ORDINANCE NO. /~7!
AN ORDINANCE WITHDRAWING TWO PARCELS OF PROPERTY
FROM BEAR CREEK VALLEY SANITARY AUTHORITY AND
FROM JACKSON COUNTY FIRE PROTECTION DISTRICT NO. 3,
AND ESTABLISHING CITY ZONING FOR EACH PARCEL
Recitals
1. The City of Central Point has previously annexed two
parcels of property, which are described below.
2. The City has also received authority from the Jackson
County Board of Commissioners, by virtue of orders number 108-94
and 109-94, to withdraw the parcels from Bear Creek Valley
Sanitary Authority, as required by ORS 450.987.
3. On November 15. 1994 the Central Point Planning
Commission, pursuant to CPMC 1.24.020, conducted a public hearing
to consider whether withdrawal of the parcels would be in the
best interests of the City.
4. On November 17, 1994, the Central Point City Council
conducted a duly-advertised public hearing, pursuant to ORS
222.524, to consider the withdrawals.
Now, therefore;
THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN
AS FOLLOWS:
Section 1. City Council hereby determines and finds that
withdrawal of the properties described herein is in the best
interests of the City.
Section 2. The following-described parcels of property in
the City of Central Point are hereby withdrawn from Bear Creek
Valley Sanitary Authority and from Jackson County Fire Protection
District No. 3:

commencing at a 3^ brass capped monument located at the
Northwest coiner of SNOWY BDTTE ORCHARDS in seotion 10, Township 37
south, Range 2 west oP the Willamette Meridian in Jackson County,
Oregon, according to the Official Plat thereof, now of record)
thence EAST 1121.8 teat; thence SOVTH 887.8 fast to a 3/4" x a6^
iron pin monument) thence EAST 616.0 Peet, more or less, to the
center line of Chicory Lane for the POINT OF aEOIHHiNQ; thence WEST
118.0 feat; thence SOUTH 70.00 font; thnnca EAST 118.0 teat to the
aforementioned center line oP~Chicory Lane; thonca NORTH along said
centerline 70.00 feet to the Point oP Heginhing.

Cawencing at a point on tho oast line of Donation Land Claim No. 56,
Tounahip 37 South, Range 2 West of the Willamette Mo ridtan to Jackson
County, Oregon, said point being South 0'38' west, 173D.44 feet from the
northwest corner of said Claim, and being the northwest corner of tract
described in Volume 197, page 548, of the Deed Records of Jackson County,
Oregon, thence South 89'42' East, along the north line of said tract, and
the north line of tract described in Volume 404 page 217, said Deed
Records, 450.00 feet, to the northeast corner of said latter described
tract, thence South 0'18' West, along the oast line of said tract, 395.84
feet, to the true point of beginning; thence continuing South 0'18' West,
along said east line 161.00 feet, to a 3/4" iron pipe at the southeast
cornet thereof; thence wost 323.00 feet; thence North 143.00 feet: thence
West, 127.00 feet; thence North, 20.00 feet, to the southwest corner of
traot described Sn Volume 415 page 474, said Deed Records; thence Eest,
along the south line of said tract, 209.69 feet, to the southwest corner
of tract described Sn Volume 584 Dege 531, said Deed Records: thence
South 89'42' East, along the south line of seld tract 241.29 feat, to the
true point of beginning.
Section 3. Pursuant to ORS 222.520,

residential single-family district; and the Freeman Road parcel
is hereby zoned R-3, residential multiple-family district.
Section 5. The City Administrator is directed to forthwith
file certified copies of the within ordinance with the Jackson
County Assessor, the Jackson County Department of Public Works,
and with the governing bodies of Bear Creek Valley Sanitary
Authority and Jackson County Fire Protection District No. 3.
