This agreement made by and between the City of Central
Point, Oregon, a municipal corporation, hereafter referred to as
"Central Point", and Jackson. County, Oregon, a political
subdivision of the State of Oregon, hereafter referred to .as
"Jackson County".
Recitals
1. Pursuant to a "Water Main Construction Agreement" dated
September 15, 1976, Central Point agreed to provide Jackson
County with water service at the Jackson County Fairgrounds and
Exposition property, and to charge Jackson County a sum equal to
the City's actual cost for such water.
2. It has recently been discovered that Central Point has
inadvertently been charging Jackson County 1-1/2 times (which is
the out-of-city rate) the appropriate rate for water.
3. Based on mutually-agreeable calculations, it appears
that Central Point has, over the period December, 1991, through
November, 1997, overcharged Jackson County by the sum of
$25,482.21.
Now, therefore,. the parties agree as follows.
Agreement
1. Central Point agrees to pay to Jackson County upon
execution of this agreement, the sum of $25,482.21.

2. Jackson County hereby accepts such sum in full and
complete satisfaction of all previous water billing overcharges
at~the Jackson County Fairgrounds and Exposition property from
the inception of water service through November, 1997.
