A RESOLUTION ADOPTING T'INDINGS AND CONCLUSIONS AND
APPROVING TkIE CONDITIONAL USE APPLICATION SUBMITTED
BY FRANCES E. BAT,~,ANTYNE FOR A FAMILY AMUSEMENT CENTER
WHEREAS, an application for a conditional use permit fax a family
amusement center in a C-3 zone has been submitted by Frances E. Ballantyne,
said business to be located at 227 East Pine Street within the City; the
location more particularly described as Jackson County Tax Assessor's map
page 37 2W 3DD, tax lot 10600; and
WHEREAS, the Central Point Planning Commission has reviewed and approved
the application at a public hearing held on the first day of November, 1988;
now, therefore,
BE IT RESOT.,VED BY THE PLANNING COMMISSION OF THE CITE' 0~' CENTRAL POINT,
OREC70N, AS FOLLOWS:
Section 1. The relevant criteria applicable to the within application
is as follows:
(a} The Comprehensive Plan designates the site as downtown business.
(b) The Zoning Ordinance designates the site as C-3.
(c) Central Point Municipal. Gode Chapter 17.76 describes the conditions
which the Planning Commission must consider in oxder to grant a
conditional use permit.
Section 2. The Planning Corr~mission hereby finds as follows: The
Comprehensive Plan identif ies a lack of cn~nznercial and recreational facili-
ties in Central Paint. Based on this deficiency, the City has committed to
encourage duality entertainment and recreational facilities to locate in
Central Paint.
Section 3. I'he Planning Commission hereby finds as follows: The
proposal. meets the requirements of the City's Zoning Ordinance for a C-3 zone
because:
(a) Amusement centers are a conditional use.
(b) No evidence was submitted supporting a conclusion that the proposed
use would generate conditions that would adversely impact suxround-~
ing properties.

Section ~. The P:l.anning Commission finds that the record herein and
the findings therefrom support the conclusion that the proposal. is in compli-
ance with the City's Comprehensive Plan and the applicable standards of the
City's honing Code. The proposed conditional use is hereby approved subject
to:
(a) Compliance with the .relevant requirements of the Uniform Building
Code and the Uniform Fire Code.
