AN ORDINANCE AMENDING THE CITY'S GENERAL PENALTY AND OTHER CODE PROVISIONS PROVIDING FOR JAIL SENTENCES THE PEOPLE OF THE CITY OF CENTRAL POINT, OREGON, DO ORDAIN AS FOLLOWS: Section 1. Central Point Municipal Code Section 1.16.010 is hereby amended to read as follows: 1.16.010 Designated. Except in cases where a different punishment is prescribed by ordinance, any person violating any of the provisions or failing to comply with any of the mandatory requirements of the ordinances of the City shall be punished by a fine of not more than five hundred dollars. Each such person is guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of Central Point is committed, continued or permitted by any such person. Section 2. Central Point Municipal Code Chapter 1.18, pertaining to imprisonment in the county jail, is hereby deleted in its entirety. Section 3. Central Point Municipal Code Chapter 2.32, relating to Municipal Court jury trials, is hereby deleted in its entirety. Section 4. Central Point Municipal Code Section 5.04.110 is hereby amended to read as follows: 5.04.110 Penalties. A. Any person violating any provision of this Chapter shall, upon conviction thereof, be subject to punishment under the general penalty. B. Every full business day during which any business activity continues to be conducted in violation of this Chapter is a separate offense. C. No license shall be issued to any person under this Chapter if such person has, previous to making application therefor, conducted a business within the City while the ordinance codified herein was in effect, without a current, valid license issued hereunder, unless such person pays an additional amount equal to the license fee for the period during which such business was thus conducted. D. The remedy specified in subsections A and C of this section shall not be deemed exclusive and, at the option of the City, amounts due and payable hereunder by way of business license fees may be collected from the owner or owners of the business involved by action of law in any court of competent jurisdiction in the state. 1 - ORDINANCE NO. 171b (011395) Section 5. Central Point Municipal Code Section 5.12.040 is hereby amended to read as follows: 5.12.040 State License Required - Penalties. A. No license shall be issued to any person, firm or corporation to engage in the business of installing wires or equipment within the City to convey electric current or installing apparatus to be operated by such current until they have secured from the state the licenses and permits required by the state and, before any license is issued by the City, the applicant for such license shall present satisfactory proof to the recorder of the City that the applicant has complied with and obtained such licenses and permits from the state and, upon payment to the City of the license fee provided herein, the City shall issue its receipt therefor, which receipt shall constitute the license of the City for such business for the term for which the tax thereon shall be paid. B. Any person, firm, or corporation violating any of the provisions of this Chapter shall be subject to the general penalty. Section 6. Central Point Municipal Code Section 5.16.040 is hereby amended to read as follows: 15.16.040 License - Issuance - Penalties. Upon presenting satisfactory proof to the City that the applicant has complied with Section 15.16.030 and is therefore eligible to apply for a license from the City, and upon payment of the license fee provided herein in this Chapter, the City shall issue a receipt therefor, which receipt shall constitute the license of the City for such business for the term for which the tax thereon shall be paid. Any person, firm or corporation violating any of the provisions of this Chapter shall be subject to punishment under the general penalty. Section 7. Central Point Municipal Code Section 5.20.110 is hereby amended to read as follows: 5.20.110 Penalty. Any person violating any of the provisions of this Chapter shall upon conviction thereof be punished by the general penalty. Section 8. Central Point Municipal Code Section 5.28.130 is hereby amended to read as follows: 5.28.130 Penalty. Any person violating any of the provisions of this Chapter shall upon conviction thereof be punished under the general penalty ordinance. Each full business day during which a person conducts an unlicensed close-out sale, 2 - ORDINANCE NO. 171 (011395) or conducts the same after being served with a stop order under Section 5.28.090 and before the City Council has acted thereon, or conducts a close-out sale after his license has been revoked, is a separate offense for the purposes of this Section. Section 9. Central Point Municipal Code Section 6.04.030 is hereby amended to read as follows: 6.04.030 Penaltv• Violation of any provision of this Chapter shall be punishable upon conviction under the general penalty ordinance. Section 10. Central Point Municipal Code Section 8.04.150 is hereby amended to read as follows: 8.04.150 Penalty. Any person convicted of maintaining any nuisance as defined or prohibited in this Chapter shall be subject to punishment under the general penalty ordinance. Each day of such violation constitutes a new offense. Section 11. Central Point Municipal Code Section 8.08.040 is hereby amended to read as follows: 8.08.040 Penaltv. Violation of the terms of this Chapter shall be punishable upon conviction under the general penalty ordinance. Section 12. Central Point Municipal Code Section 8.24.080 is hereby amended to read as follows: 8.24.080 Penalties for Noncompliance. No structure or land shall hereafter be constructed, located, extended, converted or altered without full compliance with the terms of this Chapter and other applicable regulations. Any person who violates this Chapter or fails to comply with any of its requirements shall upon conviction thereof be subject to the general penalty, and in addition shall pay all costs and expenses involved with the case. Nothing contained in this Chapter shall prevent City from taking such other lawful action as is necessary to prevent or remedy any violation. Section 13. Central Point Municipal Code Section 9.52.040 is hereby amended to read as follows: 9.52.040 Penalty. Any person violating any of the provisions of this Chapter shall upon conviction be subject to punishment under the general penalty ordinance. 3 - ORDINANCE NO. 171(n (011395) Section 14. Central Point Municipal Code Section 9.78.020 is hereby amended to read as follows: 9.78.020 Penalty. Violation of the provisions of this Chapter shall be punishable upon conviction under the general penalty ordinance of the City. Section 15. Central Point Municipal Code Section 10.20.030 is hereby amended to read as follows: 10.20.030 Penalty. Violations of any of the provisions of this Chapter shall, upon conviction, be punishable under the general penalty ordinance. Section 16. Central Point Municipal Code Section 12.08.070 is hereby amended to read as follows: 12.08.070 Penalties. Any person violating any of the provisions of this Chapter shall upon conviction be subject to punishment under the general penalty ordinance.
