HomeMy WebLinkAboutResolution 170 - Oddfellows Lodge/~J G` PLANNING COMINISS:iON RESOLUTION N0. 170 A RESOLUTION OF' CLASSIFICATION OF 1~ NONCONFORMING USE WITHIN THE CI`T'Y OF CENTRAL POINT AS CLASS ''A" WHEREAS, the City of Central Point, Oregon, has adopted a Zoning Ordi- nance Text and Map, and as a result, many uses have become nonconforming uses; and WHEREAS, the City of Central Point Municipal Cade Chapter 17.56 requires that all nonconforming uses within the City of Central Point, Oregon, shall be classified by the Central Point Planning Commission as either Class "A" or Class "B" nonconforming uses; and WHEREAS, the criteria for classification of Class "A" nonconforming uses or structures; A. Class "A" nonconforming uses are properties containing nonconforming uses or structures; 7.. The continuing use of which would not be contrary to the public health, safety, or welfare, ar to the spirit of this ordinance. 2. The use or maintenance of which is oat likely to depress the values of adjacent ar nearby properties, nor adversely affect their development potential in conformance with present zoning. 3. The use of which was lawful at the time of inception and no useful purpose would be served by strict application of the propvisions or reguire- ments of the ordinance with which the use or structure does not conform. 4. Which are not predominantly surrounded by conforming uses or structures and, considering current growth and development trends, is not reason- ably expected to come under development pressure during the next five years. 5. Which are structurally sound, well-maintained, and occupied and used for the purpose far which they were designed. 6. The continuance of said nonconforming use will not in any way delay ar obstruct the development or establishment of conforming uses on the sub- RESOLUTION NO. 1~~ - Page 1 ject property or any adjacent= o.r nearby properties in accordance w.it:h the pravi- sions of this Zoning ordinance; and WHEREAS, The Central Point Oddfelinws Lodge, owner of property at 1130 Hazel Street has requested a classification of this use as a Class "A"; and W~IEREAS, a review of the classification criteria listed in Section 17.56.030 of the City of Central Point Municipal Code was made; now, therefore, SE IT RESOLVED by the Planning Commission of the City of Central Point, Oregon, that the use currently existing at 1130 Hazel STreet is a nonconforming use and mast clearly related to a Class "A" nonconforming use designation. BE IT FURTHER RESOLVED that the Planning Commission identifies the proper- ty use as a Class "A" nonconforming use within Subarea C of the Subarea Designa- tion Key Map for the nancanfarming uses recorded in Planning Commission Resolution No. 36.
