Absent, none. - Also present; Mason, Tate, Mansfield'. The Common Council met presiding,.. It was moved and seconded the minutes be approved as mailed to each councilman. Motion carried. Planning Commission minutes were discussed. Attorney Mansfield reported to the council that he had not completed the typing on the Fire Code. It should be ready in the near future. Attorney Mansfield discussed the Sign Code ordinance with the council. He asked for $25.00 to have it tyy~ed, since it was lengthy. Mayor Bartley suggested Mr. Mason have it typed at City Hall. Mr. Mason was instructed to have itn~typed. Attorney Mansfield read Ordinance No. 927, this being an ordinance relating to driveways, and amending ordinance No. 336. It was moved and seconded Ordinance No. 927 be approved. Roll call vote. All in favor. Ordinance No. 927 declared duly adopted, Attorney-Mansfield explained that he was concerned with the division of lots in :a platted subdivision. Especially where a legal lot was divided. and left an illegal size as Thomas Whittle had proposed in his Green Oaks Subdivision. Lengthy. discussion was held on the various problems in subdivisions. Attorney Mansfield also said he felt any unplatted land within the city should be subject to the subdivision regulations." This should~be a precondition to building a 'residence on the land. After more discussion, Attorney Mansfield said he would send a written report to the Mayor and council out- lining his feelings on the matter. Attorney Mansfield sgain~;asked the council if they. would like for him to attend the Judicial Counsel meeting in Medford. The meeting would be for a discussion of eliminating ;the Justice of Peace and Municipal Courts and having a lower court. There would be no - cost to the city"for him to attend. . Mayor Bartley said he did not feel the council'could~~make any .statement as to their feelings on the matter at this time.. However, if Mr. Mansfield wanted to attend, perhaps he could obtain further information for the council. Mr. Mason asked the mayor to have the Sewer Committee meet with him to study the ~aewer rates for multiple dwellings and multiple connects. (Meeting_aet for Friday, Sept. 6 at noon.) `~ Vern Capps, Supt. Public Works, asked Mr. Mason if they were also going to discuss, some of the problems he had wanted to bring before the council. Mr. Capps was advised to attend the meeting. Mr. Mason said he was concerned with the newspaper reports. of Central Point preparing to sell bonds for their share of the BCVSA construction~~ of sewer system.Central Point has not been advised. of any change "in plans or has not received any information whatsoever on the progress, of either the BCVSA or City of Medford. He did not feel that Central Point should sell bonds and give the money to the BCVSA and have them draw interest on it during construction. Councilman Mushaney moved that a letter be sent to BCVSA and City of Medford asking them to inform City of Central Point of their .plan instead of Central Point having ~to obtain their information through the local news media. And to advise them they were not given authority to speak for the City of Central Point. Seconded by Hill. .Motion carried. Mr. Mason again ,brought up the matter of replacing the curbs on S. First Street from Cedar to Bush Street, as he had suggested at the August 2gth meeting. Mr. Mason said money budgeted for Bush Street construction could be used for South First 'Street. He estimated approximately $1,300.00 would be enough to replace the curbs. Mayor Bartley asked Mr. Mason About the drainage on Bush Street. What happened to the elevated sidewalk Mr. .Hamlin was supposed to construct when he developed. the 3 Boys Shopping Center? Mr. Mason was advised to contact Mr. Hamlin and get this done. It was moved by Ayres, second Hill to construct new curbs on S. First Street from Cedar to Bush Streets. Money from $ush Street construction to be used for this pro3ect. Motion carried. Miss Louise Lull contacted Mr. Mason about starting a new Kindergarten in her dance studio located at 216 E. Pine Street. Mr. Mason said . he was concerned about the building being safe enough for such a school. He had been concerned about it for quite some time, since it was in poor condition. Don Turner, Fire Chief, was questioned as.to the. Fire Code for this type of business. He said he felt the building was unsafe. Attorney Mansfield advised the council that it. was their duty to check the building and if it was found to,be.in an.unsafe condition, to comply with the Building Code regarding "Dangerous Buildings". The City Administrat©rr:could start proceedings in the matter. ~ . Mayor Bartley instructed Mr. Mason, Don Turner, and George Gilham to go over the building with Mr. Donald E. Faber, owner. .And to table the request of M~~~ Lull until .the building is checked.,, Councilman Hill gave sewer committee report. Councilman. Tucker gave administrative committee report. i ~: i 1 7i /. Councilman Mushaney, Chairman of the Police Committee, recommended the Jackson County Sheriff be contacted on the matter of the shooting at?°ahe Edward Zander residence last winter. Attorney Mansfield should. contact the Sheriff and see if he can obtain any information...- If the information needs to be given in confidence, the attorney can obtain it and keep - itconfidential. It was moved by Mushaney, second Ayres to instruct the attorney to contact the Sheriff on the matter. Motion carried. Councilman Tucker asked if the Police Chief had tried to obtain any information on the shooting. Chief Sibley said he had not for about two months. He had been advised by Mr. Mason to wait until a later date. ~ Councilman Tonn said he was concerned about .South First Street construction '"~ not being started yet. If it was delayed much longer, the weather would ~ be too bad to enable it to be completed this fall. Mr. Mason said. it ~ would be started as soon as he took the contract in to Concrete Steel ~ to be signed. Councilman Ayres said he had complaints of low water pressure on Crater Lane. ~~ern Capps told Mr. Ayres this was due to Crater Lane having only a 2" line. Also, the water in West Pine Villa Sub. is quite warm. He was advised 'by the Fire Chief that the lines,had.been flushed out, but due to a lack of use the water does not circulate enough to keep it cool. There are only three houses using water at this time, and the line is not a circulating line. Mr. Mason read a letter from Jackson County Court regarding the request for a bridge to be built on the Rogue River at Gold Rey. The County said it would cost approximately $1,800,000,for the road and $1,200,004.°° for the bridge. They felt there were other places in the County that needed roads much more than at that location. A letter from Goodwill Ind. saying they were not going to try to annex the former Join Cupp Furniture Store property at this time. They had found better facilities at White,City. Mr. Mason said the annexation would be dropped. ~~'`. Robert Manasco asked the council why the sewer use charges had not been dropped when the bonds were paid off. He had several citizens asking, about this. Mr. Mason explained that the charge was to cover payments,~sor bonds and interest and to maintain, construct, and replace sewer lines. It is necessary to have money available to keep the sewers in good condition. - Mr. Manasco asked the council if they planned to hold a-Public Hearing on the ,proposed New Charter. It was moved by Tucker, second Hill to hold a Public Hearing on Oct. 1, at the :regular council meeting,.. on the proposed new charter. And direct the City Recorder to publish a notice in the newspaper. Motion carried. ,b'`'' Chief of Police Sibley asked what the council meant when they had tentatively approved some of his requests presented at the last council meeting. Councilman Mushaney said they were awaiting his-return from vacation to explain .some of them.°,9~ The committee would meet with him and discuss the requests. Mr. Mason told the council that .officer Larry Johnson had completed his 30 day School at Camp Withycombe and had made a final grade of 96. He was to be commended on his high score. Mayor Bartley did not have any information back yet on his inquiry on Errors and Ommission ins. It was moved and seconded to approve the bills and instruct the City Recorder to draw warrants to~pay.
