HomeMy WebLinkAboutResolution 133 - Bi-Mor Station VariancePLANNING COMMISSION RESOLUTION N0. 133 A RESOLUTION ADOPTING FINDINGS AND CONCLUSIONS AND APPROVING THE VARIANCE OF ROBERT W. HAYS AND MICHAEL J. MORAN WHEREAS, an application for a variance for 29 on-site parking spaces has been submitted by Robert W. Hays and Michael ~. Moran for the Bi-Mor Station located at 16 North Front Street within the City and more particularly described as Uackson County Tax Assessor's map page 37 2W 3DD, t~ lots 9600, 9600 A-1, 9407, 9400, and 9407; and WHEREAS, the Central Point Planning Commission has reviewed and approved the application at a public hearing held on the first day of March, 1988; now, therefore, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CxTY OF CENTRAL POINT, ORE- GON, AS FOLLOWS: Section 1. The relevant criteria applicable to the within application is as follows: (a} The Comprehensive Plan designates the site as thoroughfare commercial. (b} The Zoning Ordinance designates the site as C-5. (c} Central Point Municipal Code Chapter 17.80 describes the conditions which the Planning Commission must consider in ordEr to grant a variance. Section 2. The Planning Commission hereby finds as follows. The proposal meets the criteria for granting a variance because: (a) The variance will provide advantages to the City because the rebuilt facilities will give more and better services to Central Point residents. (b) The variance wall provide beautification to the City with new facilities and increased planter areas. (c} The variance will provide safety to the City through its better lighting. (d) The variance will provide protection to the Gity with new underground storage tanks and piping systems. (e) The variance will not have any adverse impact upon the City because the applicants will follow all reco~r~mendations and suggestions from the City of Central Point in improving this corner. PLANNING COMMISSION RESOLUTION N0. 133 W 1 (f) The variance will utilize property with the intent and purpose of the zone district. Section 3. The Planning Commission finds that the record herein and the findings therefrom support the conclusion that the proposal is iai compliance with the City's Comprehensive Plan and the applicable standards of the City`s Zoning Code. The proposed variance is hereby approved subject to compliance with the relevant requirements of the Uniform Building Cnde, the Uniform Eire Code, and the requirements of the City's Public Warks Department attached hereto as Exhibit "A" and by this reference is incorporated into the within resolution. Meet the requirements of the State I3ighway Department regarding access on I~ighway 99. 2. Final plans must have sanitary sewer and water system service locations on them. Also verify size. 3. Water and sewer systems must be adequately sized to handle the new facility. 4. Pine Street ingress/egress driveway shall be designated a right turn in/right turn out only. This driveway shall be signed properly according to the Manual on Uniform Traffic Control Devices (MVTCD). 5. Storm drainage system is sized prnpe~-ly; however, connections to the catchbasin in Pine Street must be approved by the State Highway Department. 5. The sidewalk on Pine Street is basically at the surface of the asphalt nn the street. In order to protect the pedestrian traffic adjacent to the Bi-Mor praperty, the sidewalk on Pine Street needs to be reconstructed to include a seven-inch curb exposure. 7. Plans, when completed, should include the cost of installation of all public facilities; i.e., water, sewer, storm drainage, sidewalks, driveway, signing, etc., that is contracted in the public right-of-way and will eventually be maintained by the City of Central Point. 8. Site distance area at the corner of Pine and Front Streets shall be maintained and developed to prevent visual obstructions.
