Roll call found: Present; Ayres, Hill, Holbrook, .Mushaney, Tone, Tucker. Absent; none. Also present; Mason, Tate,Mansfield. Motion Mushaney, second Tucker to approve the minutes of the previous meeting as mailed to each councilman. Motion carried. Planning Commission minutes were discussed. Request of Mr. and Mrs. Sparks and Douglas Ness and Bryson LaCasse to vacate the alley between their properties on North First Street. School District request of Zone Change so that they might build a bus repair garage and storage on their property at the SW corner of Ash Street and S. Fourth Street. Nate Grisham request for permission for Home Occupation-T.V. Repair on property formerly called Bun and Pun at the SE corner of S. Fourth Street and Bush Street. Discussion of fence ordinance and problems of determining regulations for corner lots, etc. Difference in permit fees as stated in fence ordinance and building code ordinance. Motion Ayres, second Hill to have the attorney redraft the fence ordinance and submit sketches to explain permits for corner lots. Sketches to be made a part of the ordinance. Motion carried. Discussion of fence being built by R. DeArmond. Motion Mushaney, second .Ayres to have the street committee inspect the fence site, and make a report to the council for a decision at a special meeting. Motion carried. Public Hearing on proposed Charter, which is to be submitted to the people at the Primary Election: Donald E. Faber said he was representing himself. He wanted some answers on certain parts of the charter. 1. Does the council consider our present charter a "Grand Dad" charter? 2. Are we still "Home Rule" under the proposed charter? Will our system of government be similar to Ashland's? 3. PJill we lose our 15 mill continuing levy? 4. What will happen to our tax base? Attorney Mansfield said the city would retain all levies and tax base. Councilman Tucker explained that Sec. 41 would answer the question. He said basicly, the city mould operate as it does now, with the city Administrator. ~, ~J 1 `!,~ r, C{~ .': ~, Mr. Faber asked if the citizen would lose any power. He said most. people like the old charter. They would like to continue to elect the City Treasurer and City Recorder. The people should not lose the right to vote for their city officials. The people need to vote for qualified officials. Also, he felt the Niayor should not lose his veto. Councilman Holbrook asked Mr. Faber if he felt we needed qualified officials and people who would stay longer than two years. Mr. Faber said there had only been about three City Treasurers and the other officials had done a good job. Councilman Hill asked Mr. Faber if he felt a City. Administrator could do a fair job without pressures from outside. P~'r. HIll said he did not agree with a City Administrator having to please all tihe politicians. P°Sr. Faber said he did not want to argue with Councilman Hill. But he had seen this type of government, and did not feel it was the best. Attorney Mansfield said the City Administrator would have only the power given him by the council. C.A. is not policy maker. Mayor and .,council will make the policy. Mr. Faber said he did not like the Mayor losing his veto power. The Mayor only serves two years, and if the people are not satisfied, they can vote him out. With the C.A. type of government, it is hard to get to talk with the Mayor. Everything has to go through the office ,of the C.A. Mr. Faber said that was all he had to say. He thanked the council for listening to him. . Arden Pinkham then questioned the Mayor losing his veto power. Would this charter not destroy the Mayor's power? Will he merely beagc£:~zlg as another councilman? Councilman Tucker explained that the new charter providds that the Mayor can defer from signing an ordinance for three day. A 2/3 .vote is still required. by the council before the ordinance is passed. Mr. Pinkham said the information sent out said the old charter was cumbersome, yet parts of the old charter had been retained in the new proposed one. And the new charter is confusing. Why could't the old charter be amenddd to delete those things not wanted and add others. The year after the 15 mill continuing levy was voted, the State passed a .law that there could be no~~continuing levies. Mr. Pinkham felt there was no reason to leave any doubt in the new charter about the continuing levies now in effect. Mr. Mansfield explained that according tb the proposed charter, the Ch. X; Sec. 41, explained that all serial levies and continuing levies shall not be rendered invalid. ~~ Harold Reed asked the council several questions concerning the proposed charter. He did not understand the system of wards and electing council- men at large, Also, the proposed charter does_not say that a person to qualify for office must be a freeholder. Mayor Bartley explained that the system of wards is the same as now. And that he felt the qualifications for public officers should include being a freeholder. Mr. Reed questioned. the section referring to the council being the final judge of the qualifications of elected officials. - Attorney Mansfield exp~.ained this was in all charters, and was a post-election proceedure. Mr. Reed asked what the Mayor's duties would be if his veto power was taken away. Nfayor Bartley explained that he had to set the order of business of the meetings and perform other duties. C.L. Perkins told~the council he felt the old charter was good enough and the city did not need a new one. James Fowler said he felt the city needed a new charter. He felt the C.A. should be appointed and have to answer to the council. He also said the charter should contain some regulations for burning within the city. - Mayor Bartley asked each councilman if they had anything more to say on the proposed charter. They all said the had nothing more, except Councilman Ayres. He said if the deletion of the Mayors veto created arty static with the people, it could be put back into the charter. Mayor Bartley said the veto power was of no value as far as he wes concerned. He then asked the people present if they had any more questions. D.D. Turner, Sr., Fire Chief, told the council that when he first came to Central Point, it was a small town. We cannot run it like a small town now, because we have to run it like a city, And this requires us to have a qualified city administrator. If we elect a city recorder that the council cannot control, we will have problems. Hessaid be thought the city council and Mayor were the finest and he thanked them each personally. Harold Reed presented~an article from the local newspaper concerning a letter written by a man who had to obtain a city business license. Mr. Reed asked if it was true that the driver of a truck delivering in C.P, had to obtain a license. The council explained that only the company had to obtain a license. This was common practice in all cities. Bryce Townley, city engineer, reported on his sewer system study as requested by the council. He presented two plans. He said he felt ii 1 i ~? t t the city could install their own system without going along with Medford or the Bear Creek Valley San. Auth. And it would be cheaper. His plans included storm drain system, treatment plant and lagoon holding system. Alternate Plan A would cost $501,600.00 Atlernate Plan B would cost 588,000.00 NIr. Mason reported that he had written to, Dr. Roberts concerning ., cleaning up his property located at S. Fourth Street and Alder Street. This property formerly belonged to the Community Bible Church. and had noti~been cleaned up since the building burned. Councilman Tucker said he knew they planned to clean it up. Mr. mason was instructed to contact Dr. Roberts personally and see if it could be done soon. O Mr. Mason recommended the council update the present drive-way t""~ ordinance and incorporate diagrams into it. C~ U Motion Mushaney, second Ayres to approve recommendation of the ~ Police Committee to award bid for new police aar to Weiler ©lds. Mr. Mason asked if the street committee could check the two large trees at 435 Manzanita Street. They are breaking ,the sidewalk and need to be removed. Also they should check N. Front Street at the most northerly end near the C.P. Plywood. A complaint had been received, and the street committee should check the situation. Front Street dead ends into private property. Proposed sign ordinance rei~erred to Administrative committee to study heighth regulations. Correspondence: Letter from Don Hanscomb requesting city council write a letter to County Court to request a bridge be built across the Rogue River at Gold Rey Dam. Motin Ayres, to write letter. No second. _ It was moved and seconded to refer to the Administrative committee for their recommendation. .Motion carried. Mr. arr3. Mrs. Walter Carr requested permission to park a house trailer on their property at 1662 Scenic Ave. for their daughter and children to live in while she has time to settle some legal matters. Motion Niushaney, second Holbrook to instruct the Building Inspector to issue the temporary permit for 30 days as per the Zoning Ordinance. Motion carried. Letter from Medford Water Commission regarding new rates to go into effect July 1, 1968. Referred to the city attorney to study and check with the City of Medford and Certt~ral Point agreement for the purchase of water. Mr, Mason reported that he had received a telephone call from the P.E. R.S. representative saying he would meet with the city employees Monday, May 20, 1968 at 7:30 p.m. He will explain the retirement program. .51`?~~' ~:,~ Discussion on the property owned by the city on Old AZilitary Rd. Bob Lull said it would cost too much to level the property. And there was not very much granite left in it. It was moved and seconded to instruct Mr. Mason to contact Bob Lull and ask him to clean up the property and not take any more granite out. Motion carried. It had been suggested in the past that this property would be a good site of a future water reservoir. Discussion on the damage done by Graff and James to Comet Ave. during the construction of the new Scenic Ave. Junior High.School District 6 has held back payment to Graff and James. .. Discussion on Clean-up day, May 18. Next Budget Meeting set for Pfonday, May _ 13, at 7:00 p.m. Attorney ~ansfield reported that the Citizens Committee had filed their second Recall Petition on Friday, May 3. He had dedlared it void for the following reasons: 1. the reasons; malfeasance, non- feasance, and misfeasance are not specific enough. 2. the petitions were addressed jointly instead of separately. In his opinion, each has to be submitted singularly. 3. the petition could not be split up. At~tornery Mansfield said in the city s interest it would be wells:.to go ahead with the election, but he felt it would be declared void. Attorney Mansfield said he felt it would be a misuse of the attorney or employee to give petitioners advice. He recommended Mr. Mason, after he received the letter from the attorney, to return the petitions to the filers. Attorney Mansfield was instructed to issue a press release on the above. Mayor Bartley a inted Charles Sibley, Chief of Police. i4otion ?~~, second Ayres to approve the appointment. Roll call vote. All in Favor. Motion carried. Mayor Bartley s~~:d prestige in the F'dlice Dept. seems to center on the badge number. Mr. Sibley said he would like to get new badges and give the old one to Reserves when they get some. It was moved and seconded to instruct the City Recorder to notify the Planning Commission they would have to start paying water and sewer bills. Report Police Committee meeting.
