A RESOLU`T`ION ADOPTING FINDINGS AND CONCLUSIONS AND APPROVING TT-3E
CONDITIONAL USE APPLICATION SUBMITTED BY ROXY ANN GEM ANT? MINT?RAT.,, INC,
WT-TEREAS, an application for a conditianal use permit for a museum es~pansion
~_n an R-1 zone has been submitted by Roxy Ann Gem and Mineral, Inc., said facility
presently located at 2002 Scenic Avenue within the City; the location more particu-
larly described as Jackson County Tax Assessor's map page 37 2W 3AB, tax lots
3600, 3700, 3790, and 3800; and
WHEREAS, the Central Point Planning Commission has reviewed and approved the
application at a public hearing held on the fourth day of October, 1988; now,
therefore,
BE IT RESOLVER BY THE PLANNING COMMISSION OF THE CITY OF CENTRAL POINT', ORE-
GON, AS FOLLOWS:
Section 1. The relevant criteria applicable to the within application is
as follows:
{a) The Comprehensive Plan designates the site as residential, single--family.
{b) The Zoning Ordinance designates the site as R-1.
{c} Central Point Municipal Code Chapter 17.76 describes the conditions which
the P~.anning Commission must consider in order to grant a conditianal use
per~tit .
Section 2. The Comprehensive Plan anticipates location of new and expan-
sion of existing quasi-pubJ.ic facilities. Within the urbanization goal analysis,
the Plan concludes that these uses are often compatible with both residential and
commercial development and may locate and expand almost anywhere in the co~a€munity.
Section 3. The Planning Commi.ssian hereby finds as follows. The proposal
meets the requirements of the City's 2,oning Ordinance for an R-1 zone because:
{a) Museums are a conditional use.
{b) The proposal meets all height, yard and lot coverage requirements.
{c} Na evidence was submitted supporting a conclusion that the proposed
expansion would generate conditions that would adversely impact
surrounding properties.
{d) All areas utilized for parking, access and maneuvering of vehicles shall
be paved.
Section 4. `T'he Planning Commission fa.nds that the record herein and the
findings therefrom support the conclusion that the proposal is in compliance with

the City's Comprehensive Plan and the applicable standards of the City's honing
Code. The proposed conditional use is hereby approved subject to:
(a) Compliance with the relevant requirements of the Uniform 33uilciing Code
and the Uniform Fire Cade.
(b) Entering into a deferred a.mprovement agreement for storm drainage sys-
tems, sewer, water, streetlights, curbs, gutters, sidewalks, and paving
and Street improvements that may benefit the subject property.
(c) Completion of the paved parking area including the provision of six addi-
tional vehicle parkings spaces by Design of an-site
parking area to be reviewed arrd approved by the Central Paint public
Works Department prior to construction.
