HomeMy WebLinkAboutResolution 183 - 150 No. Front - Non-Conforming Usei ~~ ~~ r p:L~ANNTN(a COMMISSION Rl~,SO:LUTION N0. 1.83 A RLSOLUTION OF' CLASS7FIC.t1'.~ION OE A CT~]SS B NUNCONFORMINC USE AT 150 NORTH FRONT STREE`T' WITHIN '.I'~IE CITY OF' CENTRAL POINT WHEREAS, the City of Central PoS.nL-, Oregon, has adopted a Zaning Ordi- nance Text and Map wh.i.ch established lazad uses up to twenty years in advance of actual planned developzr~ent, and as a result, many land uses become noncnnform.ing uses; and WI-iEREAS, the City of Central Point Municipal Code Chapter I7.56 requires that all nonconforming uses within the City of Central Point, Oregon, shall be classified by the Central Point Planning Commission as either Class "A" or Class "B" nonconforming uses; and WHEREAS, City staff has encountered a nonconforming use at 150 North Front ,Street within the Thoroughfare Commercial District (C--S) of the City and may initiate a classification by the Central Point Planning Commission, NOW THEREFORE $E IT RESOLVED ~3Y THE PLANKING COMMISSION OF THE CITY OF CENTRAL, POINT, OREGON, AS FOLLOWS: Section 1. Based upon a staff investigation, the Planning Cairunission hereby finds that said use does not meet the classification criteria for a Class "A" nonconforming use outlined in Section 17.56.030 (A) of the Central Point Municipal Code. Section 2. Pursuant to Central Point Municipal Code Section 17.56.030 (B), the Planning Commission hereby designates the use at 150 North Front Street in Central point, as a Class B, nonconforming use, subject to conditions set forth in Exhibit A, attached hereto, and by reference expressly made a part of the within resolution. The nonconforming use described as an apartment dwelling steal]. 5.n no case, be enlarged or expanded. 2. if said nonconforming use is destroyed by any cause to an extent exceedµ ing 50 percent of the appraised va]_ue, future structures or sand use on said property shall conform to the zoning regulations for the district in which it is located. 3. Tf the nonconforming use is changed to a conforming use, or if the non- conforming use ceases for a pera_ad of six months or mare, said use shall be considered abandoned and said building or premises shall thereafter be used in accordance with the zoning regulations far the district in which it is located. ~. If the nonconforming structure containing a nonconforming use is removed from the tat, any future structure an said property shall conform to the regulations for the district in which it is located. 5. Continuance of this nonconforming use shall not in any way delay or ob- struct the development or establishment of conforming uses on the subject property or on any adjacent or nearby properties in accordance with the provisions of the zoning ordinance.
