ORDINANCE NO. ~ ~'~~~~ AN ORDINANCE VACATING CERTAIN ALLEYS LOCATED WITHIN AMY AND HARBAUGH'S ADDITION, A SUBDIVISION PLATTED IN 1889, LOCATED GENERALLY NORTH OF WEST PINE, EAST OF HASKELL STREET, SOUTH OF TAYLOR STREET AND WEST OF THE SOUTHERN PACIFIC RAILROAD IN CENTRAL POINT, OREGON WHEREAS, Steve Rietmann has requested the vacation of certain alleys described in Section 1 of this document and illustrated in Exhibit A, which is attached hereto and made part of this document, and pursuant to said request, and in accordance with ORS 271.130, the City Council initiated vacation proceedings on its own motion via Resolution No. 584, and WHEREAS, on May 7, 1991, the Planning Commission reviewed the proposed vacation and via Resolution No. 220 recommended approval of the same, and, following requisite notice of said proposed vacation by publication and posting, certifications of which appear in the record hereof, and the Council having on June 20, 1991, held a public hearing on the proposed vacation, and WHEREAS, the Council finding that owners of a majority of the area affected, computed pursuant to ORS 271.080, have not objected in writing to said vacation, the Council further finding that said vacation will not substantially affect the market value of said property, and that said area is not necessary or a useful part of the public street and alley system of the City of Central Point, and WHEREAS, the City Administrator, being the City recording officer, has filed in the official City records a certificate that all liens and all taxes have been paid on the lands to be vacated, now, therefore THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1. That the alleyways within the subdivision known as Amy and Harbaugh's Addition described as follows: Those certain alleys or portions thereof within Block 2 and Block 7 of Amy and Harbaugh's Addition to the City of Central Point in Jackson County, Oregon, more particularly described as follows: That alley lying northeast of and adjoining the northeast boundary of Lot 2 in Block 7, from the most northerly corner of said Lot 2 to the most easterly corner of said Lot 2; Also those entire alleys in Block 2, lying between Lots 7, 8, 9 and Lots 4, 5 and 6 and between Lots 1, 2, 3 and Lots 4 and 9. ORDINANCE NO. 1660 AMYALLEY.ORD (061091) Is hereby vacated pursuant to ORS 271.130 and the ownership of said land within said described alley in the City of Central Point hereby vacated shall become vested as provided by law. Section 2. The City Administrator is directed to file a recorded copy of the within ordinance with the Jackson County Clerk, the Jackson County Assessor and Jackson County Surveyor, together with any maps, plats or other records required or provided for by law.
