HomeMy WebLinkAboutOrdinance 1613ORDINANCE NO. 161.3 AN ORDINANCE REQUIRING BACKFLOW PREVENTION DEVICES AND PROVIDING FOR PERMITS AND TESTING TFIEREOF THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1. There is hereby added to the Municipal Code of the City of Central Point, Oregon, Chapter 13.20 which is to read as follows: Chapter 13.20 BACKFLOW PREVENTION DEVICES 13.20.010 Purpose. The purpose of this chapter is to protect the public potable water supply of the City by isolating within its customers' internal distribution systems or private water systems any contaminants or pollutants which could backflow or back-siphon into the public water supply system. 13.20.020 Definitions. As used in the within chapter, the following terms shall be defined as follows: A. "Backflow" shall mean the flow of water or other liquids, mixtures or substances into the distributing pipes of the public potable-domestic water supply system, from any source or sources other than the public potable-domestic water supply source of the City. B. "Back-siphonage" shall mean the flow of water or other liquids, mixtures or substances into the distributing pipes of the public potable-domestic water supply system from any source or sources other than the public potable-domestic water supply source of the City caused by the sudden reduction of pressure in the public potable-domestic water supply system. C. "Backflow prevention device" shall mean a device designed for and effectively capable of preventing backflow or back- siphonage. 13.20.030 Prohibitions. No water service connection to any premises shall be installed or maintained by the City unless the water supply is protected from backflow or back-siphonage by an approved backflow prevention device which: A. Is authorized by a permit issued hereunder, and B. Has been installed under the supervision of the Public Works Director of the City, and C. Complies in all respects with applicable State and City laws and regulations. ORDINANCE NO. 1613 - 1 (010589) D. Is of a type which has been approved by the Public Works Director for the specific application for which it is being installed. 13.20.040 Permit. The owner or person in lawful possession of any premises upon which a backflow prevention device is required by this ordinance shall, prior to the installation thereof and prior to water service connection to said premises, obtain a permit, to be known as a "backflow prevention device permit" from the office of the City Administrator. Said permit shall be in such form as shall be designated by the City Administrator, and may contain such terms or conditions as shall be deemed necessary by the City Administrator to achieve the purposes of this chapter. Said permit shall be issued on an annual basis, and the annual permit fee shall be the sum of $25.00. 13.20.050 Testing. All backflow prevention devices within the City shall be inspected and tested once each year or at more frequent intervals if, in the discretion of the Public YJorks Director, the installation carries with it an inordinate risk of backflow or back-siphonage. Inspection and testing shall be at the expense of the permittee and may be performed by the device manufacturer's representative, by the Public Works Department, or by a certified tester approved by the State Health Department. Backflow prevention devices found to be defective shall be repaired, overhauled or replaced at the expense of the permittee, and water service may be suspended pending such corrective action. Backflow prevention device testing fees shall be assessed by the City Administrator for each test taken in accordance with the following schedule: 5/8-3/4 inch meter $ 10.00 1 inch meter 15.00 1 1/2 inch meter 20.00 2 inch meter 30.00 3 inch meter 40.00 4 inch meter 55.00 Greater than 4 inch meter 100.00 Section 2. This ordinance being necessary for the immediate preservation of the public peace, health and safety of the City of Central Point, Oregon, based upon the requirements of Oregon Administrative Rules 333.61.070 that cross-connection control ordinances be enacted by municipalities, second reading is waived pursuant to Municipal Code Section 2.04.020, and an emergency is hereby declared to exist and this ordinance shall be in full ORDINANCE NO. 1613 _ 2 (010589) force and effect immediately upon its passage.
