HomeMy WebLinkAboutOrdinance 1609ORDINANCE NO. 1609 AN ORDINANCE DECLARING THE COUNCIL'S INTENTION TO CAUSE THE CONSTRUCTION OF CURBS, GUTTERS, SIDEWALKS, PAVING AND STORM DRAINS ON CI-TERRY STREET, NORTH NINTH STREET, AND LAUREL STREET WITIIIN THE CITY OI' CENTRAL POINT, OREGON, AND TENTATIVELY APPROVING PLANS THEREFOR, SETTING A PUBLIC HEARING TIIEREON AND PROVIDING FOR NOTICE TO PROPERTY OWNERS, AND DECLARING AN EMERGENCY WHEREAS, pursuant to Central Point Municipal Code Sections 11.04.024 and 11.04.030, plans, specifications and cost estimates have been prepared by the City Administrator for the proposed construction of curbs, gutters, sidewalks, paving, and storm drains on Cherry Street, North Ninth Street and Laurel Street within the City, said construction being proposed as being in the best interests of the City, and WHEREAS, said plans, specifications and cost estimates having been presented to the Council, pursuant to Central Point Municipal Code Section 11.04.040, and the Council being of the opinion that construction and completion of said project would be in the best interest of the City, now, therefore, THE PEOPLE OF THE CITY OF CENTRAL POIIQT DO ORllAIN AS FOLLOWS: Section 1. The plans, specifications and cost estimates for the construction of curbs, gutters, sidewalks, paving and storm drains on Cherry Street, North Ninth Street and Laurel Street within the City, which plans, specifications and cost estimates are attached hereto, marked Exhibit "A", and by this reference incorporated into the within ordinance, are hereby approved and adopted. ORDINANCE NO. 1609 - 1 (111588) Section 2. The City Council of the City of Central Point, Oregon, hereby declares its intention to cause the construction of said project in accordance with said plans and specifications, and to assess each lot, or portion thereof, adjacent to and benefitted by such irprovements, its proportionate share of the cost thereof as provided by statute, charter and ordinance. Section 3. The 15th day of December, 1988, at 7:00 p.m., in the Council Chambers, City Hail, Central Point, Oregon, is hereby set as the date, time and place for a public hearing to consider protests against said improvements and the assessment thereof, by adjacent property owners or other persons. Section 4. The City Administrator is hereby directed to serve notice of said hearing upon the aforesaid property owners by publishing a notice of hearing once in the Medford Mail Tribune, a newspaper of general circulation within the City of Central Point, Oregon, at least ten (10) days prior to the date of said hearing and by ordinary mail to the address of each of the adjacent property owners proposed to be assessed hereunder, at least ten (10) days prior to the date of the hearing set forth hereinabove. Said notices shall specify the date, time and place of the hearing, the purpose of the hearing, and the fact that the Council will hear and consider objections or remonstrances to the proposed improvements. Section 5. This ordinance being necessary for the immediate preservation of the public peace, health and safety of the City of Central Point, Oregon, in order that said improvements, if ORDINANCE NO. 1609 - 2 (111588) approved, may be constructed during favorable weather conditions prevailing during the summer months of 1989, an emergency is hereby declared to exist and this ordinance shall be full force and effect immediately upon its passage.
