oregon further described as Jackson County Tax Assessor's Map Page 37 2W 3B, Tax Lot 1500, and WHEREAS, the Planning Commission of the City of Central Point held a public hearing upon said application for conditional use permit on February 6, 1390, pursuant to Central Point Municipal Code Section 1.24.020B, anc3 having at said public meeting received and reviewed the City staff report and testimony, and being fully advised now therefore, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT, OREGON, AS FOLx,OWS Section 1. Based upon the staff report, evidence, and record relating to said application, the Planning Commission hereby finds that said application meets the requirements for conditional use, that said conditional use as proposed is in compliance with the City's Comprehensive Plan and Zoning Code, and if the conditions set forth hereinafter are met by the applicant, said application meets the City's requirements for conditional use. Pl,ann.j. n.cg_Cond i ti ons 1. On site outdoor lighting and lighted signs shall not impact adjacent properties or interfere with a traffic signals ar traffic control signing. 2. Off' street parking design shall be consistent ti~rith Section 17.64.090 of the Central Paint Municipal Cade and City Ordinance Nn. 1512. 3. Project shall comply with all applicable local, state and federal laws. ~ . A conditional use shall expire three years from the date an which it became effective, unless prior to the expiration of three years, a building permit is issued by the City Building Official and construction is carnmenced and diligent-ly pursued toward completion. Pursuant to CPMC Section 17=75.060, the Planning Commission may extend this use permit for an additional tv~rel ve months subject to the f i nd i ngs and conditions outlined in CPMC Section 17.76.040. 6. Sight-obscuring fence and/or sight obscuring land- scape sf~all be installed by the developer on all sides and the rear of the property sa as to provide an adequate buffer between the development and the adjoining land uses, 7. The pre-engineered metal outbuilding and the impound parking lot shall always function as a secondary or incidental use to the primary use of the public buildings which collectively serve as District Three Headquarters far the Oregon State Police. Phase III of the project consisting of up to 60,OQ0 square feet of bui 1 di ng upon the southerly three ( 3 ) acre portion of the seven acre parcel shall be compatible with the Oregan State Police facility provided far in praject phases I and II and shall be amongst those public building uses further described in major groups 91,92 (excluding 9223), and 95 of the 1987 Standard Industrial Classification Manual as follows: (a) Major Group 91 - Executive, legislative, and General Government, except Finance. (b) Major Group 92 - .Justice, Public Order, and Safety; this group includes courts, public order and safety, legal caunsel and prosecution, fire protection but excludes correction institutians SIC 9223. (c) Major Group 95 _Administration of Environmental Quality and Housing Programs, 9. Prior to obtaining building permits for phase III of the project, developer or assignee sha11 complete and submit a City Site Plan Review Application to the City Planning Commission and receive the appropriate Site Plan Review and Approval. B. Fire/building Conditions 1. P,11 buildings to be designed and built to comply with the 1990 Edition Oregon Structural Specialty Code and the 1990 Edition of the Oregon Mechanical Specialty Code. 2, All flammable liquids storage and dispensing to comply with the 1989 Edition ai= The Oregon Fire Code Article 79. 3. All hazardous materials and processes, if any, shall comply with article 80 of the 1989 Edition of the Oregon Fire Code. 4. Facilities to comply with General Provision for Fire Safety per Article i0, 1989 Edition Oregon Fire Code as it pertains ta, but not limited to, fire hydrants, location and number as well as Fire Department access. Exhibit A Conditions of Approval (1/29/90} 05P Facility - Page 3 of 5 C. Public Works Conditions 1. Presently Highway 99 is an 80 foot right of way and a 50 ft. street section. The CPMC Code requires a 60 ft, street section at this location. 1~Jiden the street 5 feet an the east side Highway 99. 2. Plantings and signings shall be located so not to interfere with 55 ft. sight triangle at all ingress/egress locations. 3. Offstreet loading bays shall be constructed according to the minimum standards established is CPMC 1'7.64.020. 4. Curb and gu'cter section on Highway 99 shall be designed to provide drainage to the nearest drainage channel. 5. A soils engineer must evaluate the strength of the soil (R-values} to determine the street section design. The City's engineer shall be used, and the developer shall pay far the cost of these services. A design life for Highway 99 shall be 20 years with average daily traffi c of 20, Ofl0 vt/d, and 203 truck traffic. 6. A street lighting plan shall be included ire the construction documents according to the requirements of the Public Works Diractar. All ingress/egress locations shall be illuminated. Developer to install all pads and conduits far street 1 i ghts as a part of the canstructi on of this project. The developer shall also pay for street lights and the installation of all street lights by PP&L. 7. The developer shall install or cause to be installed, conduits for utilities at intersections or locations determined by utility companies and utility companies who will not install their services until after this project is constructed. The developer shall be responsible for all casts associated with the installation of these conduit crossings. A11 utility construction (i.e. power, telephone, gas, cable t.v.} shall be constructed according to the requirements of the governing utility, and the franchise agreements with the City for each utility. If improvements are required, they shall be done according to the plans completed by Developer's engineer and approved by the Central Paint Public 4~ork's Department. Developer shall design the storm drainage system to provide for discharge of properties in future phases or within the drair~rage service area of this project's storm drainage system. On site storm drainage shall be designed to handle a 10 year storm runoff. 9, According to CPMC 8,24 and 8.23, the owner of the property adjacent to a 100 year -Mood plain ar a drainage channel is required to maintain their portion of the channel free from obstructions that would affect the 100 year flood elevation ar bloc{< flow in the channel. The developer shall provide access to Griffin Creet< a minimum of 1 5 ft. for ec~ui pmsnt to mai ntai n the Gri ffi r~ Creek channel. Developer shall construct the storm drainage system to meet 'clue requirements set forth by the Department of Environmental Quality for biochemical oxygen demand, suspended solids, ammonia, and phosphorus. Any correction to the storm drainage system shall be completed during the construction of this project. 10. The on site sanitary sewer shall be tapped at a l ncati on and i n a rnethnd which meets w i th the app rova l of the Bear Creek Valley Sanitary Authority and the City of Central Point. Minimum size shall be an 8" PVC pipe D~n~4. 11. Developer shall pay a systems development charge (SDC ) based on the number of f i xtures and the type of discharge to the sanitary sewer. A meeting with the waste water treatment plant staff will be established in order to determine the amount of tl~e SDC. 12. Developer shall construct an adequately sized water line to the property men~tinned herein. Cost sharing for v,~ater improvements to this property must be approved by the Central Point City Council. exhibit A Conditions of Approval {1/29/90) OSP Facility - Page 5 of 5 13. On site water system serving fire hydrants shall be 8" ductile iron (DI). 1~, Pire hydrants shall be located as approved by the Central Point Pire department. 15 . All casts associated with this installation shall be the responsibility of the developer. 16. The on site water system providing domestic service shall be designed according to the requirement of the most recent addition of the Oregon Plumbing Specialty Code. 17, Construction permit fees for Building and Public Works shall be the responsibility of the developer. 18. This ~ieview was done in accordance with the rules regulations, and ordinances in effect as of the date of this review. Any modifications by the developer which would cause this project to NOT meet the standards set forth in the Central Point Municipal Cnde shall require a new review and approval of the modifications by the City of Central Point.
