HomeMy WebLinkAboutOrdinance 1604ORDINANCE NO.dtin[ AN ORDINANCE I?ROCLAIM]:NG THE ANNEXA'PION TO THE CITY OF CENTRAL POINT CONT:LGUOUS PARCELS OF PROPERTY I:N THE COUNTX SUBDIVISIONS KNOWN AS HOMESTEAD ACRES AND HOMESTEAD ACRES EXTENSION N0. 2, MORE PAR'P.iCUhARLX DESCRIBED HEREIN AND WITHDRAWING THE SAME FROM JACKSON COUNTY FIRE DISTRICT N0. 3 AND BEAR CREEK VAI;LEY SANITARY AUTHORITY, ESTABLISHING THIi zONING DISTRICTS THEREFORE AND DECLARING AND EMERGENCY WHEREAS, the City Council has heretofore by Ordinance No. 1602 declared its intention to annex unincorporated territory contiguous to the city without an election pursuant to ORS 222.120, and to withdraw the same from Jackson County Fire Protection District No. 3 and Bear Creek Valley Sanitary Authority, and to establish the zoning district therefore pursuant to the City's comprehensive plan and zoning map and Municipal Code Section 17.12.060, and WHEREAS, notice of the public hearing was duly given in accordance with said ordinance and said public hearing on the questions of said annexation, with- drawals and establishment of zoning district was duly held at the scheduled ad- journed Council meeting on June 9, 1988, at which time all persons were given an opportunity to be heard, and WHEREAS, the comprehensive plan and zoning map for the City establishes the zoning district for said territory in the event of annexation as R-1, as shown upon said map, now, therefore, THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS FOLLOWS: Section 1. That the parcels of real property adjacent to the City owned by Petitioners Gerald L. Klocke and Kathy M. Klocke, Bob Geiger and William Hamilton, more particularly described as follows: ORDINANCE N0. 1604 - Page 1 Klocke: Lot One, Block Two, HOMESTEAD ACRES, Jackson County, Oregon. Geiger: Lot Thirteen, Block Two, HOMESTEAD ACRES, Jackson County, Oreyon Hamilton: Lot Ten, Block Seven, HOMESTEAD ACRES, Jackson County, Oregon be, and the same is hereby, proclaimed to be annexed to the City of Central Point, Oregon. Section 2. That in connection with said annexation, the City Administra- for shall submit to the Secretary of State of the State of Oregon a copy of this ordinance, a copy of Ordinance no. 1602, and a copy of the consent documents and/or petition for annexation and shall, within ten (10) days of the effective date of this annexation, report this annexation to the County Clerk, County Asses- sor and Department of Public Works (County Engineer) of Jackson County, Oregon, and to the Department of Revenue of the State of Oregon, all in the manner pre- scribed by law. Section 3. That the above described territory annexed to the City be, and the same is hereby, withdrawn from Jackson County Fire Protection District No. 3 and Bear Creek Sanitary Authority, and, pursuant to ORS 222.520, the City of Central Point assumes and agrees to pay the amount of taxes which would otherwise be extended each year against the property hereby withdrawn for the retirement of bonded debt, subject to the right of the city to obtain reimbursement therefor from the property owner(s) of the property withdrawn. Section 4. That in connection with said withdrawal, the City Administra- for shall forthwith file certified copies of the within ordinance with the Jackson County Assessor and with the governing bodies of Jackson County Fire Protection District No. 3 and Bear Creek Valley Sanitary Authority in the manner prescribed by law. Section 6. This ordinance being necessary for the immediate preservation of the public peace, health and safety of the City of Central Point, Oregon, based upon the failure of the sewage disposal systems of said properties and the immedi- ate need for connection to the City's sanitary sewer system, second reading is hereby waived and an emergency is hereby declared to exist pursuant to Charter Section 35, and this ordinance shall be in full force and effect immediately upon its passage by the Council and approval by the Mayor.
