AN ORDINANCE DECLARING TFIE COUNCIL'S INTENT TO ANNEX
A PARCEL OF PROPERTY CONTIGUOUS TO THE CITY, ,
BOUNDED GENERALLY BY TAYLOR ROAD AND SOUTHERN PACIFIC `.-"

BEAR CREEK VALLEY SANITARY AUTHORITY, TO ESTABLISIi ='
THE ZONING DISTRICT THEREFORE, AND SETTING A '"? ~ '+
DATE FOR HEARING THEREON
WHEREAS, a petition has been filed with the City of Central
Point relating to the proposed annexation of the property
described hereinafter, in which petition a majority of the
electors registered in the territory proposed to be annexed have
consented in writing to said annexation, and in which the owners
of more than half of the land in said territory have consented in
writing to annexation of their land, and
WHEREAS, the foregoing petition for annexation fully
complies with Central Point Municipal Code Chapter 1.20 and has
been submitted with the requisite preliminary plat, exterior
boundary description and annexation fee, and
VdHEREAS, the Council has elected pursuant to ORS 222.120 to
dispense with an election submitting said proposed annexation to
the electors of the City and in lieu thereof to fix a day for a
public hearing before the Council at which time the electors of
the City may appear and be heard on the question of annexation,
and
WHEREAS, in the event of said annexation, it is the
Council's intention to withdraw said territory from Jackson
County Fire Protection District No. 3 and the Bear Creek Valley

Sanitary Authority, and to establish the zoning district therefor
pursuant to the City's comprehensive plan and Municipal Code
Section 17.12.060, and
WHEREAS, the Planning Commission has reviewed and made
recommendations to the City Council on the proposed establishment
of zoning district for the property which is the subject of the
annexation proposal, now, therefore,
THE PEOPLE OF THE CITY OF CENTRAL POINT DO ORDAIN AS
FOLLOWS:
Section 1. Proceedings are hereby initiated for the
annexation to the City of Central Point of the parcel of real
property adjacent to the City, bounded by Taylor Road and the
Southern Pacific Railroad right-of-way, a more particular
description of which is attached hereto, marked Exhibit "A" and
which is by this reference incorporated into the within
ordinance.
Section 2. The public hearing on the question of annexation
of the above described parcel of real property to the City of
Central Point, the withdrawal thereof from Jackson County Fire
Protection No. 3 and Bear Creek Valley Sanitary Authority, and
the establishment of the zoning district of said property will be
held at the regular meeting of the Central Point City Council on
the 19th day of May , 1988 commencing at 7:00 p.m. at the
Central Point City Hall, at which date, time and place all
interested persons may appear to be heard on the question of said
annexation, withdrawal from special district and establishment of

Section 3. The City Administrator is directed to cause
notice of hearing on the issues of annexation, withdrawal from
special district and establishment of zoning district to be
published once each week for two successive weeks prior to the
date of hearing in the Medford Mail Tribune, a newspaper of
general circulation in the City of Central Point, Oregon, with
the second publication to be no less than 24 hours prior to said
hearing, and shall cause notices of the hearing to be posted in
four public places in the City for two successive weeks prior to
the date of hearing.
Section 4. In addition to the foregoing notice, the City
Administrator shall send notice of the public hearing regarding
the establishment of zoning district by registered or certified
mail, not less than 7 days prior to the date of the hearing to
the owners of property situated within a 200 foot radius of the
boundaries of the property which is the subject of the foregoing
petition, as shown on the current Assessor's tax rolls, and
following such mailing, shall certify to the transcript of the
within proceedings compliance with this ordinance, listing the
names, addresses and tax roll information for all persons to whom
said notice was mailed and the date of mailing, and specifying
the Assessor's maps reflecting the location of the properties of
persons to whom said notice was mailed.

Commencing at the corner common to Sections 3, 9, 9 and
10, Township 37 South, Range 2 West of the Willamette
Meridian in Jackson County, Oregon; thence along the South
boundary of said Section 3, North 89 99' 30" East, 3292.7
feet to the Southeast corner of the Incorporated Town of
Central Point by Annexation Ordinance No. 825 for the true
op int of beginning; thence along the Easterly boundary of the
Incorporated Town of Central Point by said Ordinance, North
~Y 0 SO' 30" West, 30.00 feet to a 1 1/9" iron pin located on
the Northerly right-of-way line of Taylor Road at the
.. Southwesterly corner of tract described in Instrument No.
87-10160 of the Official Records of said County; thence along
the Westerly boundary of said tract and to and along the
Westerly boundary of Parcel No.s 1 and 3 described in
Instrument No. 83-19890 of said Official Records (also
running along the Easterly boundary of the Incorporated Town
of Central Point by said Annexation Ordinance No. 825), North
0 10' 30" West, 859.93 Eeet to a 3/9" iron bolt located at
the Northwest corner of said Parcel No. 3; thence along the
Southerly boundary of tract described in Instrument No.
67-01596 of said Official Records, South 89 49' 20" West,
639.2 feet (record = South 89 95' West, 639.7 feet) to
intersect the North-South centerline of said Section 3;
thence along said Section North-South centerline, North
0 18' 30" West, 944.4 feet (record = North 0 15' West,
