City Council Meeting. Minutes
October 9, 2008
1. REGULAR MEETING. CALLED TO ORDER
Mayor Williams called the meeting to order at 7:00 p.m.
II. PLEDGE OF ALLEGIANCE

Council Members: Bruce Dingier, Dick Halley, Kay
Harrison, Walter Moczygemba, and Mike Quilty were
present. Matthew Stephenson was excused.
City Administrator Phil Messina; City Attorney Doug Engle;
Police Chief Jon Zeliff; Interim Community Development
Director Matt Samitore; and City Recorder Deanna Casey
were also present.
IV. PUBLIC APPEARANCES -None
V. CONSENT AGENDA
A. Approval of September 25, 2008, City Council Minutes.
Kay Harrison made a motion to approve the Consent Agenda as presented.
Mike Quilty seconded. Roll call: Bruce Dingier, yes; Dick Halley, yes; Kay
Harrison, yes;. Walter Moczygemba, yes; and Mike Quilty, yes. Motion approved.
VI. ITEMS REMOVED FROM CONSENT AGENDA - No items. removed
VII. PUBLIC HEARINGS, ORDINANCES AND RESOLUTIONS
A. First Reading - An Ordinance Adding Chapter 8.40 Entitled "Graffiti
Vandalism" to the Central Point Municipal Code
Police Chief Jon Zeliff explained that the proposed Ordinance is one more tool
that the Central Point Police Department will use to make citizens and visitors in
Central Point feel safe. The act of placing graffiti is often a precursor and/or
indicator of a number of other criminal activities. Graffiti is often used as a highly
visible and intimidating form of communication to warn others of territorial
boundaries. tt can be very disconcerting, adversely impacting ones feeling of
safety and their belief about the level of criminal activity in our community.
There was discussion of different types of graffiti and tagging.., Staff has been
trained to read the signs and; meanings hidden in graffiti. The Police Department
has been working with local businesses so the impact of the ordinance and
guidelines will not cause overdue burden to the sales staff and management.
Most businesses in Central Point already comply with the provisions in the

ordinance by having the items within sight of the check-out counter or have video
surveillance.
There was discussion of the steps that would be taken if someone under the age
of 18 were to attempt to purchase the items or if they were found with them in
their possession. The officers in the field will use education for most situations.
The ordinance will give officers the lawful right to retain an individual for probable
cause.
Kay Harrison made a motion to move to Second Reading An Ordinance
Adding Chapter 8.40 Entitled "Graffiti Vandalism" to the Central Point
Municipal Code. Dick Halley seconded. Roll call: Bruce Dingler, yes; Dick
Halley, yes; Kay Harrison, yes; Walter Moczygemba, yes; and Mike Quilty, yes.
Motion approved.
B. First Reading - An Ordinance Amending Chapter 2.18 to the Central
Pint Municipal Code Parks and Recreation Commission
Interim Community Development Director Matt Samitore stated that the current
ordinance states that there will be 11 members. of the. Parks. and. Recreation
Commission. Over the past two years there have never been 11 members in
attendance at any one meeting. He would like the Council to approve the
recommended ordinance lowering the membership to seven members like all
other Central Point Committees. Mr. Samitore explained that there are three
members who do not attend the meetings, and one that has had pour attendance
in the past. He will return with a recommendation at the end of the year when
Council reappoints committee members.
Kay Harrison made a motion to move to second reading An Ordinance
Amending Chapter 2.18 to the Central Point Municipal Code Parks and
Recreation Commission. Mike Quilty seconded. Roll call: Bruce Dingler, yes;
Dick Halley, yes; Kay Harrison, yes; Walter Moczygemba, yes;. and Mike Quilty,
yes. Motion approved.
VIII. BUSINESS
A. Planning Commission Report
Interim Community Development Director Matt Samitore stated that the regularly
scheduled Planning Commission meeting. for October 7th was canceled due to
lack of quorum. All items will be re-noticed and heard at the regular meeting on
November 4m
IX. COUNCIL BUSINESS
Council Member Bruce Dingler stated that he noticed an RFP regarding a
Compensation Study on -the City website. He would like to know why we are
looking outside the City to fulfill this requirement. It was explained that it is a very

in depth study. The Union Contract stipulated that the study must be done by an
outside source. The Budget Committee approved $25,000 for this study.
X. AflAYOR'S REPORT
Mayor Williams reported that he attended the RPS meeting and attended the
LOC Conference in Salem.
XI. CITY A4flAINISTRATOR°S REPORT
City Administrator Phil Messina stated that:
• He attended the RPS meeting:
• He attended the LOC Conference in Salem.
• There will be a Study Session on Tuesday, October 14, at 6:00 p.m.
• He will be attending a Sesquicentennial meeting, which is for Oregon's
150' birthday.
• Chief Zeliff did an Ethics Session at the LOC Conference.
• City Hall day for our region will be at the City Council Chambers in Rogue
River on October 16~'.
X11. COUNCIL REPORTS
Council Member Mike Quilty reported. that:
• He attended an RPS meeting where Jacksonville agreed to stay with the
process. They will be reducing the amount of land from their inventory.
• He attended a meeting with Representative Gilman .regarding
transportation pilot projects in the area.
• He will be attending a meeting in Prineville on the 16"'.
• He witl be in Portland on October 23"d and in Sacramento during the first
meeting in November.
Council Member Walter Moczygemba reported that:
• The health clinic at Jewett Elementary school is in place.
• He attended an art clinic at La Clinica on October 4~'.
• He attended a meeting regarding street maintenance fee.
Council Member Kay Harrison reported that she attended the LOC Conference
and attended the meeting regarding street fee maintenance.
Council Member Dick Halley reported that he attended a Greenway Committee
meeting
Council Member Bruce Dingier reported that he attended a Street Utility meeting
and the unveiling of the first City Mural.
XIII. DEPARTIYIENT REPORTS

Interim Community Development Director Matt Samitore reported that:
• Staff would like to have direction regarding the Community Christmas
Tree. They have not been able to find any trees to put in the Premier
West Parking lot. The other alternative is to use the live tree at City Hall. If
we use the tree at City Hall, we should schedule the tree lighting for a
different night in the future.
Council agreed that we should move the tree lighting to City Hall. It is a good
idea to schedule it on a different night from the Community Christmas event.
• They should be paving the parking area for Don Jones Park next week.
• They will be doing an assessment of the Elm Trees in Pfaff Park for
decease. They will be removing two of the trees in Pfaff Park because of
age.
• They will be having a dedication ceremony on Veterans Day for the War
Memorial.
• The final plat for Federal Way Business Park has been signed.
• There will be a discussion on Enterprise Zones at the next Study Session.
• There was a downtown meeting on Monday:
• The McDonalds expansion has been approved.
• The Malot Building across from City Hall should be complete in
November.
• Staff will be scheduling. a dedication for Blue Grass Downs Park.
Police Chief Jon Zeliff explained that the City uses the "Child is Missing" Alert
Program. He explained the steps used when there is a missing person reported.
XIV. EXECUTIVE SESSION.- There was. no executive session
XV. ADJOU~NIVIENT
Mike Quilty moved to adjourn, Bruce Dingier seconded, all said "aye" and the
Council Meeting was adjourned at 8:15 p.m.
The foregoing minutes of the October 9, 2008, Council meeting were approved by the
City Council at its meeting of October 23, 2008.
