The Common Council met in regular ad3ourned session with Mayor Bartley presiding. _ Roll call found: Present; Ayres, Hill, Holbrook, Tonn, Tucker., Absent; Mushaney. Motion Holbrook, second Ayres to approve the minutes of the previous meeting as mailed to each councilman. Motion carried. Discussion on Planning Commission minutes. ~ Vern Capps introduced Mr. Ray Parrow from Grants Pass. Mr. Barrow said P-~d 'he had equipment he used in Grants Pass for excavation on street ~' improvements. He does the work-for $19.00 per hour. This includes the ~ equipment and operator. The city of Grants Pass has been able to do ~ their ~breet work for much less than other cities, by~t hiring him for the excavation. The cost is approximately 30¢ per yard. Attorney Mansfield advised the council that the city charter might prohibit them from having the street work done without caliing for bids. However, he said he would look into it further. . Mr. Mason told the-council that the engineer, Bryce Townley, did not have the plans completed for the next years street work. Mayor Bartley suggested turning the matter over to the street committee. Motion made and seconded to have the street committee check out the prices and all the problems involved in doing the street work this .way. Motion carried. Discussion- Ordinance No. 679. This ordinance regarding animals running at large or keeping of animals. Mr. Mason said another ordinance had been ,repealed and this one passed. However, ,some parts have been deleted, which he felt were needed. He felt the ordinance should be amended to be more specific on certain points. It was moved and seconded to refer to the administrative committee for drawing up recommendations for amending Ordinance No. 679.. Motion carried. Attorney Mansfield read Resolution No. 145, this being a resolution canvassing the results of the special election on the adoption of a new City Charter held May 26, 1966. results: 426 yes 645 no Motion Ayres, second Holbrook to adopt Res. 145. Roll call vote. All ~ Yavor. Motion carried. Resolution No. 145 declared duly adopted. Letter-was read from Mrs. Charlene Menke, Sec.-Treas. of the Fourth of July Family Festival Committee. She requested permission from the council to use the city streets for a parade, use the Park for the Festiva]., hang a banner across Pine Street to advertise the Festival. 6 Motion Holbrook, second Ayres to approve all of the requests. And instruct the City Recorder to draw a warrant in the amount of $100.00 for the Festival. Motion carried. Letter frc~n Mr. N.A. Mead regarding the damage done to Comet Ave. by Graff and James Construction during their-work on the new Junior High School. He said Graff and James would not admit to any liability. Hughes and Dodd had admitted to some liability. Mr. Mansfield explained letter he had sent to"Mr. Mead. Mr. Tucker said Mr. Mead should be contacted and have him handle the matter instead of the city. Mr. Mason said he•would take care of the matter, by contacting Mr. Mead. He said the School District was holding part of the final payment~to Graff and James until the damage has been taken care of. Letter from County Commissioner regarding the Community Action Council. He said if the city did-not answer the letter, it would mean they were in agreement with-the letter. Attorney Mansfield was advised to check the matter further. Mr. Mason read a letter from Mayor Dunlevy of Medford, inviting the councilmen, mayor, department heads, and City Administrator to the Regional League of Oregon Cities meeting to be held, June 12 at the City H~,11 in Medford. A no host dinner to follow at Kim's Restaurant. Workshop to be from 4:30 p.m. to 6:00 p.m. Several councilmen indicated they would attend. Attorney Mansfield reported he had checked the Medford Water Commission schedule to water charges and they have notchha~nged the rate fir the city. Letter from State of Oregon regarding Regional Planning. Discussion- Ordinance No. 858 sets contempt of court fine at $15.00, for 3urors. The old ordinance had set the fine at $50.00. Attorney Mansfield recommended the amount be set at $100.00. Motion made and seconded to refer to attorney to have an amendment for next meeting. The amendment to read. "Not more than $100.00." Motion carried. Dog control in the city was discussed and referred to the city attorney. Attorney Mansfield explained the proposed fence ordinance. After presenting several drawings on the board, he said he felt there was need to check the proposed ordinance further, since there seemed to be several points to be cleared up. Councilman Hill requested meeting with Sewer Committee to discuss sewer system plans. ~'~' Councilman Tucker reported on the Administrative Committee meeting. • Mr. Tucker said they had discussed the letter from Mr. Hansco~mb for a bridge to be built across the Rogue River at Gold Rey Dam. The committee recommended two letters be sent: 1. A letter to the County Court requesting their views and - reasons for not taking action on the matter. 2. A letter to Mr. Hanscomb requesting the population of area to be benefitted by the bridge if it is built. Discussion on sign ordinance, The Planning Commission had recommended - the high rise signsl~be allowed in the CT Zone. The Administrative Committee said. they felt this type of sign should be restricted or limited to a specific area. Problems might arise in•the future that could not be handled with the proposed recommendation. They felt there ® should be more time to study the ordinance. P-i ~ Discussion on whether to submit charter to the people again in November. ~ A second Citizen's group is being formed to promote the new proposed V charter. It has not been formed yet. No action to be taken at this U time. Bob Marasco said he felt the charter was not rejected in entirety. Only parts of it. He had talked to some of the people and some of the questions were on qualifications of elected officials, being a resident, Mayor's veto, and keeping of a journal. Mayor Bartley said the people could have come to the Council meeting when a Public Hearing was held and they would have been glad to answer all of the questions. , Harold. Reed asked about compensation for elected officials. Mayor Bartley.-said the Budget this year contained compensation for elected official's, the Mayor and the councilmen. Mr. Reed then asked about liability requirements of the city. Attorney Mansfield explained. Fire Committee report was not available, since B. Mushaney was out of town nn vacation. D.D. Turner, Fire Chief, requested the city adopt the Fire Code. He said same of the things in .the code would not be used at •this time, but would be necessary as the city grows. He read an article from the paper which stated that aFire Chief many be sued if they ,allow a fire hazard to exist without requiring it to be corrected. Motion Tucker, second Ayres to transfer $1,600,00 from-the contingency fund to the Street fund for street construction. Motion carried. Mr. Mason reported to the council that a chebk had been received from Farmers Ins. for $801.00 for damage done to the Police Car by Robert Howe. With the trade-in and this check, the balance due to Weiler Olds. would be $867.64 for the new Police Car. Motion•Tonn, second Hill to pay the balance of $867,64 for the Police car from the contingency fund. Motion carried. Motion Tucker, seoond Holbrook to pay the bills as audited. Motion .carried. 4:4 Mr. Mason presented forms to the council for applications to conform with the new Zoning Ordinance. Attorney Mansfield was instructed to • check and see if they were suitable. Motion Ayres, second Holbrook to approve the forms sub3ect to the opinion of the attorney. Motion carried. Mr. Turner explained to the council that he had appointed Mr. Allan Higinbotham as temporary Asst. Fire Chief. Mr. Turner said the Volunteer Fire Department had been making an investigation intotthe shortage of approximately $1,600.00 of the organization's funds. As soon as more information is available, the will know what to do about the matter. Attorney Mansfield informed the council that he recommended civil and criminal proceedures. They have no other alternative, regardless of the feeling they have for anyone involved. Discussion on whether the funds were-city or the Volunteer Fire - Departmeat's. Since the city pays the Volunteer Firemen each month, and the money goes into their own account to be spent as they wish, the Department felt it was their own money and should be investigated by them. Mayor Bartley requested the councilmen to meet with the Fire Department and get more information. Then at the next meeting of the council, they can make a decision. War.
