AN ORDINANCE PROCLAIMING THE ANNEXATION TO THE
CITY OF A CONTIGUOUS PARCEL OF PROPERTY
DESCRIBED HEREIN PURSUANT TO ORS 222.125,
WITHDRAWING THE SAME FROM SPECIAL DISTRICTS
AND ESTABLISHING THE ZONING DISTRICTS THEREFOR PURSUANT
TO THE CITY'S COMPREHENSIVE PLAN
WHEREAS, ORS 222.125 provides for the annexation of property
contiguous to the City without an election and without a public
hearing when all of the owners of land in the territory to be
annexed and not less than 50 percent of the electors residing
therein consent in writing thereto, and,
WHEREAS, all of the owners of land and more than 50 percent
of the electors residing within the territory described
hereinafter proposed to be annexed have consented in writing to
the annexation thereof to the City of Central Point, Oregon, and
said written consents have been received by the City Council and
are on file with the City, and,
WHEREAS, following a public hearing on the issue of
withdrawal from special districts, notice of which public hearing
was duly and regularly advertised and posted, the City Council
finds and determines that withdrawal of said territory from
Jackson Fire Protection District No. 3 and Bear Creek Valley
Sanitary Authority upon annexation is in the best interests of
the City, now, therefore,

FOLLOWS:

Section 1. The parcel of real property described in Exhibit
A, attached hereto and by this reference incorporated into the
within ordinance, is hereby proclaimed to be annexed to the City
of Central Point, Oregon pursuant to ORS 222.125.
Section 2. The above described property annexed to the City
is hereby withdrawn from Jackson County Fire Protection District
No. 3 and Bear Creek Valley Sanitary Authority, and pursuant to
ORS 222.520, the City of Central Point hereby assumes and agrees
to pay the amount of taxes which otherwise would be extended each
year against the property hereby withdrawn for the retirement of
bonded debt, subject to the right of the City to obtain
reimbursement therefor from the owners of said property.
Section 3. The City Administrator is directed to forthwith
file certified copies of the within ordinance with the Jackson
County Assessor, the Jackson County Department of Public Works,
and with the governing bodies of Jackson County Fire Protection
District No. 3 and the Bear Creek Valley Sanitary Authority.
Section 4. The zone for the above described territory
annexed to the City is hereby established as follows:

Section 5. This ordinance being necessary for the immediate
preservation of the public peace, health and safety of the City
of Central Point, Oregon, and based upon the December 31, 1989
expiration of the ten year systems development charge waiver
established by the regional sewer rate committee, and the need to
conclude annexation proceedings in order to allow sewer
construction and connection within said time limit, second
reading is hereby waived and an emergency is hereby declared to
exist and this ordinance shall be in full force and effect
immediately upon its passage by the Council and approved by the
Mayor.
