A RESOLUTION ADOPTING FINDINGS AND CONCLUSIONS AND APPROVING
THE CONDITIONAL USE; F]PPI,ICATION SUBMITTED BY TERESE PANECALDO
WHEREAS, an application for a conditional use permit for a truck
dispatch facility in a C-5 zone has been submitted by Terese Panecaldn, said
business to be located at 175 North First Street within the City; the
location more particularly described as ~acksnn County Tax Assessor's map
page 37 2W 3DD, tax lnt 6300; and
WHEREAS, the Central Paint Planning Commission has reviewed and
approved the application at a public hearing held on the sixth day of
December, 1988; now, therefore,
BE IT RESOLVED BY THE PLANNING C0~'IMISSION OE' THE CITY OT' CENTRAL
POINT, OREGON, AS FOLLOWS:
Section 1. The relevant criteria applicable to the within
application is as followed:
(a} The Comprehensive Plan designates the site as thnrnughfare
commercial.
{b} The Zoning Ordinance designates the site as C--5.
(c} Central Point Municipal Cade Chapter 17.76 describes the
conditions which the planning Commission must consider in order to grant a
conditional use permit.
Section 2. The Planning Commission hereby finds as follows.
The proposal meets the City's urbanization goal for commercial land uses
found in the Comprehensive Plan because the east side of Highway 99 (Front
Street} is the primary thnrnughfare commercial district (C-5}. This area is
developed primarily for auto and truck related businesses and services. The
C-5 zoning recognizes these types of uses which will strengthen this corridor
while providing locations for these uses that are often not compatible with
commercial uses in other zones.
Section 3. The Planning Commission hereby finds as follows.
The prnpnsal meets the requirements of the City`s Zoning Ordinance for a C-5
zone because:
(a} Truck dispatching facilities are a conditional use.

{b) Nn evidence was submitted supporting a conclusion that the
proposed use would generate conditions that would adversely impact surround-
ing properties.
{c) A11 areas utilized .far parking, access and maneuvering of
vehicles are paved.
Section 4. The Planning Commission finds that the record herein
and the findings therefore support the conclusion that the proposal is in
compliance with the Gity`s Comprehensive Plan and the applicable standards
of the City's Zoning Code. The proposed conditional use is hereby approved
subject to:
{a} Compliance with the relevant requirements of the Uniform
Building Code and the Uniform Fire Code.
{b) No trucks used for the transport of goods exceeding 15,000 lb.
gvw shall be permitted to visit the site to conduct business transactions.
