PLANNING COr~MISSION RESOLUTION NO. 7?4 A RESOLUTION APPROVING A CONDITIONAL USE PE1~MI'I' TO ALLOW A DWELLING GROUP OP' })i1PIaE~ES l:N ~N R-2 ZO~3Is` WHEREAS, Roger Richardson filed an app:l_ication far a candit~.onal- use per- mit to allow a dwelling group of duplexes in an R-2 zone at the northeast corner of Bursell Road and Beall bane, Central. Point, Oregon, further described as Jackson County Tax Assessor's Map Page 37 ltd 11D, Tax Lot 2200; and WHEREAS, Notice of Public Hearing held June 2, 1.987 was published in the Medford Mail Tribune on May 20 and 2b, 1987; and WHEREAS, at said public hearing testimony from proponents and opponents was heard or given opportunity to be heard; now, therefore, BE IT RESOLVED that the Planning Commission of the City of Central Point, Oregon, adopts the findings of fact as presented by the applicant and approves a conditional use permit to allow a dwelling group of up to five duplexes (ten dwelling units) consistent with the development plan ~.dentified as Exhibit H, attached hereto in reduced form, in an R-2 zone at the northeast corner of Bursell Road and Beall Lane, Central Point, Oregon, further described as Jackson County Tax Assessor's map page 37 2W 11.D, Tax Lot 2200, with the following conditions attached: 1. The developer, Roger Richardson, shall enter into a Deferred Improve- ment Agreement that the City will have recorded to run with the Land. Said agreement wall requa.re that the owner or any future owner shall not remonstrate from being a party to a local improvement district to grovide water, sanitary sewer, storm sewer, street, curb, gutter, sidewalk, or other improvements de- termined to benefit said property. 2. Prior to the issuance of building permits, the developer shall. provide evidence that Jackson County has approved his development plan. 3. The developer, Roger Richardson, sha11 provide a 30-foot front setback on the Beall Lane side of the property to conform to any future additional right--of~-way as indicated on the Gity of Central Point's present Comprehensive Land FJse Plan.
