HomeMy WebLinkAboutOrdinance 1626ORDINANCE NO. 1626 AN ORDINANCE VACATING A PORTION OF ALDER STREET BETWEEN HASKELL STREET AND AMY STREET WITHIN THE CITY WHEREAS, Robert Ashenbrener and Ashenbrener Lumber Company have requested the vacation of a portion of Alder Street between Haskell Street and Amy Street within the City, and pursuant to said request, the City Council initiated vacation proceedings on its own motion pursuant to ORS 271.130, and WHEREAS, the Planning Commission of the City of Central Point, by Resolution No. 175 dated September 15, 1989, has recommended the vacation of said portion of Alder Street, and following requisite notice of said proposed vacation by publication and posting, certifications of which appear in the record hereof, and the Council having on September 22, 1989 held a public hearing upon said proposed vacation, and WHEREAS, the Council finding that owners of a majority of the area affected, computed pursuant to ORS 271.080, have not objected in writing to said vacation, and the Council further finding that said vacation will not substantially affect the market value of said property, and WHEREAS, the City Administrator, being the City recording officer, has filed in the official City records a certificate that all City liens and all taxes have been paid on the lands to be vacated, now, therefore, THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS ORDINANCE NO. 1626 _ 1 (ALDERVAC.ORD - 092689) FOLLOWS: Section 1. That portion of Alder Street between Haskell Street and Amy Street, a more particular description o£ which is attached hereto, marked Exhibit A, and which is by this reference incorporated into the within ordinance, is hereby vacated pursuant to ORS 271.130. Section 2. This vacation being upon the City Council's motion, pursuant to ORS 271.130, and based upon the agreement of the requesting party to participate in the cost of storm drain improvements in the area in connection with the within proceedings, costs of the within vacation proceedings shall not be charged to said requesting party. Section 3. The City Administrator is directed to file a certified copy of the within ordinance with the Jackson County Clerk, Jackson County Assessor, and Jackson County Surveyor, together with any maps, plats, or other records required or provided for by law.
