AN ORDINANCE DECLARING THE COUNCIL'S INTENT TO ANNEX
A CONTIGUOUS PARCEL OF PROPERTY DESCRIBED HEREIN
PURSUANT TO ORS 222.125, AND TO WITHDRAW THE
SAME FROM SPECIAL DISTRICTS.
WHEREAS, ORS 222.125 provides for the annexation of property
contiguous to the City without an election and without a public
hearing when all of the owners of land in the territory to be
annexed and not less than 50 percent of the electors residing
therein consent in writing thereto, and,
WHEREAS, all of the owners of land and more than 50 percent
of the electors residing within the territory described
hereinafter proposed to be annexed have consented in writing to
the annexation thereof to the City of Central Point, Oregon, and
said written consents have been received by the City Council and
are on file with the City, and,
WHEREAS, it is the Council's intention to withdraw the
territory described herein from Jackson County Fire Protection
District No. 3 and the Bear Creek Valley Sanitary Authority
pursuant to ORS 222.520, and a public hearing is required by
statute on the issue of withdrawal, now, therefore,
THE PEOPLE OF THE CITY OF CENTRAL POINT DO HEREBY ORDAIN AS
FOLLOWS:
Section 1. Proceedings are hereby initiated for the

annexation to the City of Central Point the real property
described in Exhibit A, attached hereto, and by this reference
incorporated into the within ordinance.
Section 2. The date, time and place for the public hearing
on the question of withdrawal of the territory proposed to be
annexed shall be as follows:
Date• 21 September 1989
Time: 7:00 p.m. Pacific Daylight Time
Place: City Hall Council Chambers
Central Point, Oregon
Section 3. The City Administrator is directed to cause
notice of the foregoing hearing on the issue of withdrawal to be
published once each week for two successive weeks prior to the
date of the hearing in the Medford Mail Tribune, a newspaper of
general circulation within the City, with second publication to
be no less than twenty-four (24) hours prior to said hearing, and
to cause notices thereof to be posted in four public places
within the City for two successive weeks prior to the date of
hearing. The published and posted notices shall contain the
date, time and place of said hearing, the purpose thereof, and a
description of the property proposed to be withdrawn from said
special districts, and notification that all interested persons
may appear to be heard on the question of withdrawal.
Section 4. This ordinance being necessary for the immediate
preservation of the public peace, health and safety of the City

of Central Point, Oregon, and based upon the December 31, 1989
expiration of the ten year systems development charge waiver
established by the regional sewer rate committee, and the need to
conclude annexation proceedings in order to allow sewer
construction and connection within said time limit, second
reading is hereby waived and an emergency is hereby declared to
exist and this ordinance shall be in full force and effect
immediately upon its passage by the Council and approved by the
Mayor.

Commencing at the Southeast corner o£ Donation Land .
Claim No. 55, Township 37 South, Range 2 West of the
Willamette Meridian in Jackson County, Oregon; thence along
the South boundary of said claim, South 890 52' 30" West,
30.32 feet; thence to and along the Westerly right-of-way
line of Hamrick Road, South 00 52' 40" East, 460.09 feet to
the Northeast corner of tract described in Volume 513, Page
485 of the Deed Records of said County for the TRUE POINT OF
BEGINNING: thence continue along said road line,
South 00 52' 40" East, 773.96 feet to the Southeast corner of
tract described in Volume 236, Page 290 of said Deed Records;
thence along the South boundary of said tract,
South 890 96' 30" West, a more or less distance of 1906 feet
to the division line between the East and West halves of
