HomeMy WebLinkAboutOrdinance 1602ORDINANCE NO. 1602 AN ORDINANCE DECLARING THE COUNCIL'S INTENT TO ANNEX PARCELS OF PROPERTY CONTIGUOUS TO THE CITY IN THE COUNTY SUBDIVISION KNOWN AS HOMESTEAD ACRES, WITHOUT AN ELECTION, TO WITHDRAW THE SAME FROM FIRE DISTRICT N0. 3 AND BEAR CREEK VALLEY SANITARY AUTHORITY, TO ESTABLISIi THE ZONE IN ACCORDANCE WITH THE CITY'S COMPREHENSIVE PLAN AND ZONING MAP, AND SETTING A DATE FOR PUBLIC HEARING THEREON, AND DECLARING AN EMERGENCY WHEREAS, a petition has been filed with the City of Central Point relating to the proposed annexation of the property described herein, in which petition a majority of the electors registered in the territory proposed to be annexed have consented in writing to said annexation, and in which the owners of more than half of the land in said territory have consented in writing to annexation of their land, and WHEREAS, the foregoing petition for annexation fully complies with Central Point Municipal Code Chapter 1.20 and has been submitted with the requisite preliminary plat, exterior boundary description and annexation fee, and WHEREAS, the Council has elected pursuant to ORS 222.120 to dispense with an election submitting said proposed annexation to the electors of the City and in lieu thereof to fix a day for a public hearing before the Council at which time the electors of the City may appear and be heard on the question of annexation, and WHEREAS, in the event of said annexation, it is the Council's intention to withdraw said territory from Jackson County Fire Protection District No. 3 and Bear Creek Valley Sanitary Authority, and to establish the zoning district therefor pursuant to the City's Comprehensive Plan and Municipal Code Section 17.12.060, and WHEREAS, the Planning Commission has reviewed and made recommendations to the City Council on the proposed establishment of zoning district for the property which is the subject of the annexation proposal, now, therefore, THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS I'OLLOWS: Section 1. Proceedings are hereby initiated for the annexation to the City of Central Point of the parcels of real property adjacent to the City owned by Petitioners Gerald L. Klocke and Kathy N. Klocke, Bob Geiger and V7illiam Hamilton, more particularly described as follows: ORDINANCE N0. 1602 _ 1 (051788) Klocke: Lot One, Block Two, HOMESTEAD ACRES, Jackson County, Oregon. Geiger: Lot Thirteen, Block Two, IOMESTEAD ACRES, Jackson County, Oregon. Hamilton: Lot Ten, Block Seven, HOMESTEAD ACRES, Jackson County, Oregon. Section 2. The public hearing on the question of annexation of the above described parcel of real property to the City of Central Point, the withdrawal thereof from Jackson County Fire Protection District No. 3 and Bear Creek Valley Sanitary Authority, and the establishment of the zoning district of said property, will be held at the regular meeting of the Central Point City Council on the ~qfi{~ day of dun ~ , 1988, commencing at 7:00 p.m, at the Central Point City Hall, at which date, time and place all interested persons may appear to be heard on the question of said annexation, withdrawal from special district and establishment of zoning district. Section 3. The City Administrator is directed to cause notice of hearing on the issues of annexation, withdrawal from special district and establishment of zoning district to be published once each week for two successive weeks prior to the date of hearing in the Medford Mail Tribune, a newspaper of general circulation in the City of Central Point, Oregon, with the second publication to be no less than twenty-four hours prior to said hearing, and shall cause notices of the hearing to be posted in four public places in the City for two successive weeks prior to the date of hearing. Section 4. This ordinance being necessary for the immediate preservation of the public peace, health and safety of the City of Central Point, Oregon, based upon the failure of the sewage disposal system of said property and the immediate need for connection to the City's sanitary sewer system, second reading is hereby waived and an emergency is hereby declared to exist pursuant to Charter Section 35, and this ordinance shall be in full force and effect immediately upon its passage by the Council and approval by the Mayor.
