PlanningCommission minutes were read and discussed. ~' Motion made and seconded the bill be approved and the Recorder be ~instructed'to draw warrants on the proper funds to pay them. F , • ~ ,. . ~ ~ kttorney Mansfield read Ordinance No. 900, this being an ordinance.. - ;relating.. to .the use of water of the City of Central Point, and arriending .~ Section 3-2_.11, Code of Central Point, 1967. Moton~mad;e..and seconded that Ordinance No.~ 900 be adopted. Roll call vote.. All in favor. Motion carried. Ordinance No. 900` declared duly adopted. ~- Mr ~.~Perkins,, 532 Maple Street, appeared before the council again to ~.,gizestion"some of the construction on Maple .Street. He asked why the_ council felt. it was necessary to tear~out the intersections-that were "already installed. Mr. Mason explained that the council was trying to divert the water drainage from the street into the storm sewer instead of the sewer lines. Mr. Perkins. then discussed the dog control in the city. He said he had ` circulated"the petition to get .dog control in the city, and the council or rio~one else had even thanked him for doing it. ~Mr. TYfomas~Whittle;appeared before the council to discuss the cost and charges-made to him for water meters on Bigham Drive. He said in 1954 he had paid-the city for meters, in advance, for all the lots in the Oak Knoll ,Sub. on Bigham Dr. Now, whenever, he builds"on one". of the lots, the city charges him again for the meter. He had="checked with xrden Pinkham, and Mr. Pinkham, former city recorder, did not. recall that Mr. Whittle had paid him. Mr. Pinkham told Mr. ~rJhittle that they did not keep records in those days on such things. Mr. Mason, City Recorder, then !explained to the council that he .could not find anywhere-in the records where Mr. Whittle had paid for all the meters in advance for Bigham Dr. The City did not have the space~to. stockpile meters for,indivi.duals. xnd the cost increase in meters, would not justify holding them. for 10 years. Mr. Mason said he had . advised Mr. Whittle several times that if he had a receipt, the matter " could be taken under consideration. The records were produced to shpw that Mr. Whittle had, in fact,:.paid: for several meters on Bigham Drive, duu~ing 1957 and 1958 when he took out a building permit for the house. Mr. Whittle then said~he did. riot remember having paid for them. He said he had a check in his canceled checkes that showed he had~paid the City of Central Point $300:00,'_ but he thought it was for mete"rs. However, he did not have the`~check with him. It may have been for a lot he purchased from the city. Discussion on lease with Niedermeyers oh land,purchased from them. ' Tabled until arrival of Niedermeyers. Discussion--N. 9th Street-stop signs be~installed at the SE cornier '~ ' of 9th and Laurel Streets. Councilman Hill said this intersection- was a hazard during school hours, because of the large number-of . :students who walk home that way. If illegal connect has been made, he is in viol:atiori~.~`, Mr. and Mrs. Dale Niedermeyer came to the council as per requested to discuss the lease agreement. Mr. Miedermeyer said he would pay operational costs and city pay `for taxes, water rights for irrigation,. and assessment". Mr. Niedermeyer would market the crop, store~it if ' necessary until marketed. "Bid opening to be at a=special meeting, September 19, 1967. ~'xttorney~Mansfield read Resolution No, 141,. this being a:.resolution ~-adopting.polcy for a:~new sewer facility in Bear Creek Valley and. ,,, :contracting;`with Bear Creek Valley Sanitary authority for, service ~ along with other cities. Mr. Mansfield stated this was a non-commital resolution as far as the city was concerned. Motion made and seconded to adopt Resolution No. 141. Roll call vote. Ct~ .. 0~ All in `.favor. He recommended the city accept the .improvement on North First ~Street.~if they were completed satisfactorily. It was moved and seconded the 9mpravements on North First Street be accepted.. Tt was moved and seconded to authorize attorney.Mansfield to file °the "answer" to the alleged complaint of Grigsbys vs City of Central '~ Point. on.
