Roll call found: Hill, Manasco, Reed, Tonn, Tucker, Van. Horn, present. - Also present were: Mansfield, Tate and Zander. Motion by Hill, second Tucker to approve the previous minutes with the following corrections to be made. Paragraph 7-as per sentence 7 with a large "W" on the word "when". Sentence 4 to read: !'He said he had been told by a member of this council that the City Administrator's duties would be directed to him at the January 7 council meeting." Mayor Burton read correspondence from State Forester regarding City, State,and Rural Fire Dept. agreement. Comment by Chief Allan Higinbotham regarding the City share of cost should be discussed further before the next fiscal year. Tabled. for further study by Fire Committee. City Attorney Mansfield presented proposed Ordinance, an ordinance relating to the office of City Administrator and repealing ordinance No. 488 and Sec. .l-1 of the Code 6f Central Point, 1967. Discussion held on this by Mayor Burton. Mayor Burton advised to hold the ordinance to a later point in the meeting, as he had further information on the subject. Nomination was made by Mayor Burton for Central Point Airport commission as follows: Mr. Richard Krupp and Everett Faber. Motion by Manasco and second by Tone to accept the Mayor's appointment. Motion carried. Mr. Todd Rowe, 700 N. 3rd Street, presented his request of a~variance of the Building Code regulating the structure of backyard fences of 6 feet in height. After discussion and a report from Building Inspector George Gilham, recommending the approval of the change, Councilman Reed made a motion for granting the request. Second by Tucker. Motion carried. Motion by Manasco, second by Hill to approve the bills for the month of Januray, 1969, for exception of Bryce Townley's statement of services for engineering on S. 1st Street. Conditional approval of Mr. Townley's statement was made by Council that councilman Manasco check with Mr. Townley and approve or disapprove. (Manasco approved by phone call Feb. 6, 1969.) Mr. Ben Mushaney reported and stated that "We are progressing very well and. agreements will be in hand shortly, with minor issues to be worked out." (refer to Mushaney report). Mr._ Mushaney stated that a press release made recently was inadequate and that "We have not reached a Complete Agreement." Press release was ordered by Mayor Burton by prepared letter. Appreciation was extended to Mr. Mushaney for a fob well done when representing .Central Point at these meetings. It was agreed by all members of the Council that Mr. Mushaney continue with his fine and respected effort to meet with the B.C.V.S.A. of further meetings. Attorney Mansfield asked if he ~sould be of any assistance at this time regarding any. legal approach with the proposal of Sewer Development. Mayor Burton .stated. that further information and material would be needed before making the next step. ., 1 ~'~. Mr. Dave Almquist reported of log trucks and other large vehicles using residential streets in Royal Heights Subdivision,. causing excessive noise in the early hours of the morning, which is very distrubing to the residents. He asked if there was any ordinance regulating this problem. City Attorney Mansfield explained the ordinance and approach to the problem such as calling for the police when excessive noise or hazards exist. Mr. Mansfield referred to the nuisance ordinance that would ` regulate most of the existing problem. Pavement damage on Comet Avenue was discussed and explained by Mr. Mansfield. City Attorney advised against any suit as not being ~ o~ ® feasible. Cost of repairs were discussed to some extent but no ~ ~"°~ ~ appraisal or estimate has been made. The last estimate (May 1968) ~~p~~ti`~~~~ ~ being approximately $425.00. The water and flood problem has been ;~ remedied, but the damage still exists. Mayor Burton delegated the Street Committee to study the situation for further reports of findings. v,~ ' Councilman Hill reported on the Larry Freeman Sanitary Service (garage). Reports show that Mr. Freeman will operate a closed dump. Mr. Mansfield read an existing agreement to the"Council and discussion was held. Liability, dependability, and land usage was discussed. Councilman Tucker moved that Mr. Freeman be notified to file application with deposit to conform with the agreement now being held by City Sanitary Service. Motion second by Ree. Roll call. Five in favor with. aye. Councilman Manasco voted nay. Motion carried. Mayor Burton called for a motion to establish a study for Municipal Employee Retirement and to pay the estimated $100.00 fee required for the study. Tonn made the motion to call for a retirement study of City Employees, second by Reed. All in favor. Motion carried. Sgt, James Corliss stated that all City employees agreed the Public Employees Retirement Plan was the best. Nt~,~r Burton stated that the City employees will refrain from making • City purchases from the Central Point Pharmacy as he now has taken .ownership. Mayor Burton stated that any business conducted between City and C.P. Pharmacy would be in violation of City Charter. However, this-does not refer to city employees own personal business. Mayor Burton asked that all employees, appointees and elected persons give-full cooperation to each other and to refrain from further bickering and. backbiting. Only with an adult approach, the City will meet its goal. He further stated that he will appoint a m as City Administrator during. the regular meeting in March. A study was conducted on this matter and from it "I have made the decision." Questions from the floor, Mr. Ken Damon: Are you going to take applications for City Administrator? Answer: Mayor Burton - according to the City Charter it does not-state or ask for any applications and only through it did I hase may opinion and decision. "I'm going to recommend to the Council a nominee and hope they will accept it with approval." Mr. Todd Rowe suggested of taking applications for this position. Mayor Burton again referred to the City Charter explaining the appointment and only by what it spells out. 9:50 P.M: Councilman A.D. VanHorn excused from the meeting. Letter read by Councilman Reed regarding the proposed appointment of City Administrator and elected Recorder. (refer to letter attached). Proposed ordinance read by Mayor Burton on traffic control regulating truck traffic in residential area and parking violations. Mr. Mansfield reported to the Council that the Judgement of Grigsby vs. City of central Point was in favor of the City with no further court action foreseen, unless an appeal is made within 30 days. It was agreed by Mayor and Council that Nir. Mansfield prepare a certain amount of copies of the Sign Ordinance by xerox copy in the amount of $36.40 for .the cost of service. Councilman Tucker reported on the Church of Christ property still being available to the City at a price of $50,000.00 for future City ~1a11 location. Mr. Tucker stated that a tour of the property shatu~d be conducted by the Council to determine its value, etc. Motion by Reed, second by Manasco to study the need and also to tour and investigate the property. Motion carried. Mr. Mansfield read letter from Mr. Neidermeyer regarding the sale of City share of crop (hay). Also reported that 2 checks were received in the amount of $554.03 as part of expected share. Councilman Reed wanted to know under what authority does Chief Sibley use City car for transportation to and from his residence, since he lives out side the city limits? Discussion. Ben Mushaney commented that the former Chief had the same privilege. Mr. Mansfield. stated that the proposed traffic ordinance had been prepared and been side tracked. Copy of prepared ordinance was in the hands of the former City Administrator at this time. Mayor Burton stated that we should go ahead with the prgparati.on. ' Vern Capps suggested that the council should consider an increase in the water connect charges due to the increase of material and labor costs.
