AN ORDINANCE ADDING TO THE CENTRAL POINT MUNICIPAL CODE
A NE4d CHAPTER I7.37 RELATING TO THE C-2(M} ZONE
WHEREAS, the Planning Commission and the City Council have
resolved, pursuant to Central Point Municipal Code Chapter: ],7.88,
to initiate a new land use regulati-on i.n the zo~.ring text so as to
allow residential uses i.n the C-2(M) zone under certain
circumstances;
Now, therefore,
THE PEOPLE OF THE CITY OF CENTRAI~ POINT, OREGON, DO ORDP.IN
AS FOLLOWS:
Section 1. The within ckrange to the zoxxing tent ronsti.tutes
a new land use regulation, which i.s li.mited i.n scope, and {:he
adoption thereof constitutes a legislative action. The Council.
hereby determines that the State Land tJse Goals do not apply i:o
this new regulation and the 45-day notice to the Department. of
Land Conservation and Development otherwise required by ORS
197.610(1) is not applicable.
Section 2. In. adopting this ne:w land use regulation, the
Council makes the following fi.ndin.gs:
A. The C-2(M) zone was established to support. effective and
efficient medical office development around what was then Crater
Hospital. Crater Hospital is now gone, its premises occupied by
Serenity Lane, a chemical-dependency treatment center, which does
not require the same level of medical support.
B. As a result of the loss of Crater Hospital, there has
been less intensive use of medical offices in the C-2(M) zone.
The demand for medical office property has declined, and the area
remains largely residential.
C. The zoning change herein i.s not inconsistent with the
City's Comprehensive Land Use Plan because it does not hinder the
development of medical. offices, but merely adds residential use
as a permitted use under certain circumstances.
D. The zoning change herein will apply uniformly throughout.
the C-2(M) zone, and new-construction residential development
will continue to be prohibited.

E. The effect cf the zoning change, herein will. be to allow
property owners in the C-2(M) zone whose premises were once i.xsed
for residential purposes, but were later converted to medical
offices, to restore those premises to residential pi.xrposes. This
will add flex:i.ba.lity and will be a benefit to the area.
Section 3. There is hereby added to tlae Central Poa.ni:
Municipal Code a new chapter. 17.37, to read as Poll ours:

~(M). COMMERCIAL-MEDICAL DISTR~T
17.37.010 Permitted Uses. Structw:es within the C-2(M) zone
may be used for
A. Professional medical offices; or
II. Residential purposes, but. only if the structure was
initially built for use as a single family, duplex or multiple
family residence. If a structure oras initially built for use as
a residence, the fact that it was subsequently used as a
professi.onaJ, medical office shall be no bar to reverting back to
the original residential use.
Section 4. Pursuant to ORS 197.615, the City Administrator
is directed to mail or otherwise submit, not later than 5 working
days from the date of adoption of. this or_di.nance, to the
Department of Land Conservation and Development, a copy of this
ordinance, including the findings adopted herein.
